ITEM BACKGROUND: Keith and Schnars (K&S) was retained to update the County's Comprehensive Plan Technical Document; complete an Evaluation and Appraisal Report (EAR) of the Comprehensive Plan (CP); complete Comprehensive Plan text amendments; and complete Land Development Code(LDC)amendments. PREVIOUS RELEVANT BOCC ACTION: December 16, 2009 — BOCC approved contract to update the Monroe County Year 2010 Technical Document, Evaluation and Appraisal Report(EAR),Comprehensive Plan Amendments, and Land Development Code. September 15, 2010—BOCC approved Amendment No. 1 which amended the work program and deliverable schedule without a change to the total fee of the contract. October 20, 2010—BOCC approved Amendment No. 2 amending Master Schedule `B" referencing the work program timeline and deliverable schedule. May 18, 2011 — BOCC approved Amendment No. 3 amending Exhibit "A" Scope of Services for Phase II to include services relating to the Environmental Impact Statement. August 17, 2012 - BOCC approved Amendment No. 4 amending Exhibit "A" Scope of Services and Exhibit `B" to increase compensation $96,183.00, for additional services related to data collection, development of existing conditions to prepare the technical document (primarily existing land use mapping and acreage/density/intensity information), population projection approval by the Department of Community Affairs, and timeline adjustments due to recent statutory amendments to Chapter 163,F.S. (HB 7207). June 20, 2012 — BOCC approved Amendment No. 5 amending Exhibit "A" Scope of Services, for additional services oncerning the Naval Air Station Environmental Impact Study or other studies or activities connected with the National Environmental Policy Act documents published by the Nary that potentially affect the County in relation to state requirements for military installation compatibility and increasing compensation by$46,000.00. June 20, 2012 — BOCC approved Amendment No. 6 amending Exhibit "A" Scope of Services, for additional services identifying any potential deficiencies in the County Comprehensive Plan policies and land development code relative to State regulations on mining operations, including minimum permitting requirements for mines and the minimum legal requirements for remediation and restoration after a mine if officially abandoned and an increase in compensation by $7,500.00. September 21, 2012—BOCC approved Amendment No. 7 to reorganize the remaining phases of the contract, without a change to the total fee of the contract, in order to reduce the potential for conflicts between the Comprehensive Plan and the Land Development Code, and minimize the time period between the adoption of the Comprehensive Plan Amendments(Phase III)and the adoption of revisions to the Land Development Code(Phase IV). February 26, 2013—BOCC approved Amendment No. 8 for additional services to evaluate the Coastal Barrier Resource System (CBRS) Comprehensive Plan policies to determine whether they add any additional protection to land over and above Comprehensive Plan and Land Development Regulation (LDR) policies that govern the Tier System and an increase in compensation by$40,600.00. CONTRACT/AGREEMENT CHANGES: Adjusting Exhibit B to revise and align Phase 3 and Phase 4 tasks and reorganizing Phase 4 tasks (LDC) to include additional public hearings to provide additional review and comment by the public, Planning Commission and BOCC on the draft LDC amendments and to receive updated deliverables incorporating the comments received from the additional meetings. This Ninth Amendment (Amendment) to the Contract for Professional Services dated December 16, 2009 between Monroe County (County) and Keith and Schnars, P.A. (Consultant) is made and entered into this 19th day of February, 2014. ITN : WHEREAS, Consultant was retained to update the County's Comprehensive Plan Technical Document (Phase 1), complete an Evaluation and Appraisal Report (EAR) of the Comprehensive Plan (Phase II) , complete Comprehensive Plan Text Amendments (Phase III) and EAR based Land Development Code amendments (Phase IV); and WHEREAS, in order to reduce the potential for conflicts between the Comprehensive Plan and the Land Development Code, the County desires to minimize the time period between the adoption of the Comprehensive Plan Amendments (Phase III) and the adoption of revisions to the Land Development Code (Phase IV) and has requested the Consultant move forward the Phase IV schedule; and WHEREAS, the County and Consultant desire to clarify Phase III, Task 4 deliverables, in order to provide additional deliverables for BOCC meetings which will incorporate the direction received from the LPA during Phase III and BOCC direction from review meetings; and WHEREAS, the County and Consultant desire to clarify Phase III, Task 5 deliverables; and WHEREAS, the County and Consultant desire to eliminate Phase IV, Task 2.3 and 2.4 (meetings to discuss the Recommendations and Revisions Report); and WHEREAS, for Phase IV, both County and Consultant see the need for additional meetings for the Planning Commission (PC) and Board of County Commissioners (BOCC) to review and discuss the draft Land Development Code amendments, and to amend the Task 5 deliverables accordingly to provide additional Amendment#9 February 19,2014 Page 1 copies of the proposed land development code amendments for review by the PC and BOCC; and WHEREAS, the County and Consultant desire to eliminate one meeting from Phase IV, Task 7 (Phase IV, Task 5 includes the PC public hearing that is being eliminated in Task 7); and WHEREAS, these amendments result in additional fees of $6,325.00 for Phase III and additional fees for Phase IV of $5,826.00; for a total increase of $12,151.00; and WHEREAS, the above noted changes are being incorporated into the revised Exhibit A Scope of Services and Exhibit B (attached). NOW, THEREFORE, the parties agree that: Section 1. Exhibit A Scope of Services for Phase III and IV shall be amended as shown (attached) and summarized as follows: 1. Phase III, Task 4 compensation has increased by Five Thousand and Fifty Dollars ($5,050.00) for the additional hard copies and digital copies of draft comprehensive plan amendments to receive additional deliverables which incorporate the public comments and BOCC direction. Consultant's Lump Sum Fee for Phase III, Task 4 shall be Thirty-seven Thousand, Sixty-five Dollars ($37,065.00). 2. Phase III, Task 5 compensation has increased by One Thousand Two Hundred and Seventy-five Dollars ($1,275.00) for the additional hard copies and digital copies of comprehensive plan amendments. Consultant's Lump Sum Fee for Phase III, Task 5 shall be Forty Thousand, Eight Hundred and Thirty Dollars ($40,830.00). 3. The Total Lump Sum Fee for Phase III has increased by Six Thousand Three Hundred and Twenty-five Dollars ($6,325.00) for a total of Two Hundred, Twenty- eight Thousand, One Hundred and Four Dollars ($228,104.00) 4. Phase IV, Task 2 compensation shall be reduced by Eleven Thousand, Three Hundred and Fourteen Dollars ($11,314.00) due to the shifting and conversion of meetings. Consultant's Lump Sum Fee for Task 2 shall be Forty Thousand, Nine Hundred and Ninety Dollars ($40,990.00). 5. Phase IV, Task 5 compensation shall be increased by Twenty-one Thousand, Four Hundred, and Seventy-two Dollars ($21,472.00) for additional meetings added and deliverables. Phase IV, Task 7 compensation shall be decreased by Four Thousand, Three Hundred and Thirty-two Dollars ($4,332.00) to eliminate a meeting that has been shifted to Task 5. Consultant's Lump Sum Fee for Task 7 shall be Four Thousand, Three Hundred and Thirty-two Dollars ($4,332.00). 7. The Total Lump Sum Fee for Phase IV has increased by Five Thousand, Eight Hundred and Twenty-six Dollars ($5,826.00) for a total of Two Hundred, Seventy- two Thousand, Three Hundred and Eighty Dollars ($272,380.00) 8. All other conditions of the contract entered into by the parties, and amendments to date which have not been superseded, remain in full force and effect. Section 2. Consultants Lump Sum Fee for Phase IV Task 2...............................................$40,990.00 TASK 3 - MEETINGS AND PUBLIC INVOLVEMENT 3.1 For the duration of Phase IV, K&S will participate in up to two (2) meetings per month (for up to a total of 14 meetings), either in person or via telephone, with County staff to discuss the status of the project and to solicit comments and feedback. This subtask is an ongoing activity and is not subject to the retainage clause in Section 4.2 of the Contract for Professional Services between the County and K&S. 3.2 K&S will participate in one (1) general public outreach event/program during Phase IV. 3.3 K&S will update the project website monthly, at a minimum. Progress reports shall include details of website updates completed every month. This subtask is an ongoing activity and is not subject to the retainage clause in Section 4.2 of the Contract for Professional Services between the County and K&S. Consultants Lump Sum Fee for Phase IV Task 3............................................$ 56,871.00 TASK 4-PREPARATION OF DRAFT LAND DEVELOPMENT CODE 4.1 Utilizing the results of the Tasks 2 and input gathered through the community involvement process and scoping and review meetings with County staff, K&S will prepare amendments to the County's LDCs. As directed, the codes shall be reorganized to unify the various requirements and consolidate subject matter into a user-friendly, simple to administer and 19 Monroe County Comprehensive Plan Update SCOPE OF SERVICES - EXHIBIT A Monroe County and Keith and Schnars, P.A. 9th Amendment, February 19, 2014 enforce, land development code that will implement the adopted Comprehensive Plan; the EAR.; Chapter 380 and Chapter 163, Part II, F.S.; and Rule 28-20 F.A.C; and conform with other applicable studies and plans. 4.2 During the drafting process, K&S will work closely with County Staff, the Planning Commission, the Development Review Committee (DRC), the BOCC, the state land planning agency and other agencies as necessary, to assure that the amendments are acceptable and to work through issues prior to submission to the County of the final amendments. 4.3 K&S will coordinate three (3) presentations before the DRC to review and discuss the draft amendments as noted in Task 4.1 4.4 Subsequent to the DRC meetings, K&S will coordinate one meeting with the DEO to review and discuss the draft amendments as noted in Task 4.1 Task 4 Deliverable: • Comment Response Form documenting the comments received during the DRC presentations and the state land planning agency Informal Review • 20 copies and 1 digital file of the proposed LDC amendments for the DRC meetings. K&S will coordinate with the County regarding public notice of the meetings. 5.2 K&S will present and provide an overview of the planning and regulatory documents prepared based on comments and direction received in task 5.1 (LPA recommendations)-at three (3) public hearings of the Board of County Commissioners; solicit the comments of the Commission members; and, develop a list of the concerns and suggestions provided at the meetings.
