Resolution 094-1960 RESOLUTION NO. 94 , 1960 WHEREAS the Monroe County Anti-Mosquito District desires to acquire certain surplus equipment and/or materials through the Florida Development Commission, Surplus Property Department, and WHEREAS the Board of County Commissioners of Monroe County, Florida, acting as the Monroe County Civil Defense Council has no objec- tions to said District acquiring said equipment and/or materials if such acquisition is subject to the terms, qualifications and conditions hereinafter set forth, now therefore BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Director of Civil Defense be and is hereby authorized to transmit the request of the Monroe County Anti-Mosquito District for surplus equipment and/or materials to the Florida Development Commission, Surplus Property Department under the following terms, qualifications and conditions: 1. That title to and responsibility for equipment and/or materials donated and secured by the Monroe County Anti-Mosquito District shall be vested in said District. 2. That compliance with the rules and regulations governing use, maintenance, operation, care, responsibility and disposal of said equip- ment and/or materials shall be the sole responsibility of the said District. 3. That compliance with any Federal laws, rules and regulations concerning said equipment and/or materials is the sole responsibility of said District. 4. That the Monroe County Civil Defense Director and the Board of County Commissioners of Monroe County, Florida, acting as the Monroe County Civil Defense Council, shall be in no way responsible nor will either be held liable in any manner whatsoever for any of said equipment and/or materials furnished to said District or reports thereon. 1 44 4bid 5. That the Board of County Commissioners of Monroe County, Florida, will in no way be responsible for payment for said equipment and/or materials and that payment for any such equipment and/or materials desired by said District be made direct to the Florida Development Commission, Surplus Property Department. 6. That the Monroe County Civil Defense Director and the Board of County Commissioners of Monroe County, Florida, acting as Civil Defense Council will not and cannot make any certification with reference to the use and disposal of any property in accordance with the rules and regulations pertaining thereto. 7. That any equipment and/or materials furnished to said District will not preclude or jeopardize the Monroe County Civil Defense Council from receiving necessary and needed equipment as determined by the Board of County Commissioners acting as said Civil Defense Council, and in the event any quota has been set for Monroe County, Florida, that none of this equipment and/or materials given to said District shall be charged to said quota. BE IT FURTHER RESOLVED THAT THE CLERK OF SAID BOARD be and he is hereby directed to furnish the Monroe County Civil Defense Director a certified copy of this Resolution to be forwarded with the above referred to request of said Monroe County Anti-Mosquito District to the Florida Development Commission, Surplus Property Department. -2-
