ITEM BACKGROUND: This property was the subject of a code compliance case for violations of the County's vacation rental ordinances. The property owner gained compliance and is paying the outstanding fines and costs through an installment plan, However the property owner has recently began advertising for short term vacation rentals in violation of the Special Magistrate's order and the County's vacation rental ordinances. CE10090019: On September 26, 2013,the Code Compliance Special Magistrate approved an executed Stipulation Agreement wherein the property owner admitted to the violations of renting and advertising a property for short term vacation rentals in an Improved Subdivision(IS)where it is prohibited and without the necessary business tax license(violations of MCC 130-83 (b)and 134-1(k)(1)and 23-72). The property owner gained compliance by the agreed upon compliance date. In the Stipulation,the property owner agreed to pay a onetime fine in the amount of$ 3,500.00 due to the irreparable and irreversible nature of the violation and costs. The property owner has made installment payments as agreed upon with the Code Compliance Department. The County's lien was recorded on February 11,2014.'The Special Magistrate granted the County's motion to proceed with further collection efforts on June 26, 2014.The code case remains open for non-payment of the outstanding fine and costs. In lieu of initiating an new code case for the repeat violation of advertising for short term vacation rentals where short term vacation rentals are prohibited, Code Compliance Department would like to initiate litigation in the Circuit Court for an injunction. The property is not homesteaded and there are no pending foreclosure actions at this,time. Pursuant to Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and writ of attachment; 2. Allow the lien to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Reduce the amount of the fines. County staff recommends initiating litigation (option 1) against the property owner for injunction, foreclosure, money judgment and writ of execution. Had to contact John about a couple of minor things and he got back to me quickly to address them.I would recommend to anyone who wants to experience the Keys experience and hope to return myself.The area itself was very quiet,no issues with the neighborhood.Hawk's Cay Resort was five minutes away by car and twenty minutes by boat.The only Issue was make sure you talk to someone on how to get out on a low tide,the water even in the channel gets a little skinny.
