ITEM BACKGROUND: Monroe County Code Section 6-108(e) allows BOCC approval for waivers of building permit fees for affordable housing which have a Development Order in effect as of February 17, 2010 for affordable housing. Gorman & Company, Inc. is requesting the building permit fee waiver to build 42 affordable housing Units on Key Largo. Fees are estimated at $261,791.00. This amount is only for the housing units. A minor conditional use permit (Planning Commission Resolution No. P14-14) was granted by the Planning Commission oil April 15, 2014 allowing the development oil'an institutional residential use, involving 46 deed-restricted affordable housing units (in the form of rooms), I commercial apartment and accessory uses/structures. The Planning and Environmental Resources Director has since approved a Minor Deviation to the Minor Conditional Use modifying the project boundary and reducing the approved number of affordable housing units from 47 to 42. PREVIOUS RELEVANT BOCC ACTION: February 10, 2010 — BOCC approved Ordinance 004-2010 allowing waivers for housing for households up to 120% of median income in Monroe County, developments leveraging state or federal funds or which had a development order in,effect prior to February 17, 2010. November 18, 2009 — BOCC approved Ordinance 036-2009 allowing building permit fee waiver for entities building low income housing leveraging state or federal funds, or affordable housing as defined by state statutes. N41AMI PHOEMX (AH(ACIO DEN\/FR November 6, 2014 Wes Maltby Building Official Monroe County Growth Management Division 102050 Overseas Highway Key Largo, FL 33037 RE: Affordable Housing Application for Waiver of Building Permit Fees, Dear Mr. Maltby: Gorman & Company competed in the annual competitive cycle for Low Income Housing Tax Credits (LIIITC) from Florida Housing Finance Corporation and was awarded over $10 million dollars of tax credits to build 42 affordable housing units on N. Blackwater Lane in Key Largo, Florida. These are rental units will be built for those with qualifying incomes of 60%of the area median income. The tax credits allow for the development of quality and truly affordable housing units to meet a growing demand for affordable units in the Keys. When completed, these units will rent between $825 to $992 and the tax credits along with other grants and local government support is what allows these units to be truly affordable. With the recent adoption of the fee schedule, the total permit fees estimated for this project is $263,000 which is a $200,000 increase over what the fee would have been under the old schedule. We appreciate that Monroe County recognizes and provides for the ability to waive fees for affordable project per Section 6-108 (c). Given that our project is building for those earning less than 60% of median income as well as the huge increase in fees that was not anticipated at the start ofour project, we request that these fees be waived. We would request that this item be considered by the Board at the November I 8t" BOC'C meeting given that we anticipate submitting for building permits within the next two weeks and Would like to have the fee waiver in place prior to submitting.
