ITEM BACKGROUND: At its November 14, 2016 Special BOCC Meeting to discuss potential financing options for the -term and long-term options for the canal restoration program. The first two options are: Option 1: Do nothing. Stop all canal restoration efforts and terminate the program. Do not fund any Operations and Maintenance costs on completed canals or canals in-process of restoration. Option 2: Move forward with a discussion at a minimum of the financing options for the Demonstration Projects Operations and Maintenance costs. If the BOCC wishes to pursue Option 2, it is necessary for staff to move forward a resolutionnow that would be heard at the December 2016 BOCC regular meeting, for the following reasons. A.Possible funding sources that have been identified for Option 2 include levying a special assessment or a stormwater utility fee to pay for the annual O&M costs. B.The timeline from the first steps for the levy or imposition of the assessment to collection of the money is approximately twelve (12) months. C.Under F.S. 197.3632(3)(a), any local government that elects to use the uniform method of collecting an assessment for the first time shall adopt a resolution at a public hearing prior to January 1, indicating its intent to use the uniform method to collect the method. (The uniform method of collecting a non-ad valorem assessment is to place the assessment on t 2016 meeting, and it requires four (4) consecutive weeks of advertising prior to the December meeting. 4EGOIX4K 4 D. advance of the December BOCC meeting. resolution does not bind the BOCC to vote to approve the resolution at its December meeting ; it only preserves the right of the BOCC to hear the resolution in December 2016. to approve either an assessment or a utility fee for canal restoration during FY 17. Approval of a special assessment or a stormwater utility fee would require BOCC approval of an initial assessment resolution and final assessment resolution in Spring/Summer 2017. In order to meet this timetable, it is the intention of staff to present an overview of Option 1 and Option 2 at the October BOCC meeting, and to seek preliminary direction regarding whether to advertise the Notice of Intent resolution prior to the December meeting. If the BOCC gives this direction, staff will place the advertising. Staff will also bring back all formal ordinances and resolutions in November and December. Options 3 and 4, also to be discussed at the November 14, 2016 Special Meeting include a discussion of the potential use of various sources of potential funding, including RESTORE and Stewardship funds. It will also include a discussion about the overall commitment required for a potential full restoration program if that option is desired.
