According to the tales shared with me by Dagny Johnson, Grace Mannillo and Marie Landry-Shinkevich the battle-was fought County-wide with slogans, petitions, bumper stickers and rallies. The issue was huge thirty-five years ago and the issue is huge today. Thanks to these efforts, and the continued support for the 35-foot height limit, Monroe County is different from most other places, including Key West. The unique community character of the Florida Keys is essential to our economic survival. It is an asset that we need to protect. Our height ordinance dates back to 1979. The pre-firm/post-firm date for Monroe County is 1974. For forty years we have been elevating our homes to protect us from floods. For thirty-five years we have successfully been building ----------------structures that comply with FEMA that are under the 35-foot height limit. Yes, we are now dealing with sea level rise and exorbitant flood insurance rates, and yes we need to find solutions to these problems, but we need to do so very carefully. We need to address each of the five issues raised in the staff report individually. We need to gather and analyze the data. We need to be very careful about unintended consequences. I have looked at each of the five issues in the staff report carefully. Some of them I cannot support and some of them I can support provided they are approved on a case-by-case basis. There will only be a relatively small number of parcels where a true hardship can be evidenced and these should be address using the variance process. Many, if jintmost, of the homes in Monroe County already have several feet of clearance between BFE and the first habitable floor to afford parking. Additionally, not very many homes will be voluntarily elevated because of the expense. And, finally, only a relatively small percentage (10-z0%) of the undeveloped parcels are in the in the higher flood zones, where it would be necessary to exceed 35- foot height limit to build a structure with five feet of clearance over Base Flood Elevation. Given these facts and the fact that we award less than one hundred ROGO allocations a year, there will be very few application for a variance to the 35-foot height limit. There are ways to deal with sea level rise and increasing flood insurance rates without risking the loss of our community character. Please remove the height exception issue from the Comprehensive Plan Transmittal today. Please give us time to do this right the first time. It is part of our community character and helps to maintain our small town feel. In the county's efforts to mitigate flood insurance premiums, we feel the proposed comp plan language has gone beyond what is necessary to reduce flood insurance costs. The Comp Plan has been in the process of being updated for several years. Now that we are down to the final draft,a major height change has been introduced. The proposed new language raises the building height limit to 40' county wide and much higher in some instances. Without changing a thing and under current code it is already possible to build a new building raised 5' above Base Flood Elevation and still stay within the 35' height limit. There is no need for the county to change the overall height limit to 40'. The new FEMA flood maps have not come out yet. It seems a little premature to establish detailed flood mitigation comp plan policy before knowing the outcome of the new maps. Key Largo has had affordable and workforce housing built to the current 35' height limit. Is it the intention of this county to now allow low income housing to be the most prominent buildings in Monroe County by raising it above the rest of the community? Low income housing may not be the community character Monroe County wants to dominantly display. In the staff provided backup there are example graphs of potential heights that are alarming. These new policies are now going to allow buildings as high as 55'. These proposals are proposing a dramatic change to our county. It requires much more discussion and public input before going forward. If this is indeed being driven by the National Flood Insurance Program Community Rating System then there needs to be a discussion about just how likely it is that Monroe County can achieve the insurance rate deductions depicted in the staff backup given our at risk location. The Federation finds these policies over reaching and unnecessary. We would ask that they not be included at this time in the comp plan. There must be more community discussion and collaboration.
