This meant that the amount of clearing on the site was severely restricted (causing changes in site layout) and the landscaping mitigation requirements were significantly increased. Porter Work Proposal Dated 9/28/04 Recommendations Dear William, Attached is D.L. Porter's response to Proposal Request No. 29, Landscape Revisions. As you are aware, the Village of Islamorada has required mitigation of trees removed for the fire lane based on their L.D.R. requirements for high quality hammock designation. Therefore, we re- designed the landscape plan and utilized the landscape design services of Craig Reynolds to ensure compliance and minimize cost impact to Monroe County. Also, Porter has requested a time extension from September 14 to whatever date they are authorized to proceed. For purposes of this recommendation, I will assume they will receive Monroe County's approval on Monday, October 4, 2004, or 20 days. Also, as discussed, Porter has requested $500 per day for general conditions expenses, which, as I explained to you, Monroe County will not pay. Therefore, I will deduct that request and let the appropriate parties debate it later, so that any further delays are minimized. My recommendation is made with consideration given to the following. 1. The change is necessary because the Village of Islamorada has required additional mitigation beyond the original permit plans. 2. Monroe County's biologist prepared a habitat analysis that was included with the specifications when originally bid. The landscape plan was prepared based on that report as a moderate quality hammock. The change came after the contract was executed. 3. Because of the above, landscape plans were not designed to mitigate high quality hammock and this work cannot be considered an error or omission. 4. The pricing is fair. 5. The time delay and contract extension is justified. The paving cannot proceed until the landscape work is complete. The contract requirement that paving be the last item of work was made to ensure Monroe County an undamaged parking lot at project completion. (This decision was made because of paving punch list issues at Marathon Park.) 6. The Village of Islamorada has accepted our mitigation landscape plan.
