Street on Duck Key by paying off the tax lien of$5,703.19.
ITEM BACKGROUND: On September 4, 2020 the Clerk notified the County Attorney's Office of
the addition of the subject parcel to the list of "lands available for taxes", pursuant for F.S.
197.502(7). That list contains properties with tax liens that received no bids during the public sale
and which the tax certificate holder failed to timely pay the costs of resale or failed to pay the
amounts due for issuance of a tax deed within 30 days after the sale. The BOCC has the sole option
to purchase the property for the opening bid of$5,703.19 within 90 days of notification by the Clerk.
After that, anybody willing to pay the $5,703.19 can purchase the lot.
The lot is zoned Improved Subdivision (IS) and has a Tier III designation. The address is 104
Jamaica Street on Duck Key. The property has an expired ROGO allocation that has been returned
for use as administrative relief. There are no mortgages or liens, other than a County code lien
valued @ $545,000.00 encumbering the property. The County foreclosed on the lien and has a
default judgment but auctions have been suspended due to COVID.
Purchase by the County the process outlined in F.S. 197.502(7) provides the quickest and most
certain method of acquisition of the property. The County would acquire the property for density
reduction or conservation, a decision which can be made after the lot is acquired. The Land
Authority owns an adjacent lot and has expressed an interest in acquiring the lot for conservation. It
is estimated that curing the ongoing code violations (concrete columns and stairs)will cost$10,000.

(7) On county-held or individually held certificates for which there are no bidders at the
public sale and for which the certificateholder fails to timely pay costs of resale or fails to
pay the amounts due for issuance of a tax deed within 30 days after the sale, the clerk shall
enter the land on a list entitled "lands available for taxes" and shall immediately notify the
county commission that the property is available. During the first 90 days after the property X

rights to purchase the property. Thereafter, any person, the county, or any other CL
governmental unit may purchase the property from the clerk, without further notice or
advertising, for the opening bid, except that if the county or other governmental unit is the CU
