ITEM BACKGROUND: Gorman & Company, Inc. (Gorman) is requesting a reservation of forty-two (42) affordable housing allocations pursuant to Monroe County Code Section 138-24(b)(2). Gorman is proposing to develop the site in Key Largo (located behind the Winn Dixie store at mile marker 105) with florty-two (42) affordable housing units. The Monroe County Planning Commission approved a Minor Conditional Use Permit Resolution on April 15, 2014, as memorialized in Resolution P14-14 allowing the development of an institutional residentrial use including 47 deed-restricted affordable housing units. The Planning and Environmental Resources Director approved a Minor Deviation to the Minor Conditional Use modifying the project boundary and reducing the approved number of affordable 110LISing units from forty-seven (47)to forty-two(42). Gorman utilizes Low Income Housing "Fax, Credits (LIHTC) to develop and manage affordable housing projects throughout the United States and Currently has two approved projects located in the Florida Keys. Gorman was selected by Monroe County to develop the "BILiewater" property in Tavernier (approximate mile marker 92) with 36 affordable housing units. The "BILiewater" project was completed in 2011. Gorman developed the "Wet Net" property in Islamorada (approximate mile marker 8 1)with 36 affordable housing units completed in 2014. The resolution states that the allocations must be used and building permits pulled by November 18, 2015. PREVIOUS RELEVANT BOCC ACTION: September 17, 2013 the BOCC approved a reservation of 50 affordable housing allocations for the Gorman project until July 31, 2014. WHEREAS, on October 29, 2014, RC3 WORLD submitted a request to re-establish and reduce the number of affordable housing reservations for Gon-nan & Company, Inc. (Gorman), Paradise Point Senior Housing Project at(RE # 00084260-000 100) approximately MM 105 in Key Largo; and WHEREAS, the Board of County Commissioners previously reserved fifty (50) affordable housing allocations(very low, low and median income categories) in Resolution 261-2013 unitl July 31, 2014; and WHEREAS, the October 29, 2014, RC3 WORLD submission reduces the requested reservation for affordable housing allocations(very low, low and median income categories)to forty-two (42)units; and WHEREAS, Gorman has applied for and intends to use low income housing tax credit (LII-ITC) financing and other state and federal assistance to finance and construct the project and qualifies for the reservation of forty-two(42)affordable housing ROGO allocations as provided in MCC Sec. 138-24(b)(2); and WHEREAS, Monroe County (..ode Section 138-24(b)(2) authorizes reservations for affordable housing ROGO allocations as follows for: "(2) Specific affordable or employee housing projects participating in a federal/state housing financial assistance or tax credit program or receiving some form of direct financial assistance from the county upon written request from the project sponsor and approved by resolution of the board of county commissioners."and WHEREAS, Monroe County Code Sec. 138-24(b) allows the reservation of affordable ROGO allocations by the Board; however, building permits must be picked up within six nionths, of the reservation, unless otherwise authorized by the Board;, and WHEREAS, there currently exists a balance of 226 affordable housing allocations (114 allocations very low, low, & median category and 112 allocations moderate category) at the Conclusion Of Quarter I Year 23 (October 14, 2014); and WHEREAS, the current affordable housing allocation 226 balance does not include the previously reserved fifty(50)allocations for Gorman which has now expired; and WHEREAS,the reservation of affordable housing allocations for the anticipated project does not exempt the project frorn applicable requirements in the Monroe County Land Development Code, and other regulatory requirements; and Page 1 of 2 WHEREAS, the Monroe County Planning Commission approved a Minor Conditional Use Permit Resolution on April 15,2014, as memorialized in Resolution P14-14, allowing the development of an institutional residentrial use including 47 deed- restricted affordable housing units; and WHEREAS, the Planning and Environmental Resources Director approved a Minor Deviation to the Minor Conditional Use modifying the project boundary and reducing the approved number of affordable housing units from forty-seven(47)to forty-two(42); and WHEREAS, the reservation of these allocations for a period of greater than six months is necessary to correspond to the financing requirments, for the federal/state financial assistance program utilized by Gorman; NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS: Section 1. The Board previously reserved 50 allocations for our project per Resolution 2013-216 (attached). However, this reservation expired July 31, 2014. We had anticipated being able to utilize the allocations by this previous date however due to circumstances the project has not progressed at the pace originally desired. We however have made substantial progress on the project: including award of LIHTC credits by Florida Housing; Minor Conditional Use Approval by the Development Review Committee and Planning Commission and full construction drawings. We have recently met with Monroe County Growth Management Division regarding the permit process and anticipate permit submission within the next month and issuance by the end of year. Although the initial concepts anticipated 50 reservations the final approved project only requires 42 ROGO's which we are requesting reservation of by the Board.
