AGENDA ITEM WORDING: Approval to advertise a Public Hearing to consider adoption of an
ordinance amending Monroe County Code section 126-10, subsection (f) related to the use of Fair
Share Library Impact Fees.
ITEM BACKGROUND: Monroe County adopted a Fair Share Library Impact Fee in 1986. In
1992 the BOCC approved a resolution amending the original Land Development Regulation which
set forth the Fair Share Library Impact Fee. The resolution adopted recommendations for increasing
the amount of the impact fee following an analysis performed by Freilich, Leitner, Carlisle and
Shortlidge and titled "Library Facilities Impact Fee Report for Monroe County, Florida. Among the
other recommendations that were made were to establish one county-wide Impact Fee District in
recognition of the interrelated services provided by Monroe County's unified library system. In
addition, the resolution established a broad category of impact fee eligible expenditures. This
amendment adopts these last items.
PREVIOUS RELEVANT BOCC ACTION: At the June 21, 2017 regularly scheduled board
meeting the BOCC approved a resolution setting the Library Fair Share Impact Fee at $0.00 as of
January 1, 2018.

AMENDING SECTION AMENDING SECTION 126-10(f) OF
THE MONROE COUNTY CODE PROVIDING FOR THE
ESTABLISHMENT OF A SINGLE ACCOUNT FOR THE
FAIR SHARE LIBRARY IMPACT FEES AND FOR
PAYMENT OF THE FEES INTO THE ACCOUNT; SETTING
FORTH THE DEFINTION OF CAPITAL IMPROVEMENTS _
FOR PURPOSES OF THIS SECTION; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY
CODE OF ORDINANCES; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Monroe County established the Fair Share Library Impact Fee in 1986; and
WHEREAS, the Fair Share Library Impact Fee was established in order to fund capital
expansion of the library's County facilities as the County grew; and
WHEREAS,collection of the Monroe County Fair Share Library Impact Fee and payment
into a single account is appropriate since the County has a unified system which provides
interrelated services; and
WHEREAS, for purposes of clarifying the eligible expenditures, it is in the best interest
of the County to define Fair Share Library Impact Fee "capital improvements";
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY 2
COMMISSIONERS OF MONROE COUNTY, FLORIDA: W

SECTION 1: Section 126-10(f). — Use of funds collected shall be amended to read as
follows:
Sec. 126-10—Fair Share Library Impact Fee.
(f) Use of funds collected.
(1) The county shall establish an appropriate accounting mechanism for ensuring
that the fees collected pursuant to this section are appropriately earmarked -2
and spent for the capital expansion of the county's library facilities.

(3) Expenditure of fair share fees in fund shall be in accordance with the 0

b. Any funds in the funds on deposit, not immediately necessary for
expenditure, shall be invested in interest-bearing assets. All income
derived from these investments shall be retained in the applicable
account. These moneys shall be used for the capital expansion of the
county's library facilities in a manner consistent with the capital
improvements plan in the comprehensive plan.
c. Each year, at the time the annual county budget is reviewed, the
Planning Director shall propose appropriations to be spent from E
the fund. The proceeds shall be spent for capital improvements plan
consistent with the capital improvements plan of the comprehensive
plan. Any amounts not appropriated from the fund, together with
any interest earnings, shall be carried over in the specific account to
the following fiscal period.
d. For purposes of this section, capital improvements means the
planning of, design of, engineering for, acquisition of land for, `=
construction of improvements and includes the equipment and
furnishings needed for the completion of the capital expansion and
all other costs necessarily incident to provision of the capital
improvement including but not limited to collection materials U)
acquisition.
(4) Refund of fair share fees, if not encumbered for community library facilities, E
shall be in accordance with the following:
a. Any fair share library fees collected shall be returned to the fee payer ,
if the fees have not been spent or encumbered within six years from
the date the fees were paid. Fair share library fees collected shall be
deemed to be spent (encumbered) on the basis of the first fee
collected shall be the first fee spent for library improvements.

b. Any fair share library fees collected shall be returned to the fee payer
if the land development activity is canceled due to
noncommencement and if the fees have not been spent or
encumbered. Fair share library fees collected shall be deemed to be
spent or encumbered on the basis of the first fee collected shall be
the first fee spent for library facilities improvements. U-
c. The refund of fair share library fees shall be undertaken through the
submission of a refund application to be submitted within one year c
following the end of the sixth year from the date on which the fair
share library fee was paid or within three months of
noncommencement. The refund application shall include the
following information:

1. A notarized sworn statement that the fee payer paid the
fair share community library fee for the property and
the amount paid; and
2. A copy of the receipt issued by the county for payment
of the fee.
d. Within 20 working days of receipt of the refund application, the
Planning Director shall determine if it is complete. If the Planning
Director determines the application is not complete, he shall send a

written statement specifying the deficiencies by mail to the person
submitting the application. Unless the deficiencies are corrected,
the Planning Director shall take no further action on the refund 2

application.
e. When the Planning Director determines the refund application is
complete, he shall review it within 20 working days, and shall 2
approve the proposed refund if he determines the fee payer has paid
a fair share library fee, which the county has not spent or
encumbered within six years from the date the fees were
encumbered or within three months of noncommencement.
f. Any fee payer may appeal the Planning Director's decision on a
refund application, by filing a petition with the BOCC within 30
days of a decision by the Planning Director. In reviewing the county
Planning Director's decision, the BOCC shall use the standards E
established in subsection (c) of this section. -�
SECTION 2: SEVERABILITY. If any portion of this ordinance is for any reason held
invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the
remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be
inapplicable to any person,property or circumstances, such holding shall not affect its applicability
to any other person,property or circumstances.

SECTION 3: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict.
SECTION 4: INCLUSION IN CODE OF ORDINANCES. The provisions of this
ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe,
Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform U-
to the uniform numbering system of the Code.

SECTION 5: TRANSMITTAL AND EFFECTIVE DATE. This Ordinance shall be filed
with the Department of State and shall be effective as provided in Section 125.66(2), Florida <
Statutes.

The Iutome County Library System currently consists, of a headquarters
Iibrery in Key Wait,bra nch libraries in Maradwn, lslarnorada and Key Largo,and a
bookmobile which operates between Key-West and Big Pine Key, The public Library
E System Is particularly important in Monroe County because the County spans a 125
mile distance from the mainland and the closest large public libraries are in Mfariu.
The branch libraries are strategically located to provide service within a reasonable
distance for most County residents, while the mitin 'library in Key West serves the
most densely populated area of the County. All Monroe County libraries operate as
a undfied,system to provide library and reference services vAth all libraries

participating in a significant County-wide intrallbrary loan system for collection
materials. In Fiscal Year I990.91. the County Library System provided the following
services: circulation of 2,99,A30 Items,intrabbrairy loans of items within the County
i, Library System. and responses to 78,875 reference queries. In addition, the libraries
provided space for 1,559 meetings of public bodies arid, various groups.

As of August, 1992, the existing Monroe County Library System includes.:
,680 square feet of library fdeillty space and a total of 174,833 collection material
ttarns (149,497 books,and 25,336 films,cassettes and video cassettes:). With an

existing facility level of service of 0.5 square feet per capita and an existing, collection
materials level of service of 7.7 items per capita (1.9 books per capita and .3 fllrnt,
periodicals, audio materials and video cassettes per capita). Tables 2, 3 and 4 show
the existing facilities and items, bar district for the Lower,Middle and Upper Ko ys and 2

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, �
AMENDING RESOLUTION NO. 493-1992, SPECIFICALLY
THE FEE SCHEDULE OF LIBRARY FACILITIES IMPACT
FEES TO BE IMPOSED ON NEW RESIDENTIAL
DEVELOPMENT PURSUANT TO CHAPTER 126 IMPACT
FEES OF THE MONROE COUNTY LAND DEVELOPMENT
CODE,AMENDING ALL FEES IN THE FEE SCHEDULE TO
ZERO DOLLARS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Board of County Commissioners adopted Resolution No. 493-1992 on
October 16, 1992 establishing a Library Facilities Impact Fee Schedule to be imposed on new
residential development pursuant to Chapter 126 Impact Fees of the Monroe County Code; and
WHEREAS,the Board of County Commissioners has acknowledged that at this time the
amount of development of capital improvements of library facilities concludes a reasonable
determination that the Library Facilities Impact Fee Schedule be amended to$0.00 for all types of o
new residential development;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY THAT:
The following Library Facilities Impact Fee Schedule shall be adopted and imposed on
new residential development in the unincorporated area of the County and within the boundaries
of participating municipalities pursuant to an Interlocal Agreement:
