AGENDA ITEM WORDING: Approval of joint participation agreement, amended and restated 99-year
lease agreement and revocable license agreement with the City of Key West to provide a new site location
to build a new animal control facility to serve the Lower Keys and Key West.
ITEM BACKGROUND: The animal control facility on Stock Island is in overall poor condition and the
County's Lower Keys animal control contractor, the FKSPCA, has raised funds in order to build a new
shelter. The FKSPCA has requested support from the City of Key West and the County to further this
project. The City, in consideration of this request, has proposed a new site location and has provided an
amended 99-year lease agreement to the County whereby property located at the old transfer station on
Stock Island, as described in more detail as schedule B in the lease agreement, will be leased under the
remaining term of the 99-year lease or until November 11t', 2084. The County and City also entered into a
Joint Participation Agreement (JPA) in 1978 and in order to further clarify the current obligations of the
parties a revised JPA has also been drafted. The revocable license agreement is to provide open space for
the purpose of exercising animals pursuant to normal animal shelter operations.
PREVIOUS RELEVANT BOCC ACTION:
• May 16, 1978, the BOCC and City entered into JPA for a period of 25 years which set forth the
obligations of the parties at that time.
• December 20, 1985, BOCC and City entered into 99-year lease agreement whereby the City leased
the current animal control shelter location and in exchange the County is responsible for animal
control enforcement and services in the City.
• The BOCC passed resolution 262-2007 exploring the possibility of the City of Key West deeding
to Monroe County the parcels of land on Stock Island now use for animal control offices,
sheltering, parking and associated uses to facilitate the building of a new animal control/sheltering
facilities at the current location.
• March 19, 2014, an Amended and Restated Agreement with the FKSPCA is also before the BOCC
for approval. The Amended and Restated Agreement with the FKSPCA binds the FKSPCA to
adhere to all of the terms and conditions as set forth in the amended 99-year lease agreement and
revised JPA and the revocable license agreement.
CONTRACT/AGREEMENT CHANGES: Adds new site location as described in more detail in
schedule B to be exclusively used and developed as an animal control shelter; the development of the new
animal control facility/project must meet and progress under the schedule of deadlines set within the lease;
upon obtaining a certificate of occupancy for new site location the County will have 90 days to vacate the
current location; the County will be responsible for demolition and removal of the current shelter.
