AGENDA ITEM WORDING: Release of an Affordable Housing Deed Restriction recorded in the Monroe
County Public Records Document #1523764, Book 2125, Page 827 on June 21, 2005, at the request of TD
Group Retail,LLC.
ITEM BACKGROUND: On March 10, 2004, the Planning Commission approved an affordable housing
allocation award for Jack Reed for building permit application#03304488 provided the applicant's Affordable
Housing Deed Restriction was approved by the Growth Management Division Director. The Affordable
Housing Deed Restriction was approved by the Growth Management Division Director on May 11, 2005.
Subsequently, the restriction was recorded in the Monroe County Public Records Document #1523764, Book
2125, Page 827 on June 21, 2005, prior to the issuance of the building permit on June 22, 2005. Based on the
Building Department records, the permit received passed inspections for augers, grade beam, slab and columns.
The permit expired in 2007 and therefore, the ROGO allocation award expired as well. A site visit conducted
by staff on January 16, 2014 found some development which consisted of columns, slab, and partial
construction of walls.
The current property owner, TD Group Retail, LLC is requesting the release of the Affordable Housing"Deed
Restriction recorded in the Monroe County Official Records in order to complete the residential dwelling unit
without an Affordable Housing Deed Restriction. The property has changed hands several times and the TD
Group Retail, LLC purchased it from Centennial Bank. TD Group Retail, LLC submitted a building permit
application on July 22, 2013 and a ROGO Application for a market rate allocation on October 10, 2013. On
December 18, 2013 the Planning Commission reviewed and approved market rate rankings which included the
application from TD Group Retail. TD Group Retail, LLC was awarded a market rate allocation. Subsequent
to the approval of the rankings, the Planning Department discovered the property had a previously issued, but
expired permit which included an affordable housing deed restriction. On January 15, 2014, the Planning
Department was able to reach TD Group Retail, LLC (Guillermo Alvarez, Manager and Jose Alvarez Manager)
to explain that a market rate allocation could not be issued to a property which has an Affordable Housing Deed
Restriction. If the BOCC releases the deed restriction, the property owner will continue to move forward in
obtaining a building permit once the allocation award is issued.
The residential rate of growth ordinance (ROGO), Monroe County Code Section does not address the scenario
of expired building permits and expired allocation awards relative to an affordable housing deed restriction.
On August 21, 2013 the BOCC directed staff to develop a Comprehensive Plan and Code amendment to address
these situations. Staff is working on this now.
PREVIOUS RELEVANT BOCC ACTION: June 23, 1992, the BOCC adopted Ordinance No. 016-1992.
(ROGO); March 15, 2006, the BOCC adopted Ordinance #009-2006 (Revised Residential Rate of Growth —
Tier Ordinance);
October 17, 2012 , the BOCC approved the release of Affordable Housing Deed Restriction to Mr. Arnold on
property with columns identified with RE#00172061.001200;
August 21, 2013, the BOCC approved the release of Affordable Housing Deed Restriction to Mr. Alexander on
vacant property identified with RE#00532701.039200.

RELEASE OF AFFORDABLE HOUSING DEED RESTRICTION
Whereas, Jack and Masumi Reed filed an affordable housing deed restriction on June 21, 2005,
in the Monroe County Public Records Doc #1523764, Book 2125, Page 827 on the following
property in favor of Monroe County, Florida to restrict development to affordable housing on the
following property:
Lot 15, Block 14, Twin Lakes, Key Largo, according to the plat thereof
recorded at Plat Book 3, Page 160 of the public records of Monroe County,
Florida;
and
Whereas,Jack and Masumi Reed are no longer the property owners, the property has
some development which consist of columns, slab, and a partial construction of walls,
and the building permit issued in 2005 has expired; and
Whereas, the current owner, TD Group Retail, LLC, has requested the release in
order to build a market rate dwelling unit; and
Whereas, the Board of County Commissioners approves the removal of the affordable housing
deed restriction on the property;
Now, therefore, on this 19 day of February, 2014, Monroe County, by and through its Board of
County Commissioners, hereby releases the above legally described property from the affordable
housing deed restriction recorded in Doc #1523764, Book 2125, Page 827 of the Official
Records of Monroe County.
