AGENDA ITEM WORDING: Discussion and direction to proceed with further collection actions
against GGH 36 LLC including but not limited to foreclosing on the code compliance liens on the subject
property located at vacant lot next to 29114 Cedar Drive, Big Pine Key,Florida, which liens were a result
of code compliance case numbers CE 13020110 and CE06070026.
ITEM BACKGROUND:
The subject property has been the subject of code compliance cases starting as early as February 20, 2013
when Code Compliance received complaints from a neighbor that the subject property vacant lot was
being used to park and store trailers.
CE130201 10: The Special Magistrate found the subject property owner in violation of 3 violations: MCC
130-83(5) accessory use of the subject property for storing of barbeques/smoker that may not be
established prior to the principal use to which it is accessory; MCC 21-20(a) the subject property needs to
be cleaned;MCC 6-144(7)b failure to obtain the final inspection on the permit for docking facility(permit
08102408), and imposed daily fines in the amount of$300.00, ($100.00 per count) if not compliant by
October 11, 2013.
Compliance was achieved on violation MCC 130-83(5) on May 16, 2014. Therefore on that violation
$100.00 per day fine accrued for 216 days, (from October 12, 2013 through May 16, 2014), and total
$21,600.00. The property owner has not gained compliance on 2 violations; MCC 21-20(a) property
needs to be cleaned and MCC 6-144(7)b failure to obtain final inspection on pen-nit 08102408. Pursuant
to the Final Order fines in the amount of$200.00 per day have been accruing for 258 days and the case
remains open for failure to gain compliance and failure to pay fines and costs. Additionally the violation
of MCC 130-83(5), accessory use of subject property prior to the establishment of a principal use has
reoccurred. The current total amount of the fines is $73,200.00. The current amount of the costs is
$346.01. The Final Order was recorded as a lien on January 17, 2014. This lien is a lien on the subject
property and any real and personal property owned by the property owners.
CE06070026: As a result of this code action the County obtained a final judgment of foreclosure(against
the vacant lot referenced above), a money judgment and writ of execution(against an adjoining property
at the time which was homesteaded) and an injunction against the then property owner(Robin Eubanks).
This final judgment was attached to the above referenced lot at the time the property owner purchased it
by tax deed. F.S. 197.552 states that County Government liens survive the issuance of a tax deed. Also
code compliance liens run with the land. Therefore the Final Judgment entered in Circuit Court case
Number CA-K-07-1663 on August 23, 2009 survives on the vacant lot against the property owner, GGH
36 LLC.
On March 19, 2014 the BOCC passed and adopted resolution 057-2014 adopting procedures to be used
after a Final Order has been rendered. This property is not homesteaded.
The available legal options in regard to the County's liens are:
1. Initiate litigation against GGH 36 LLC for foreclosure,money judgment and writ of execution;
2. Allow the liens to remain against the property owners, the subject property and any other
property that they own; and/or
3. Reduce the amount of the fines.

THIS CAUSE having come before the Court upon Plaintiff's Motiorrf1 r�; rn_N�y o
Judgment and the Court having considered the pleading and proof submitted and having
received no objection from Defendant Robin L. Eubanks, it is thereupon
ADJUDGED as follows:
1. Legal service of process has been had upon all defendants; this court has
jurisdiction over the parties in this cause and the subject matter of the cause;
and the allegations contained in the complaint have been proven by
competent evidence.
2. The code enforcement lien being sued upon by Plaintiff in this matter
constitutes a valid lien on the properties located at and the lien has not
heretofore been satisfied by the Defendant.

5. If the total sum due, with interest at the rate prescribed by law, and all costs
of this action accruing subsequent to this judgment are not paid, the Clerk of
this Court shall sell the property at public sale, on w t✓ , 2009, at
(/-00 A rn [NO EARLIER THAN MAY 15, 2009]. or sue time as shall be
scheduled by the Clerk, to the highest bidder or bidders for cash, except as
set forth hereinafter, at the front door of the Monroe County courthouse, in
Key West, Florida, in accordance with F.S. 45.031, except the Clerk shall
not conduct the public sale unless Plaintiff or its representative is present to
bid at sale. Plaintiff may cancel the sale on notice to the Clerk and without
further order of this Court.
6. Plaintiff shall advance all subsequent costs of this action and shall be
reimbursed for them by the Clerk if Plaintiff is not the purchaser of the
property at the sale. If Plaintiff is the purchaser, the Clerk shall credit
Plaintiff's bid with the total sum due hereunder with interest and costs
accruing subsequent to this judgment or such part of it as necessary to pay
the bid in full.
7. After confirmation of the sale,whether confirmation be by the Clerk's filing
the Certificate of Title or by order of this Court ruling on objections to the
sale, the Clerk shall distribute proceeds of the sale so far as they are
sufficient, by paying: first, all of Plaintiff's costs; second, documentary
stamps affixed to the certificate; third, Plaintiff's attorneys' fees; fourth, the
total sum due to Plaintiff plus interest at the rate prescribed by law from this
date to the date of the sale: and last, by retaining any amount remaining
pending further order of this Court.
8. After confirmation of the sale, whether confirmation be by the Clerk's filing
the Certificate of Title or by order of this Court ruling on objections to the
sale, Defendant and all persons claiming by, through, under, or against them
since the filing of the Lis Pendens herein, shall be forever foreclosed of all
right, title, interest, estate, or claim in the property being sold and the
purchaser at the sale shall be let into possession thereof.
9. After confirmation of the sale, whether confirmation be by the Clerk's filing
the Certificate of Title or by order of this Court ruling on objections to the

sale. the Clerk shall at the request of Plaintiff immediately issue a Writ of'
Ilossession.
10. The Court does not determine at this time whether Defendant is personally
liable for damages under the lien sued upon, and therefore. this judgment is
without prejudice to the Defendant asserting any defenses to liability for
damages should Plaintiff hereafter file a Motion for Deficiency Judgment.
11. The Clerk, upon request of the purchaser at the foreclosure sale, shall issue a
Writ of Possession of the property to accomplish possession by the
purchaser without further order of the Court. Jurisdiction of this action is
retained to enter further orders as are proper, including, without limitation,
writs of possession and deficiency judgments.
12. The United States of America shall have a right of redemption provided by
28 U.S.C. § 2410(c) for the period therein running from the date of the
issuance of Certificate of Title issued therein.
ON COUNTS TWO AND THREE: FOR MONEY JUDGMENT AND WRIT
OF EXECUTION
13. A final judgment is entered in favor of Plaintiff Monroe County and against
Defendant Robin L. Eubanks, 29114 Cedar Drive, Big Pine Key, FL 33043,
in the principal sum of$151.200.00, plus $575.00 as costs, and $1,900.00 in
attorneys' fees, for a total sum of$153,675.00; for all of which let execution
issue. Interest shall continue to accrue at the rate of 8% per year or $33.68
per day.
ON COUNT FOUR: FOR INJUNCTIVE RELIEF
14. Within ninety (90) days from the date of this Judgment, the Defendant is
hereby required to correct the violations of the Monroe County Code as set
forth in the Findings of Fact, Conclusions of Law, and Order signed by
Special Magistrate in Monroe County Code Enforcement Case No.
CE06070026, recorded in the Official Records of Monroe County as
Document 1624592, Page 202, Book 2270, by obtaining an after-the-fact
permit and passing final inspections by the Monroe County Building
Department or obtaining a demolition permit and passing final inspections
by the Monroe County Building Department to correct said violations.

1.5. Any person violating this Judgment may be subject to civil or criminal
contempt proceedings, punishable by sanctions including imprisonment up
to a tern of one year pursuant to Sections 38.22 and 38.23, Florida Statutes,
and the Court retains jurisdiction for the enforcement of this provision.

THIS CAUSE having come before the Code Enforcement Special Magistrate for a public

C. Noncompliance by the above date will result in the imposition of a fine,$100.00

required prior to the following: (1)Any work specified in chapter 6.0; an after the fact permit
is required for downstairs enclosure, widows platform, spiral staircase, outdoor lighting,

THIS CAUSE having come on for public hearing before the Special Magistrate on
December 15' 2006, after due notice to the,Respondent(s), at which time the Special
Magistrate heard testimony under oath, received evidence, and issued his Order finding
the Respondent(s) in violation of Monroe County Code Section(s): §9.5-1110),
§9.5-391.
Said Order, and subsequent orders, required the Respondent(s) to correct the
violation(s) by January 18'h 2007, and further, that failure to correct the violation(s) by
