AMENDMENT 1 TO THE AGREEMENT UNDER THE
CORONAVIRUS AID RELIEF, AND
ECONOMIC SECURITY ACT FUNDING PROGRAM
WITH STAR OF THE SEA FOUNDATION, INC.
THIS AMENDMENT is made and entered into this 9th day of December 2020 between the
BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, hereinafter referred to as
"COUNTY'and Star of the Sea Foundation, Inc., hereinafter referred to as'AGENCY'.
WHEREAS, the PROVIDER is a not-for-profit corporation established for the provision of food
assistance to struggling families, and
WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act; P.L. 116-
136), was signed into law on March 27, 2020 and created the Coronavirus Relief Fund,which provides
$150 billion in direct assistance for domestic governments; and
WHEREAS, on June 10, 2020, Governor DeSantis announced the State of Florida's plan to
disburse up to $1.275 billion in CARES Act funds to counties like Monroe County with a population
below 500,000; and
WHEREAS, the COUNTY and the Florida Division of Emergency Management (herein after
DIVISION) entered into a CARES Act funding agreement which distributes an initial disbursement of
25% of the COUNTY's allocation; and
WHEREAS,the Agreement with the DIVISION provides that funds may only be used on eligible
expenditures as defined by the CARES Act, and related guidance from the U.S. Department of the
Treasury, and the COUNTY agrees to repay the State of Florida any portion of the disbursed funds that
Is unused or not utilized in accordance with the CARES Act; and
WHEREAS, the COUNTY recognizes the provision of food to COVID-19 Impacted persons and
families a necessary response to the coronavirus public health and economic crisis; and
IN CONSIDERATION of the mutual promises and covenants contained herein, it is agreed as
follows:
1. Section 1 FUNDING, Item 1, AMOUNT OF AGREEMENT, shall be amended to reflect
additional funds awarded:
The COUNTY shall therefore pay to the AGENCY an additional sum of THREE
HUNDRED THOUSAND AND NO/DOLLARS ($300,000.00).
2. In all other respects the Agreement dated October 21, 2020 remains in full force and
effect.
