AGENDA ITEM WORDING:Authorization to initiate litigation against Kurt Rockenbach and his
property located at 33 Dolphin Road, Key Largo Florida,to seek compliance with the county
Code and enforce a lien arising from code compliance case number CE13050156.
ITEM BACKGROUND:
This property has been the subject of a code compliance case for failure to hook up to central
sewer. The fines total $19,700.00 as of November 15, 2014 and will continue to accrue at $100
per day until compliance is achieved.
CE13050156: On October 24, 2013, the Special Magistrate approved a stipulated agreement
wherein the property owner admitted to the violation, agreed to gain compliance by January 1,
2014 and agreed to pay fines in the amount of$100 per day if compliance was not achieved by
the agreed upon compliance date. The property owner was granted one extension of the
compliance date. The compliance date was May 1, 2014. The property owner did not gain
compliance by the deadline and the fine began to accrue on May 2, 2014. The County's lien was
recorded on May 29, 2014. The Special Magistrate authorized further collection actions on
October 30, 2014. The code case remains open for non-compliance and failure to pay
outstanding fines and costs.
The property is homesteaded and there is a pending foreclosure action on the property at this
time. However one foreclosure action against this property owner has been dismissed.
Pursuant to Resolution 057-2014 the available legal options in regard to the County's lien on this
property are:
1. Initiate litigation against the property owner for injunction, and money judgment;
2. Allow the liens to remain against the property owner, the subject property and any
other property owned by the property owner; and/or
3. Reduce the amount of the fines.
County staff recommends initiating litigation(option 1)against the property owner for injunction
and money judgment.

his Sewer Hook-up Grant Application dated December 3, 2013. Pursuant to the terms of the grant, due to the pendling
Green Tree Servicing LLC Lis Pendens (foreclosure) we are not able to assist Mr. Rockenbach at this time. However, I
advised him that if the Lis Pendens gets dismissed (cleared up), he is welcome to re-submit his application at that time
for reconsideration.

the compliance date. You should contact Ms. Schoenrock at least 1 week prior to the compliance date in the
Stipulation, (January 1, 2014), and provide her with the information as to what you have accomplished thus
far. She will then collaborate with Iher supervisor as to if an extension may be granted'.
As far as your questions about the Lis Pendens filed against your property, I would suggest that you speak with

I understand, that a very short reprieve was granted regarding 33, Dolphin Rd. Key Largo Fl 33037.
Unfortunately, that only left just over a month to work out the detail of how/who pays for the, installation and
to get an installation completed. I've resubmitted an application for the grant as I never heard any thing
back from my first attempt. I sent the second request via USPS certified mail. Maybe that will get some
attention.
The other issue is that the house is in Les Pens, so installing a system in a house I may not own next month
seems rather bizarre. Who do I call to address these issues,as I am disabled,not working, low to no
income; the idea of being fined $100 per day is just wrong,and quite illegal.
