N 0 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: SECTION 1. Resolution No. 088-1998 is hereby repealed. SECTION 2. Code Enforcement actions to enforce compliance with the reporting requirements of Chapter 15.5, Monroe County Code (M.C.C.), should proceed as follows: (a) The Monroe County Health Department (MCHD) notifies the property owner requesting evidence that the owner's on-site sewage disposal system is in compliance with Chapter 15.5, M.C.C., or if not in compliance, the owner's plans to bring the system into compliance. (Chapter 15.5, M.C.C. is the County Code Chapter regulating on-site sewage treatment and disposal systems.) (b) The MCHD furnishes to the Monroe County Code Enforcement Department (CED) a list of property owners who failed to respond to the MCHD's notification. (c) The CED initiates the proceedings before the County's Code Enforcement Special Master to seek compliance with the tenns of the MCHD's notification letter. The MCHD will make available to testify, at hearings before the Special Master, its personnel with direct knowledge of a property owner's failure to comply with the notification letter. SECTION 3. The Code Enforcement actions to enforce other requirements of Chapter 15.5, M. C. C. should proceed as follows: In those cases where the MCHD has issued a permit for the construction or reconstruction of an on-site sewage disposal system to bring the property into compliance with Chapter 15.5, M.C.C., and the permit holder has failed to timely complete the construction or reconstruction, or the work performed does not meet the criteria of Chapter 15.5, M.C.C., then: (a) MCHD will also notify the CED; and (b) CED will commence proceedings (or resume abated proceedings) before the Code Enforcement Special Master to seek compliance with the on-site sewage disposal system criteria of Chapter 15.5, M.C.C.. The MCHD will make available to testify, at hearings before the Special Master, its personnel with direct knowledge of the property owner's failure to comply with Chapter 15.5, M. C. C., and the terms of the on-site sewage disposal system permit. The following exceptions will apply to Section 3 of this resolution: (1) Persons who apply to the Monroe County Housing Authority and are unable to receive funding but receive verification that their income level meets the criteria for: (a) Very low income (b) Low income (c) Moderate income, as described in the current Monroe County Housing Assistance Plan approved by the Monroe County Board of County Commissioners. (2) Owners of parcels of property that require a Class V (injection) well used for effluent discharge as required by the Department of Health's Rule No. 64E-6, Florida Administrative Code. NOTE: Exception (2) will be readdressed once the Department of Health and the Department of Environmental Protection have resolved their differences in wastewater treatment standards.
