ITEM BACKGROUND: Monroe County building inspectors were not performing certain inspections between March 23, 2020 and May 17, 2020 due to concerns related to COVID-19. Therefore certain permit holders were offered a choice to hire private provider inspectors, engineers, or architects to conduct required inspections, to maintain progress on their development projects while the County was not performing these inspections. This proposed resolution would authorize and direct staff to refund these specific permit holders. We are not refunding inspection fees for permits who already hired a private provider prior to this COVID closure, as described in Section 11 of the proposed resolution. The method to calculate the refund was to take the total building discipline portion of the permit fee (planning, environmental, and fire disciplines may not be performed by Private Providers), divide by 50% (the approximate amount of the fees for inspections) and then proportion the building inspection fee portion by the total number of building inspections due on the specific permit. Then, an amount of fee per inspection was calculated. Finally, the amount per inspection was multiplied by the number of inspections a private provider, engineer, or architect performed, due to COVID-19 closure. An example of how this was calculated is a single-family residential modular home with the 50% of the building portion of the fees being $2,328.09. The total number of building inspections was 30. That equals $77.60 per inspection. In this example, the number of inspections performed by a private provider from March 23 through May 17, 2020 was 3, which is 10% of the total number(or 3 times $77.60 = $232.80). Therefore the amount of the refund proposed is 10% of$2,328.09, or $232.81. PREVIOUS RELEVANT BOCC ACTION: On September 18, 2019 the BOCC approved Resolution No. 257-2019. This Resolution increased fees based on the CPI for FY20 and amended fees due to new laws. PROVIDED BY PRIVATE 8 PROVIDER INSPECTORS DURING TIME FRAME WHEN MONROE 9 COUNTY WAS NOT PROVIDING THESE SERVICES DUE TO COVID-19; 10 AND PROVIDING FOR AN IMPLEMENTATION DATE y 11 a, 12 WHEREAS, the County protects life and safety through review of construction 13 plans and inspection of construction work as provided by the Florida Building Code; and 0. 14 15 WHEREAS, these services provided by the County are engaged at the discretion 16 of applicants and for the benefit of applicants; and 17 18 WHEREAS, the Monroe County Board of County Commissioners wish to provide 19 the citizens of the County with the best possible service in the most cost effective and 20 reasonable manner; and 21 22 WHEREAS, the Board finds that it would be in the best interests of the public to 23 charge costs for services, thereby placing the burden of such costs directly upon those 24 parties deriving the benefit from such services; and CL 25 26 WHEREAS, the updated fee schedules prepared by the Building Department for 27 providing these services include the estimated direct costs associated with the review and 28 processing of applications for permits issued by the County; and 29 30 WHEREAS, Monroe County building inspectors were not performing certain 31 inspections between March 23, 2020 and May 17, 2020, and therefore certain permit 32 holders chose to hire private provider inspectors to maintain progress on their 33 development projects while the County was not performing these inspections due to 34 COVID-19; and 35 36 WHEREAS, the Board heard testimony and evidence presented as to the LO 37 appropriate fee schedule. 38 39 NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY 40 COMMISSIONERS OF MONROE COUNTY, FLORIDA: E 41 42 Section 1. The foregoing recitals are hereby incorporated as if fully stated herein. 43 44 Section 2. Pursuant to Monroe County Code, the following building permit fees (and 45 Floodplain and Developmental permit fees) were amended from those 46 implemented in Resolution 257-2019, and are hereby established: (All 47 applicable fees within this Fee Schedule are subject to Florida Permit Page 1 of 9 Packet Pg. 2102 L2.b 48 Surcharge Program Fees as per F.S. 553.721 and F.S. 468.631, which shall 49 be applied to all Building Permits at Issuance.) 50 51 (A) BUILDING PERMIT APPLICATION FEES: 52 53 1. Upon submission of application: 54 a. Valuation-based permit jobs valued at $5,000 or more require fifty percent 55 (50%) of the building permit fee due, with remaining balance of building 56 permit fee plus one hundred percent (100%) of planning, environmental, 57 and/or fire fee as applicable due at issuance. y 58 b. Permit jobs valued at less than $5,000 require one hundred percent (100%) 59 of the fee due. > 60 2. Job value will be based upon the submitted, legitimate contract price or CL 61 ICC/Construction Costs Valuation manuals. 62 63 (B) RESIDENTIAL BUILDING PERMIT FEES: CL 64 1. In the event a particular discipline review is not required for code 74 compliance, the applicant shall not be assessed the rate of that particular 75 discipline. For example, in the event only a Building review is deemed necessary 76 to ensure a particular application complies with Monroe County Code, the 77 applicant shall not be assessed the fee for Planning and Environmental. 78 a. A project whose value exceeds the lowest value band shall be priced based 79 on value in band 1 times rate for band 1 plus the value in the next highest 80 band times the rate for that higher band. 81 b. The rate table below itemizes the maximum Building fee, which 83 includes all 5 building discipline reviews (Structural, Electrical, 84 Mechanical, Plumbing, and Flood disciplines). 85 ii. Appeal of Preliminary Floodplain Maps $5,000.00 Deposit y Plus $170.00 Floodplain discipline review Property owners that appeal Preliminary Floodplain maps (on a form provided 0. by the County), that require Monroe County to process and/or review and issue a technical opinion stating whether the evidence presented is sufficient to justify an appeal on behalf of such permits by the County in accordance with Part 67.6 of the NFIP regulations shall bear the cost of the technical review being performed by a consultant hired for such reviews. At the request of the Floodplain Administrator Applicants shall be required to deposit a fee of$5,000.00 into an escrow account to cover the cost of experts hired by the Department to review technical data/evidence submitted by the applicant compared to the FEMA Preliminary map data/modeling CL Any unused funds deposited by the applicant will be returned upon the County forwarding the appeal to FEMA. Monroe County shall obtain an estimate from the consultant they intend to hire to review and/or conduct the technical review and if the cost for the review on behalf of Monroe County is higher than the $5,000.00, applicant shall remit the estimated amount. The fees established in this resolution shall be applicable through 164 September 30, 2020. Thereafter, annually, beginning October 1 of each 165 following year, they shall be adjusted by the percentage change in the CPI 166 from the previous year; except for those in Section 2. (B) 1, (D), (E) 1, 2, 3, 167 6 and 7, (F) 5, (G)la., 3, 4, 5, 7, 10, the $10 per plan page in 13, 14, and all 168 other No Fee items.
