Resolution 092-1960 RESOLUTION NO. 92 -1960 WHEREAS, there is pending in the Circuit Court of Monroe County, Florida, in Chancery, the case of Sigsbee Park, Inc. , a Florida cor- poration, Plaintiff, vs. Howard E. Wilson, as Tax Collector of Monroe County, et al. , Defendants, same being docketed under No. 15-1001, seek- ing the refund of $154, 060. 14 paid by the Plaintiff as ad valorem County taxes for the years 1953 through 1957, and the cancellation of ad valorem County taxes assessed for the years 1958 through 1960, but not paid, and WHEREAS, there is pending in the Circuit Court of Monroe County, Florida, in Chancery, the case of Peary Court, Inc. , a Florida cor- poration, Plaintiff, vs. Howard E. Wilson, as Tax Collector of Monroe County, et al. , Defendants, same being docketed under No. 15-1002, seek- ing the refund of $62, 725. 98 paid by the Plaintiff as ad valorem County taxes for the years 1953 through 1957, and the cancellation of ad valorem County taxes assessed for the years 1958 through 1960, but not paid, and WHEREAS, proposed compromise and settlement of said suits has been negotiated, whereby the Plaintiffs waive their rights and claims for refund of the ad valorem taxes aforesaid paid by the Plaintiffs, and agree to pay the attorneys' fees and costs incurred by the Board of County Commissioners of Monroe County, Florida, Defendants therein, and the Defendants agree that the levy and assessment of ad valorem taxes for the years 1958 through 1960 aforesaid be vacated, cancelled and set aside, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY. FLORIDA, that proposed stipulations, embodying provisions for carrying into effect the proposed compromise and settlement indicated in the preambles of this Resolution, copies of which stipulations are hereto attached and made a part hereof, be, and the same are hereby approved, and Paul E. Sawyer and J. Lancelot Lester, attorneys for the ` O Defendants, be, and they are hereby authorized to enter into said stipula- tions, and to take such action as may be proper and necessary to effect the intent of said stipulations in the compromise and settlement of said suits.
