Building Permits Issued Between March 10, 2020 and the Effective Date of the Resolution, All Due
to the Impacts of the COVID-19 Pandemic and State of Emergency.
ITEM BACKGROUND:
On March 1, 2020, the Governor of Florida issued Executive Order Number 20-51 directing the
State Health Officer and Surgeon General to declare a Public Health Emergency due to the novel
coronavirus (COVID-19) occurring and spreading in Florida. On March 9, 2020, the Governor of
Florida issued Executive Order Number 20-52, declaring a State of Emergency for the State of
Florida related to COVID-19, extended by, in pertinent part, Executive Order Numbers 20-114 and
20-166, amended by Executive Order Number 20-192, and extended by Executive Order Number
20-213.
The Monroe County Mayor declared a State of Local Emergency on March 15, 2020, due to
COVID-19, to, in pertinent part, "initiate protective measures necessary to ensure the health, safety,
and welfare of residents and visitors."
Due to permitting office closures and other measures taken related to COVID-19, on April 15, 2020,
the BOCC adopted Resolution No. 100-2020, approving a temporary suspension of the expiration of
ROGO and NROGO allocation awards by giving additional time for permit issuance for previously
awarded allocations, and deferral of ROGO Year 28 Quarter 3 applications until the scheduled
Quarter 4 allocation period.
Following the re-opening of services in the permitting and related Planning and Environmental

Resources Department offices, on August 26, 2020, the Monroe County Planning Commission held
a public hearing and approved 54 ROGO allocation awards for ROGO Year 28, Quarters 3 and 4,
combined. Resolution No. 100-2020 did not include extensions for these ROGO Quarters, and
allocation letters were sent to owners with deadlines for permit issuance based on the adopted
requirements of the Land Development Code (LDC).
Pursuant to Sections 138-25 and 138-52 of the LDC, ROGO and NROGO permits which do not
require updates to plans based on the building code are given 60 days from the date of the allocation
letter to have the subject permit issued, while permits that do require updated plans based on the
building code are given 180 days from the date of the allocation letter to have the subject permit
issued. If building permits are not picked up/issued by the stated deadlines, or if issued permits
expire, then the related ROGO allocation awards expire, thus requiring the property owners holding
those ROGO allocations to have to reapply for ROGO allocation awards.
The majority of the allocation awards approved by the Planning Commission in August were given a
60-day deadline (i.e., December 1, 2020) to pick up permits. Several were given 180-day deadlines
(March 31, 2021). As of this writing's date, 15 permits of the 54 ROGO awards approved in August
have already been issued.
Additionally, as of this writing's date, 52 ROGO building permits which had pending permit
issuance deadlines have been issued since March 10, 2020, and are therefore not eligible for state of
emergency extensions to issued building permits under the Governor's Executive Order No. 20-52
and subsequent extensions/amendments.
Monroe County Code (MCC) Section 6-103 provides that permits shall become null and void unless
work authorized by the permit is commenced within 180 days and, once commenced, required
inspections are conducted within 180 days from the last passed inspection. If issued ROGO/NROGO
permits expire, then their associated allocation award expires as well and the property owner then
holding that allocation must reapply.
Staff has received feedback from the construction industry indicating that due to the manifold
impacts of COVID-19, additional time is needed to meet the deadlines required for ROGO/NROGO
permits. Input received includes the following:
• Property owners are still replacing homes from Hurricane Irma, in addition to developing
homes subject to ROGO, thereby creating a higher demand on building materials.
• COVID-19 protocols have restricted production levels of building materials and disrupted
supply chains creating a shortage of product and increased prices.
• There are delays for engineering services.
• Building permits issued for ROGO awards approved after March 9 are not eligible for the
Governor's pertinent extension.
• Due to COVID-19 the building dynamic has changed and increased the cost of development.
• Owner finances are uncertain due to COVID-19 impacts, delaying construction scheduled.
Staff is recommending that an additional 180 days be authorized for ROGO permit issuance
deadlines for those allocations already awarded but not yet issued, or for commencement of
construction/inspections requirements for those permits already issued but not eligible for

extensions under the Governor's Executive Order/State of Emergency. Regardless of the "end-
date" of the COVID-19 state of emergency, its impacts are anticipated to extend well into 2021.
Therefore, staff is also requesting authorization to give extensions for future quarters through
ROGO/NROGO Year 29, Quarters 1, 2, and 3 (application periods running through April 12,
2021; Planning Commission hearings for those awards are scheduled to be held in November
2020, February 2021, and May 2021).
PREVIOUS RELEVANT BOCC ACTION:
On April 15, 2020, the BOCC approved Resolution No. 100-2020, approving a temporary
suspension of the expiration of ROGO and NROGO allocation awards by giving additional time for
permit issuance for previously awarded allocations, and deferral of ROGO Year 28 Quarter 3
applications until the scheduled Quarter 4 allocation period, due to the impacts of COVID-19.

27 WHEREAS,the Monroe County Board of County Commissioners (`BOCC", "Board", or
28 "Monroe County") is the legislative body of Monroe County, Florida, and constitutes the local 0
29 legislature of Monroe County, Florida; and 0

31 WHEREAS, Florida Statute § Section 252.38(3)(a), gives authority to political
32 subdivisions to declare and enact a State of Local Emergency for a period of up to seven (7) days, 0
33 thereby waiving the procedures and formalities otherwise required of the political subdivision by
34 law; and
35
36 WHEREAS, on March 1, 2020, the Governor of Florida issued Executive Order Number
37 20-51 directing the State Health Officer and Surgeon General to declare a Public Health
38 Emergency due to the novel coronavirus (COVID-19) pandemic occurring and spreading in
39 Florida; and E
40
41 WHEREAS, on March 9, 2020, the Governor of Florida issued Executive Order Number
42 20-52, declaring a State of Emergency for the State of Florida related to COVID-19, extended by,
43 in pertinent part, Executive Order Numbers 20-114 and 20-166, amended by Executive Order

I WHEREAS, the spreading COVID-19 pandemic poses a health risk to Monroe County
2 residents, as well as to visitors to Monroe County; and

4 WHEREAS, responding to the threat posed by the COVID-19 pandemic may require
5 extraordinary and immediate actions by Monroe County in order to protect the public health,
6 safety, and welfare of residents of and visitors to Monroe County; and
7
8 WHEREAS, Section 11-1 of the Monroe County Code (MCC) vests the Monroe County x
9 Mayor with the authority to declare a state of local emergency for a renewable period of up to 0
10 seven (7) days; and 0
11 z
12 WHEREAS,the Monroe County Mayor declared a State of Local Emergency on or about
13 March 15,2020,due to the COVID-19 pandemic,to,in pertinent part,"initiate protective measures 0
14 necessary to ensure the health, safety, and welfare of residents and visitors"; and

16 WHEREAS, Monroe County has recently observed an increase in the number of reported
17 COVID-19 cases; and

19 WHEREAS, on April 15, 2020, the BOCC adopted Resolution No. 100-2020, approving
20 a temporary suspension of the expiration of ROGO and NROGO allocation awards by giving
21 additional time for permit issuance for previously awarded allocations, and deferral of ROGO Year
22 28 Quarter 3 applications until the scheduled Quarter 4 allocation period, due to the impacts of the
23 COVID-19 pandemic; and

25 WHEREAS, on August 26, 2020, the Planning Commission approved 54 ROGO awards

28 WHEREAS, Resolution No. 100-2020 did not include extensions for ROGO/NROGO
29 awards in Year 28, Quarters 3 and 4; and

31 WHEREAS, pursuant to Sections 138-25 and 138-52 of the Monroe County Land
32 Development Code (LDC), ROGO and NROGO permits which do not require updates to plans 0

42 NROGO allocation awards will expire if building permits are not picked-up/issued or if issued
43 permits expire, thereby requiring property owners to reapply for NROGO allocation awards; and

I WHEREAS, of the 54 ROGO awards approved in August, 51 were given 60 days from

8 WHEREAS, pursuant to Monroe County Code Section 6-102, if a permit is not issued, x
9 then the permit shall automatically expire and become null and void; and 0

11 WHEREAS, the Florida Building Code and Monroe County Code (MCC) Section 6-103 z
12 provide that permits shall become null and void unless work authorized by the permit is
13 commenced with 180 days and, once commenced, required inspections are conducted within 180 0
14 days from the last passed inspection; and

16 WHEREAS, building permits issued on or before March 9, 2020, were/are eligible for
17 extensions under Executive Order No. 20-52 and subsequent extensions/amendments; and

19 WHEREAS, 52 ROGO building permits which had pending permit issuance deadlines
20 have been issued between March 10, 2020 and October 23, 2020, and are therefore not eligible for
21 state of emergency extensions under the Governor's Executive Order No. 20-52 and subsequent
22 pertinent extensions/amendments; and

24 WHEREAS, the construction industry in Monroe County has provided feedback to the U
25 Monroe County Planning and Environmental Resources Department indicating that, due to the
26 impacts of the COVID-19 pandemic, additional time is needed to meet the deadlines required for 0
27 ROGO/NROGO permits; and
28
29 WHEREAS, the above-referenced feedback received includes that property owners are
30 still replacing homes from Hurricane Irma, in addition to developing homes subject to ROGO,
31 thereby creating a higher demand on building materials, that public health and medical protocols

32 necessitated by the COVID-19 pandemic have restricted production levels of building materials
33 and other materials have slowed creating a shortage of product, and due to the COVID-19
34 pandemic the building dynamic has changed and increased the cost of development; and

36 WHEREAS, the BOCC wishes to address these concerns expressed by the construction
37 industry regarding the impacts of the COVID-19 pandemic on the ability to meet required
38 timelines for construction;

40 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
41 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

43 Section 1. Recitals and Legislative Intent. The foregoing recitals are true and correct, and
44 are hereby incorporated as if fully stated herein.

42 2) The building permit is not eligible for Executive Order Extension(s) from 20-
43 52 or subsequent extensions/amendments; and
44 3) The property owner applies for a 180-day extension as prescribed by the
45 Monroe County Building Department on or before January 31, 2021.

I Section 7. The extensions provide herein shall run concurrently with any other relevant
2 extension(s) available and timely and lawfully obtained.

4 Section 8. The Monroe County Building Official or his authorized designee, and the Senior
5 Director of the Planning and Environmental Resources Department or her
6 authorized designee, are hereby authorized to render extension decisions pursuant
7 to and in accordance with this Resolution.

9 Section 9. Construction and Interpretation. This Resolution and its interpretation shall be
10 liberally construed and enforced in favor of Monroe County to effectuate its public 0
11 purpose(s)and policy(ies)of the County. The construction and interpretation of this z
12 resolution and all Monroe County Comprehensive Plan provision(s), Florida
13 Building Code, Florida Statutes, and Monroe County Code(s) provision(s) whose 0
14 interpretation arises out of, relates to, or is interpreted in connection with this
15 resolution shall be liberally construed and enforced in favor of Monroe County to
16 effectuate its public purpose(s) and policy(ies) of the County, and shall be deferred
17 in favor of the BOCC and such construction and interpretation shall be entitled to �?
18 great weight in adversarial administrative proceedings, at trial, bankruptcy, and on
19 appeal.

21 Section 10. No Liability. Monroe County expressly reserves and in no way shall be deemed to
22 have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign,
23 governmental, and any other similar defense, immunity, exemption, or protection
24 against any suit, cause-of-action, demand, or liability.

26 Section 11. Severability. If any provision of this resolution, or any part or portion thereof, is 0
27 held to be invalid or unenforceable by any administrative hearing officer or court
28 of competent jurisdiction, the invalidity or unenforceability of such provision, or
29 any part or portion thereof, shall neither limit nor impair the operation, 0
30 enforceability,or validity of any other provision of this resolution, or any remaining z
31 part(s) or portion(s) thereof. All other provisions of this resolution, and remaining

32 part(s) or portion(s)thereof, shall continue unimpaired in full force and effect.

34 Section 12. Effective Date. This resolution shall become effective November 17, 2020.

7 cannot proceed to required public meetings/hearings, as the County is following the Center for
8 Disease Control and Prevention(CDC)and State Department of Health(DOH)Directives;-and .

10 WHEREAS, as such, the Planning &Environmental Resources Department will not be
11 accepting certain new applications for the Planning & Environmental Resources Department,
12 until further notice, including ROGO/NROGO applications; and
13
14 WHEREAS, enacting a temporary suspension of the expiration of ROGO and NROGO
15 allocation awards, which were awarded prior to March 15, 2020, and not already expired, to
16 provide for a period of 180 days to obtain building permits due to the impacts of COVID-
17 19/novel Coronavirus,is necessary to protect the general welfare of the county;

19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
20 COMMISSIONERS OF MONROE COUNTY,FLORIDA:
21
22 Section 1. Monroe County is enacting a 180-day temporary emergency suspension of the
23 expiration of ROGO and NROGO allocation awards, due to the impacts of
24 COVID-19/novel Coronavirus. For those allocation awards for which award
25 letters were issued prior to March 15, 2020, and not already expired, building
26 permits must be issued within 180 days of March 15, 2020 (on or before
27 September 11,2020),notwithstanding the deadline specified in the award letter.

29 Section 2. Monroe County is deferring the issuance of allocation award letters. Upon
30 issuance of the award letters, applicants will be given 180 days to pick up

Emily - I think some additional leeway is appropriate. This issue of COVID is far
from over despite the Governor's order, which defies logical thinking, the
coming winter and Flu season will again affect the industry and further

Thank you for asking. Even though the construction industry didn't slow down much during Covid,
we are still behind. Our company has 20 houses in line ahead of the 6 permits we have coming out
of Rogo. We are a minimum of a year behind. We are short staffed due to no affordable housing. We
are still replacing Hurricane Irma homes as well as new construction. It all started when sewer was
ready. Everyone wanted to build.Then the County announced 6 year build out for vacant lots. Of
course Hurricane Irma followed and now Covid. Not to mention we had to slow down production
due to shortage of building materials. We can't seem to catch a break. I know you say busy is good!
It is also important to keep these permits active or we waste clients time and money. The permits
coming out have not had the opportunity to take advantage of the extension given to this point. We N
just need a way to mark time until we can get to them. We can stall a year with temp pole
inspection right now, but that won't be long enough. We need a minimum of two 180 days
Extensions. Pray no more major catastrophes occur. I appreciate you reaching out.

now is when we are truly seeing the impact of the virus in our local industry of construction, in our
personally business we have had cancellation in work and contracts, due to the lack of supply's
coming from the mills, and the increases in prices from the local vendors, every day we see more
and more lack on demand of building supply's, please see the link below and the attachement,
attached to this email, my customers fear that their permits may expire do to them not be able to
afford the raise in prices, I would say that an extension of at least two years was needed,this was y
right after the big wave of the virus, some items are taking 12 weeks lead time in order to received
them, for example refrigerator I order refrigerators about 4 months ago, Air conditioner units for
new and commercial construction, windows, and other essential items needed for the completion of
a project, I really urge the county officials to consider extending all active permits for at least
another two years to see where this pandemic will take us, I seat in the county board of
construction, and some residents think I can do something to make this situation better, I have sent
letter to Mr cater and Ms Hurtly requesting this extension already, please consider this very carefully

extensions to allow additional time for ROGO permits that were affected by the office shut down and
the stay at home requirements.

Hello Christine I don't think I need an explanation but was asking why the owners do not have six
months
to pickup their permit. They will not be available to receive the COVID 19 extension as their permit was CL
not active on March 9, 2020 so this leaves us at a loss if their finances have not come back as the
economy has not. Another question was this change heard by the Planning Commission and was
it approved by them and when?

Dear Vitello:
The Planning and Environmental Resources Department (Department)
forwarded a report to the Monroe County Planning Commission that
included a ranking of applications submitted for the third and fourth
quarter, year twenty-eight of the Dwelling Unit Allocation System. On
8/26/2020 the Planning Commission held a public hearing to review the
report and rankings. As a result of that meeting, and pursuant to Section
138-26 of the Monroe County Land Development Regulations and

Resolution 21-20, the Planning Commission granted your application an
allocation award.
The building permit 20-10-1003 will need to be issued by December
1, 2020. If you do not pick up your building permit by that date, the
allocation award will expire pursuant to Monroe County Code
Sections 138-25(h) and 138-25(k). If the permit is not issued then the 2
permit shall automatically expire and become null and void 2
pursuant to Monroe County Code Section 6-102. Once the permit is
issued, you must obtain the required inspection approvals in the c
allowable time frames or the permit will expire. If the permit
expires, then the allocation award expires which means that the
project would be subject to the ROGO process again.
The building permit 20-10-1003 cannot be issued until you provide and L XU
comply with the following items:

1. Department of Health permit or a letter from the local sewer CL
authority indicating the residential unit will be on a sewer system
with immediate hook up required.
2. If applicable to your application, coordination with other state or
federal agencies for impacts to wetlands or other surface waters
may be required. This coordination could result in additional
changes to your building plans which would require further
review. If you choose to pick up your permit prior to the
completion of your coordination with the other state or federal
agencies, the County may require you apply for and to receive a
"Notice to Proceed" prior to the commencement of development.

3. Applications cannot be revised that would result in a reduction of
ROGO points which were the basis of the allocation award.
Section 138-25(i)(2) of the Monroe County Land Development
Code, states: "After receipt of an allocation award, and either
before or after receipt of a building permit, but prior to receipt of
a certificate of occupancy, no revisions shall be made to any aspect
of the proposed residential development which formed the basis
for the evaluation review, determination of points and allocation
rankings, unless such revision would have the effect of increasing
the points awarded."
4. Your property is within one or more Species Focus Areas for
federally protected species. In order to meet your obligations
under the Federal Endangered Species Act, you must comply with
the USFWS issued Biological Opinion. Review of your permit
application by the Department has resulted in a determination c
that the proposed development is "NOT LIKELY TO ADVERSELY
AFFECT" federally protected species under the Endangered
Species Act. This determination was made based on the permit

application information and may be further based upon the
assumption that you will agree to certain specific conditions
included in the building permit. These conditions may include, but
are not limited to:
1. Providing mitigation to compensate for lost habitat in
accordance with Sections 118-2 and 118-8 of the Monroe
c
County Land Development Code.
1. Acknowledging receipt of a copy of the U.S. Fish and
Wildlife Service's indigo snake protection measures and
agreeing to implement the measures and post the LU
informational sign on-site during development.

2. Recording a Deed Restriction agreeing that no free-

roaming cats shall be allowed on the subject property.
Please contact the Monroe County Planning & Environmental
Resources Department to determine if any of these conditions
apply to your permit.
Please allow ample time to provide and comply with the above
requirements. When you have secured the required documents,
submit them to the Building Department [Upper Keys (305)453-8800;
Middle (305)289-2501 or Lower Keys, or (305) 295-3990] to
coordinate and schedule an appointment for the processing of your
application.

AS INDICATED, PRIOR TO BUILDING PERMIT ISSUANCE THE ABOVE
ITEMS MUST BE COMPLETED. Once the permit is issued, remember to
obtain the required inspection approvals in the allowable time frames
so that the permit does not expire. If the permit expires,then the
allocation award expires, which means the project would be subject to
the ROGO process again.
