Re: Revised Fee Schedule Resolution and Core Contract approved 10/15/08(Item L-1)
Dear Mr. Eadie:
Pursuant to your letter dated 11/12/08, enclosed please find an original revised Fee Schedule Resolution
that I have stamped approved for submission to the BOCC for approval. Please note, there was no Agenda Item
Summary accompanying the Resolution received from you for review/initialing by the County Attorney. An
agenda item summary is required by the County Administrator's Office for placement of an item on the BOCC
agenda.
Your letter also transmitted six (6) sets of the Core Contract executed by the Health Department on
11/3/08 requesting they "..be stamped with the Monroe County Attorney approved as to form". A verbatim
comparison revealed the Core Contract and attachments received to be stamped are identical to the Core Contract
and attachments approved by the BOCC on 10/15/08 (Agenda Item L-1). On 10/21/08, following approval by the
BOCC, it was brought to the attention of the County Attorney by the Clerk that the attachments to the Core
Contact submitted by the Health Department to the Clerk for execution by the Mayor had been altered slightly,
specifically Attachment H. Part II. On 10/24/08, the County Attorney advised you that"Since the dollar amount
of the County's appropriated responsibility remains the same and matches the text of the contract, I am
authorizing the Clerk to execute the document, on the condition that you resubmit the revised document to the
BOCC for ratification, noting that amounts from the State and County Public Health Unit (CHD Trust Fund
have been revised—The County's reduced by$216,667 and the State's increased by that amount" Based on the
County Attorney's authorization 10/24/08, the Mayor has already executed the Core Contract that was submitted
by the Health Department to the Clerk with the revised Attachment IL Part I. In fact, the Clerk has advised the
executed originals have already been returned to the Health Department for execution by the State and return of the
Clerk's original and Finance copy once fully executed. Therefore, as the County Attorney previously indicated,
only the changes made to Attachment II. Part H. after the BOCC approved the Core Contract must be ratified by
the BOCC. You do not need to submit the Core Contract to the BOCC in its entirety as it has already been
approved and processed.

I am returning the six (6) copies of the Core Contract executed by the Health Department on 11/3/08 to
you. I have also enclosed an Agenda Item Summary containing the language provided in the County Attorney's
emails to you on 10/29/08 (copies enclosed)that has been initialed by the County Attorney. I have attached a copy
of the Clerk's notes reflecting the changes made to Attachment II. Part II. of the Core Contract following approval
by the BOCC along with a copy of the agenda back-up for Item L-1 as approved by the BOCC on 10/15/08. The
agenda item summary and the referenced back-up should be submitted for placement on the 12/17/08 BOCC
agenda for ratification by the Board.
