ITEM BACKGROUND: Summerland Key Marina, LLC is the current owner of the real property located at 24326 Overseas Highway, Summerland Key, Florida 33042, with a parcel identification number of 00190830-0000. (hereinafter referred to as the "Property"). George Secchiaroli is the owner of Summerland Key Marina, LLC. On or about July 20, 2011, Monroe County Code Compliance Department filed Code Enforcement Case No. CE-11070030 concerning the Property. The Property Owner was cited for building without a permit. On or about July 28, 2011, as a result of a signed stipulation agreement - the Monroe County Code Enforcement Special Magistrate entered a Final Order finding the Property to be in violation of the Monroe County Code. Due to ongoing issues gaining compliance between Code Compliance and the Building Department, the fines accrued to nearly $175,000 against the Property. Ultimately, the County sued the Property Owner in Circuit Court (Case No. 18-CA-001205-K) and the property was brought into compliance. The Property Owner made a settlement offer to resolve all claims raised in the above referenced Code Enforcement Case and the Circuit Court case. The Property Owner proposes to pay a $25,000.00 fine and costs totaling $3,267.70 for a total amount of$28,267.60. The Board discussed the proposed terms at the October 21, 2020 BOCC meeting in lieu of a closed session and gave conceptual approval of the terms. The proposed settlement agreement would formalize the terms of the agreement and include a mutual release of any and all claims capable of being raised. On or about July 28, 2011, as a result of a signed stipulation agreement - the Monroe County Code Enforcement Special Magistrate in Case No. CE-11070030 entered a Final Order finding the Property to be in violation of the Monroe County Code as alleged by Monroe County Code Compliance. 5. On or about February 18, 2015, the July 28, 2011 Final Order was recorded in the Public Records of Monroe County. Florida at Book 2725, Page 391, as a lien against the Property. 6. On August 27, 2015 an Amended Final Order was entered by the Monroe County Code Enforcement Special Magistrate in Case No.: CE-11070030, amending the July 28, 2011 Final Order and authorizing further foreclosure and/or money judgment Packet Pg. 2528 R 5.a proceedings. On or about September 8, 2015 the Amended Final Order was recorded in the Public Records of Monroe County, Florida at Book 2759, Page 1638 as a lien against the Property. 7. On or about October 10, 2018, the BOARD OF COUNTY Ul) N COMMISSIONERS OF MONROE COUNTY FLORIDA as Plaintiff caused to be filed a co suit against SUMMERLAND KEY MARINA, LLC and GEORGE SECCHIAROLI, as Defendants, in the Circuit Court of Monroe County,Case Number 18-CA-001205-K. 8. After discussions between counsel for BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY FLORIDA, A POLITICAL SUBDIVISION E OF THE STATE OF FLORIDA and SUMMERLAND KEY MARINA, LLC and GEORGE 0 SECCHIAROLI, the parties have agreed to settle all of their separate claims and defenses 0 against one another and agree that they shall Have no claims against one another for all or any damages, fines, attorney's fees or costs relating to the matters which were or could have been raised in the above referenced Code Enforcement Case No. CE-11070030 and the resulting Final Order and Amended Final Order, as well as the result Circuit Court case bearing Case No. 18-CA-001205-K. As a result, a Notice of Violation/Notice of Hearing was mailed to the property owner as per the tax records on July 20, 2011 to appear at the hearing on July 28, 2011. Additionally, research revealed that Mr. Secchiaroli had entered co into a Quit Claim Deed transferring title of the property from Summerland Key Marina LLC to himself individually. CD Therefore a Notice of Hearing to be held on August 27, 2015 was mailed certified mail to the address on the tax M CD records. The hearing was held and Mr. Secchiaroli was present and addressed the Special Magistrate. The Special W Magistrate granted the motions to amend respondent's name on Final Order and authorize foreclosure and/or money judgment proceedings.
