Resolution 074-1960 RESOLUTION NO. 74 -1960
WHEREAS, due to the damage caused by the recent hurricane in the
Florida Keys, Monroe County, Florida, said Florida Keys area has been de-
clared a national disaster area in accordance with Public Law 875, Eighty-
first Congress, Year 1950, and also has been declared a disaster area by
the State of Florida in accordance with Chapter 252, Civil Defense, Florida
Statutes, 1959, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, acting as the Civil Defense Council for Monroe County, Florida,
has also declared said area a disaster area in accordance with said Chapter
252, Florida Statutes, 1959, and
WHEREAS, in accordance with said law in order to render the neces-
sary assistance to the residents in said area and in order to furnish adequate
medical and health services and to protect communications and local roads in
said area, it is necessary to immediately take action to furnish aid and as-
sistance in clearing said roads without delay as the accumulation of debris
not only blocks communications and transportation, but also threatens to be-
come a health menace unless said debris is immediately removed, and
WHEREAS, said Board in order to accomplish the above purposes
deems it necessary to waive any and all procedures and formalities other-
wise required by law as provided for in Sub-section (e), Section 9, of Chapter
252, Florida Statutes, 1959, and
WHEREAS, said Board desires to use funds budgeted in the Road and
Bridge Fund or other funds in the Monroe County Budget for the year 1959-
1960, and, if necessary, to use funds budgeted in the Monroe County Budget
for the year 1960-61, and to set up a Disaster Emergency item in both of said
budgets and, if necessary, to transfer funds to be expended for emergency purposes
as contemplated herein, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, as follows:
1. That the procedures and formalities otherwise required by law

pertaining to: the performance of public work, entering into contracts, the
incurring of obligations, the employment of permanent and temporary work-
ers, the utilization of volunteer workers, the rental of equipment, the pur-
chase and distribution with or without compensation of supplies, materials,
and facilities, and the appropriation and expenditure of public funds, as set
forth in Sub-section (e), Section 9, of Chapter 252, Florida Statutes, 1959,
are hereby declared to be waived.
2. That there is hereby created in the Road and Bridge Fund of the
Monroe County Budget for the year 1959-1960 and in the Monroe County
Budget for the year 1960-61 a Disaster Emergency item.
3. That the Clerk of said Board be and he is hereby directed to
transfer the sum of Twenty-five Thousand Dollars ($25, 000. 00) from any
item within the Road and Bridge Fund to the newly created Disaster Emer-
gency item in said Fund.
4. That County Commissioner Clarence S. Higgs be and he is here-
by authorized to immediately start the necessary work to clear County roads
in the disaster area in the Florida Keys in Monroe County, Florida, and to
take the necessary steps to enter into any contracts and incur obligations as
contemplated.within Chapter 252, Florida Statutes, 1959, said obligations
not to exceed the sum of Twenty-five Thousand Dollars ($25, 000.00) unless
further authorized by this Board, and to make any necessary arrangements
with other political subdivisions, including the State of Florida and the
United States of America, to accomplish the aims and purposes of this reso-
lution.
