AGENDA ITEM WORDING: Approval of a Resolution Authorizing the Monroe County Building
Official to Toll the Time Limits for Commencement of Construction and Required Inspections on
Building Permits for Properties Located on Duck Key's Harbour Island, Plantation Island, and Yacht
Club Island, which are affected by the FDOT 10-ton weight limit on Bimini Bridge, Harbor Drive
Bridge, and Seaview Bridge, until 180 days after a solution for delivery of materials, including
concrete, is available.
ITEM BACKGROUND:
On October 4, 2020, the Florida Department of Transportation (FDOT) inspected bridges on Duck
Key and advised that the weight limit for Bimini Bridge was only three (3) tons and only ten (10)
tons on Harbor Drive & Seaview bridges. On October 9, 2020, the weight limit on Bimini Bridge
was increased to nine (9) tons, and has now been further increased to ten (10)tons.
The Roads and Bridges Department plans to move ahead with temporary strengthening on the north
side of the bridge. This will be used for traffic while the other side is replaced in the first phase of
the replacement project. The County's consultant is reviewing the load rating calculations. It will
then do design/load rating of the proposed repair (strengthening) before it can tell us what the
ultimate load will be with the repair project implemented.
As seen below, the only access by road for properties located on Duck Key's Harbour Island,
Plantation Island, and Yacht Club Island (the "Affected Area")is via the Bimini Bridge. On Harbour
Island, access by road is via both Bimini and Harbour Drive Bridges; on Yacht Club Island, access
by road is via both Bimini and Seaview Bridges.

There are approximately 79 issued building permits that are currently active for properties within the
Affected Area (this includes permits that are currently eligible for extensions under the Governor's
Emergency Declaration regarding COVID-19). The Florida Building Code and Section 6-103,
Monroe County Code (MCC), provide that permits shall become null and void unless work
authorized by the permit is commenced within 180 days and, once commenced, required inspections
are conducted within 180 days from the last required inspection.
An empty concrete truck or a dry batch truck weighs approximately 15.5 tons, and a concrete truck
with a 10-yard load weighs 33 tons. Therefore, the 10-ton weight limit of Bimini Bridge would
impede the ability of a permit holder to obtain construction materials and potentially cause delays
beyond the time limits of MCC Section 6-103, leading to building permit expiration. Building
permits for the construction of new dwelling units that have been awarded a ROGO allocation are
further compromised, in that the ROGO allocation award expires when its corresponding building
permit expires. In such a case, the property owner would also need to re-apply for a new ROGO
allocation award.
On October 21, 2020, the BOCC adopted Resolution Number 353-2020, authorizing the Monroe
County Building Official to toll the time limits for commencement of construction and required
inspections on building permits for properties located on Duck Key's Harbour Island, Plantation
Island, and Yacht Club Island, which are affected by the FDOT 9-ton weight limit on Bimini Bridge,
until 180 days after a solution for delivery of materials, including concrete, is available.
In order to address the weight limits on Harbour Drive and Seaview Bridges as well, staff is
requesting that the BOCC adopt a superseding resolution to authorize the Building Official to
automatically toll the time limits of MCC Section 6-103, for commencement of construction and
required inspections for building permits that meet the following criteria:

1) The property which is the subject of the building permit is located within a
portion of Duck Key for which the only access by road is via the Bimini Bridge, Harbour
Drive Bridge, and/or Seaview Bridge, including Harbour Island, Plantation Island, and
Yacht Club Island; and
2) The building permit was active and not expired as of October 4, 2020 (list is
attached); or the building permit was issued on or after October 4, 2020.
The applicable building permits that meet the criteria in Section 1 above will be tolled until 180 days
after a solution for delivery of building materials including concrete is available for the respective
bridges impacting the subject building permit. This extension runs concurrently with any other
extension(s) available for the subject building permit(s).
Tolling of a building permit under the authority of this resolution would not preclude a permit holder
from commencing construction and/or completing inspections for work that is not affected by the
Bimini, Harbour Drive, and Seaview Bridge weight limits, and such actions would not forfeit the
permit's tolled status.
Once a solution for delivery of building materials including concrete is available for the applicable
bridge(s), the holder of a tolled building permit will be notified by mail or e-mail by the Building
Department that there must be a passed building permit inspection within 180 calendar days from the
date of the letter or e-mail, or the permit will expire, as required by MCC Section 6-103.

22 WHEREAS, on October 4, 2020, the Florida Department of Transportation (FDOT)
23 inspected bridges on Duck Key and advised that the weight limit for Bimini Bridge would be only
24 three (3)tons, and that the weight limit on Harbour Drive and Seaview Bridges would be ten (10)
25 tons; and

28 revised its analysis and advised the weight limit for Bimini Bridge is nine (9)tons; and

30 WHEREAS, the weight limit on Bimini Bridge has now been updated to ten (10) tons;

33 WHEREAS,the only access by road for properties located on Duck Key's Harbour Island,
34 Plantation Island, and Yacht Club Island (the "Affected Area") is via the Bimini Bridge; and

36 WHEREAS,the only access by road for properties located on Duck Key's Harbour Island
37 is via the Bimini Bridge and the Harbour Drive Bridge; and

39 WHEREAS, the only access by road for properties located on Duck Key's Yacht Club
40 Island is via the Bimini Bridge and the Seaview Bridge; and

I WHEREAS, there are approximately 79 issued building permits that are currently active

4 WHEREAS, there are Rate of Growth Ordinance (ROGO) applications for properties
5 within the Affected Area pending in the ROGO system for award; and

7 WHEREAS,the Florida Building Code and Section 6-103, Monroe County Code (MCC),
8 provide that permits shall become null and void unless work authorized by the permit is
9 commenced within 180 days and,once commenced,required inspections are conducted within 180 �
10 days from the last required inspection; and

22 WHEREAS, on October 21, 2020, the Board of County Commissioners (BOCC or
23 Monroe County) adopted Resolution Number 353-2020, authorizing the Monroe County Building
24 Official to toll the time limits for commencement of construction and required inspections on
25 building permits for properties located on Duck Key's Harbour Island,Plantation Island, and Yacht
26 Club Island, which are affected by the FDOT 9-ton weight limit on Bimini Bridge, until 180 days
27 after a solution for delivery of materials, including concrete, is available; and

29 WHEREAS, the County is exploring ways to provide alternative and interim solutions
30 regarding services, repairs, and replacements; and
31
32 WHEREAS, the BOCC desires to extend the time limit requirements for commencement
33 of construction and required inspections on building permits for properties located within the
34 Affected Area until 180 days after a solution for delivery of building materials, including concrete

35 is available for all three affected bridges, as described above, with certain restrictions;

37 NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
38 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

I Section 1. Recitals and Legislative Intent. The foregoing recitals are true and correct, and
2 are hereby incorporated as if fully stated herein.

4 Section 2. The Monroe County Building Official, or his or her authorized designee, is hereby
5 authorized and directed to automatically toll the time limits of MCC Section 6-103, for
6 commencement of construction and required inspections for building permits that meet the
7 following criteria:
8
9 1) The property which is the subject of the building permit is located within a portion of �
10 Duck Key for which the only access by road is via the Bimini Bridge, Harbour Drive
11 Bridge, and/or Seaview Bridge, including Harbour Island,Plantation Island, and Yacht -�

22 Section 4. Tolling of a building permitunder the authority of this Resolution shall notpreclude
23 a permit holder from commencing construction and/or completing inspection(s) for work that is
24 not affected by the Bimini, Harbour Drive, and/or Seaview Bridge weight limits, and such actions
25 shall not forfeit the permit's tolled status.

27 Section 5. Once a solution for delivery of building materials including concrete is available
28 for the applicable bridge(s), the holder of a building permit tolled under the authority of this
29 Resolution will be notified by mail or e-mail by the Building Department that there must be a
30 passed building permit inspection within 180 calendar days from the date of the letter or e-mail,
31 or the permit will expire, as required by MCC Section 6-103.

33 Section 6. Construction and Interpretation. This resolution and its interpretation shall be �.
34 liberally construed and enforced in favor of Monroe County to effectuate its public purpose(s) and
35 policy(ies) of the County. The construction and interpretation of this resolution and all Monroe
36 County Comprehensive Plan provision(s), Florida Building Code, Florida Statutes, and Monroe
37 County Code(s) provision(s) whose interpretation arises out of, relates to, or is interpreted in
38 connection with this resolution shall be deferred in favor of the BOCC and such construction and
39 interpretation shall be entitled to great weight in adversarial administrative proceedings, at trial,
40 bankruptcy, and on appeal.

I Section 7. No Liability. Monroe County expressly reserves and in no way shall be deemed to
2 have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign, governmental,
3 and any other similar defense, immunity, exemption, or protection against any suit, cause-of-
4 action, demand, or liability.

6 Section 8. Severability. If any provision of this resolution, or any part or portion thereof, is
7 held to be invalid or unenforceable by any administrative hearing officer or court of competent
8 jurisdiction, the invalidity or unenforceability of such provision, or any part or portion thereof,
9 shall neither limit nor impair the operation, enforceability, or validity of any other provision of this
10 resolution, or any remaining part(s) or portion(s) thereof. All other provisions of this resolution,
11 and remaining part(s) or portion(s)thereof, shall continue unimpaired in full force and effect. -�
12
13 Section 9. Repeal of Inconsistent Provisions. All resolutions in conflict with this resolution
14 are hereby repealed to the extent of said conflict. The repeal of a resolution herein shall not repeal
15 the repealing clause of such resolution or revive any resolution which has been repealed thereby.
