ITEM BACKGROUND: On September 22, 1999, the Planning Commission approved an allocation award
for Giles A. Light for building permit application #97101905 provided the applicants' Lot Aggregation
Restrictive Covenant was approved by the Board of County Commissioners (BOCC). On April 20, 2000 the
BOCC approved the Lot Aggregation Restrictive Covenant which is intended to benefit and run in favor of the
County. Subsequently, it was recorded in the Monroe County Public Records on May 8, 2000. Although, the
restrictive covenant was recorded in the Monroe County Public Records the property owner did not pick up
building permit 97101905 and the allocation award expired.
Giles Light, is requesting the BOCC's approval to remove and release the Lot Aggregation Restrictive
Covenant recorded in the Monroe County Official Records Document #1178299, Book #1631, Page #2463.
The residential rate of growth ordinance(ROGO),Monroe County Code Section 138-28,Evaluation criteria has
a provision for lot aggregation point assignment; however, the code does not address expired allocation awards
or building permits.
On August 21, 2013, the BOCC heard a similar request for the release of a Lot Aggregation Restrictive
Covenant. The request was made by an applicant who had an active permit. This request differs from the
previous request because the allocation award expired and the permit was not issued. If the BOCC releases the
restrictive covenant, the applicant will move forward on two Building Permit Applications 13103806 and
13103807 and compete for two allocation awards in the Permit Allocation System(ROGO).
The BOCC directed staff to develop a Comprehensive Plan and Code amendment to address these situations.
Staff is working on this now.
PREVIOUS RELEVANT BOCC ACTION: On June 23, 1992, the BOCC adopted Ordinance No. 016-
1992 (ROGO); and Ordinance #009-2006 (Revised Residential Rate of Growth — Tier Ordinance) on
March 15, 2006. On August 21, 2013, the BOCC denied a request to release a Lot Aggregation Restrictive
Covenant to Steven L. and Marni Caputo who had an active permit for property identified with
RE#00545920.000000 and 00545920.000100.

STAFF RECOMMENDATION: Denial based on BOCC direction at August 21, 2013 BOCC
meeting to process amendments to preserve and uphold Lot Aggregation Restrictive Covenants but
consider a process which may allow points to be transferred to a new ROGO applicant/owner if they
apply for an allocation.

RELEASE OF RESTRICTIVE COVENANT FOR LOT AGGREGATION
Whereas, Giles A. Light, filed a lot aggregation restrictive covenant on May 8, 2000, in the
Monroe County Public Records Document#1178299, Book#1631, Page#2463 on the following
property in favor of Monroe County, Florida to restrict development to one dwelling unit on the
following property:
Lots 10 & 11, Mates Beach Plat #2, Little Torch Key, according to the plat
thereof recorded at Plat Book 3, Page 80 of the public records of Monroe
County, Florida;
and
Whereas, the Board of County Commissioners approves the removal of the lot aggregation
restrictive covenant provided no development has commenced on the property; and
Whereas, the property owner, Giles A. Light was approved for an allocation award on
September 22, 1999 by the Planning Commission for ROGO application 97101905; and
Whereas, the property owner, Giles A. Light, filed the Lot Aggregation Restrictive Covenant on
May 8, 2000 and subsequently let the allocation award expire on building permit application
97101905;
Now, therefore, on this 19th day of February, 2014, Monroe County, by and through its Board
of County Commissioners, hereby releases the above legally described property from the lot
aggregation restrictive covenant recorded in Document #1178299, Book #1631, Page #2463 of
the Official Records of Monroe County.
