ITEM BACKROUND: The first public hearing or "transmittal hearing" was held on November 12, 1998, where the BOCC recommended approval of the Future Land Use Map (FLUM) amendment being proposed. The Planning Department transmitted a draft FLUM ordinance to the Department of Community Affairs (DCA) for its consideration. The DCA has reviewed the proposed FLUM amendment and has no objections to the proposed amendment as transmitted. PREVIOUS RELEVANT BOARD ACTION: The BOCC approved a resolution authorizing the Planning Department to transmit a draft ordinance that would amend the Future Land Use Map to the DCA for review. WHEREAS, the Monroe County Board of County Commissioners on April 15, 1993 adopted the Monroe County Year 2010 Comprehensive Plan, and therefore, designated the properties set forth below with various designations on the Future Land Use Map (FLUM); and WHEREAS, the Planning Department initiated a request to change the Future Land Use Map from the various existing designations as set forth below to Conservation (C); and WHEREAS, the Development Review Committee recommended approval of the request to the Planning Commission during a regular meeting on July 16, 1998, and the Planning Commission recommended approval of the request to the Board of County Commissioners during a public hearing on September 2, 1998; and WHEREAS, the Board of County Commissioners, during a public hearing held on November 12, 1998, conducted a review and considered a request for a future land use map amendment to the Monroe County Year 2010 Comprehensive Plan filed by Monroe County to change the various future land use designations to Conservation (C) for the below described properties; and WHEREAS, the Board of County Commissioners approved the transmittal of a proposed ordinance to the Department of Community Affairs for its review and consideration; and WHEREAS, the Department of Community Affairs made no objections, recommendations or comments regarding the proposed ordinance; and WHEREAS, the Board of County Commissioners held a second public hearing on February 17, 2000 to consider the proposed amendment; and WHEREAS, in November 1999, portions of Monroe County incorporated to form the City of Marathon; and WHEREAS, at this time, the Board of County Commissioners no longer has jurisdiction inside the city limits; and Parks/(C) Page 1 of 4 Initials WHEREAS, CoCo Plum Beach lies within the city's jurisdiction and was a property under consideration for this future land use designation change; and WHEREAS, that portion of the proposed ordinance identifying CoCo Plum has been removed from this ordinance and will be provided to the City of Marathon to process; and WHEREAS, the Board of County Commissioners hereby makes the following Findings of Fact and Conclusions of Law: 1. Based on Section 9.5-511 of the Monroe County Code (MCC), the Board of County Commissioners may consider a land use change if at least one of six criteria is met. Goal 102 and Objective 10 1. 11 of the Year 2010 Comprehensive Plan stipulate that Monroe County must implement measures to direct future growth away from environmentally sensitive land. These properties were purchased by the County to prevent development on environmentally sensitive land. Therefore, the proposed land use changes are consistent with the requirements enumerated in Section 9.5- 51 1(5)(d)b.(v) (Need for Additional Comprehensiveness) of the Monroe County Code. 2. Based on the Monroe County Existing Conditions Maps and site visits by Monroe County Biologists (Niko Reisinger and Dianna Stevenson), it has been determined that these properties contain significant natural habitat worthy of preservation. Goal 102 and Objective 101. 11 direct Monroe County to encourage conservation and protection of environmentally sensitive lands. Therefore, the proposed land use changes are consistent with the standards enumerated in Goal 102 and Objective 101. 11 of the Year 2010 Comprehensive Plan. 3. Based on Policy 101.4. 15 of the Year 2010 Comprehensive Plan, the principal purpose of the Conservation future land use category is to provide publicly owned lands held primarily for the preservation of natural and historic resources and compatible passive recreational uses. These properties were purchased by Monroe County to prevent harmful development on environmentally sensitive lands while providing recreational opportunities to County residents and visitors. Therefore, the Conservation (C) future land use category is most applicable to these environmentally sensitive properties. 4. The environmental preservation of these sites, through limiting the use to passive recreation, will greatly reduce the development potential on these properties. Therefore, the proposed land use changes will not negatively impact existing public facilities. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: Section 1. Based on Section 9.5-511 of the Monroe County Code (MCC), the Board of County Commissioners may consider a land use change if at least one of six criteria is met. Policy 1201.4. 1 of the Year 2010 Comprehensive Plan stipulates that existing County -owned neighborhood and community parks shall be assigned to the Park and Refuge land use district. In addition, the adopted standards set forth in Policy 101.4.21 of the Year 2010 Comprehensive Plan stipulate that all properties zoned Park and Refuge District (PR) shall have the corresponding future land use category Recreation (R). The attached aerial photographs indicate the surrounding land uses of each site. The majority of the parks are located within walking distance of potential users. However, on site parking is provided at most facilities to expand the service area. Existing Habitat: Site visits and an examination of the existing site conditions maps indicate that the majority of the sites are scarified. New Issues: These properties were purchased and taken out of the pool of vacant properties eligible for private development for the expressed purpose of providing active recreational opportunities for County residents and visitors in accordance with the Level of Service standards enumerated in Policy 1201.1.1 of the Monroe County Year 2010 Comprehensive Plan. Need for Additional Comprehensiveness: Policy 1201.4.1 of the Year 2010 Comprehensive Plan stipulates that "existing County -owned neighborhood and community parks shall be assigned to the Parks and Refuge Land Use District." In addition, Policy 1201.4.2 states that "upon fee simple acquisition, new County -owned neighborhood and community park sites shall be reassigned to the Park and Refuge Land Use District." The standards set forth in Policy 101.4.21 of the Year 2010 Comprehensive Plan stipulate that all properties zoned Parks and Refuge (PR) shall have the corresponding Future Land Use category Recreation (R). Data Updates: None. IMPACT AND POLICY ANALYSIS: Comparison of Development Potential for the Current and Proposed Land Uses: The development potential associated with the current and proposed designations is limited because these properties were purchased by the County with the specific intent of providing active recreational opportunities for County residents and visitors. To insure that these properties are used as public park lands in the future, a new future land use designation of Recreation (R) is recommended by staff. In addition, staff recommends that the properties be rezoned to Park and Refuge (PR) so that building permits for parks related construction may be issued. Many facilities required at County parks, such as athletic fences and lighting, may not be permitted in other zoning classifications. Compatibility with Adjacent Land Uses and Effects on Community Character: #M98128\parks\PCmap2. doc Sec. 9.5-511, Monroe County Code (MCC), prohibits any amendments which would negatively impact community character. Parks and residential uses are compatible because parks serve the residents of surrounding neighborhoods. The platted subdivision lots in the Keys tend to be very small and therefore, do not adequately provide space for the outdoor -recreational pursuits of residents. Essentially, the County parks have become the "backyards" of subdivision dwellers. Additionally, the placement of these parks in and around existing subdivisions, makes them more accessible to pedestrians and bicyclists. Effects on Natural Resources: Goal 102 states that the County shall direct future growth to lands which are intrinsically most suitable for development and shall encourage conservation and protection of environmentally sensitive lands. The majority of the County park sites are scarified. However, when environmentally sensitive habitat exists on a park site, new development shall be clustered in accordance with Section 9.5-345(a) of the Monroe County Code, to limit the clearing of native vegetation. Effects on Public Facilities: Objective 101.11 requires the County to direct future growth away from environmentally sensitive land and towards established development areas served by existing public facilities. The proposed designations are not in conflict with Objective 10 1. 11 based on the findings of the 1997 Public Facilities Capacity Assessment Report and the listed programs on stormwater and wastewater: Solid Waste: The existing solid waste haul -out contract provides the county with approximately nine years of guaranteed capacity. These County recreation areas will not generate any appreciable solid waste. Debris from the removal of invasive exotic vegetation could be mulched and used for bufferyard ground -cover on scarified park sites throughout the County. Potable Water: The Florida Keys Aqueduct Authority's existing consumptive use permit authorizes the withdrawal of sufficient quantities to meet the demand anticipated for 1997. The proposed land use changes are not expected to have a significant effect on potable water withdrawals. Watering the playing fields at the parks will not require more water than would be used by the significant number of residential units which could have been constructed on these parcels of land. Roads: To support additional development the County is required to maintain a level of service "C" on US-1. The rezoning of County parks should not negatively impact the level of service on US-1 because no additional trips will be generated. Stormwater: No net increase in stormwater runoff is expected as a result of this land use change because the County designs its facilities in accordance with all applicable stormwater retention regulations. Section 9.5-293 of the Land Development Regulations requires that all development retain stormwater on site following Best Management Practices (BMP). Also, pursuant to Policy 1001.1.1, all projects shall be designed so that the discharges will meet Florida State Water Quality Standards. Compliance review for these sections is determined by the Environmental Resources Department and the Department of Health and occurs at the time a development permit has been filed. In addition, Monroe County and the South Florida Water Management District, acting in accordance with Governor Chiles' Executive Order No. 96- 108, have developed an agreement for the development of a Stormwater Management Master Plan. #M98128\parks\PCmap2.doc A Wastewater: There are several programs and policies in place that address wastewater treatment throughout Monroe County: • Policy 901.1.1 provides the interim Level of Service for wastewater treatment plants and OSDS (On Site Disposal Systems), stating that they must use AWT (Advanced Wastewater Treatment), BAT (Best Available Technology) and not exceed 100% of their planned capacity. • Ordinance No. 03-1997, adopted pursuant to Objective 901.2 and related policies, establishes an inspection and compliance program for OSDS, and requires among other things, that all (commercial and residential) cesspits be replaced, that all septic tanks be inspected and if necessary, upgraded to meet state standards. • Policy 101.2.13 is also tied to the inspection and compliance program in that a cesspit must be replaced with BAT for every single family home permitted under the County's Rate of Growth Ordinance (ROGO). The proposed land use changes will not interfere with the implementation of these programs because they are ongoing and do not rely upon a "development permit" trigger. Effects on Redevelopment and Infill Potential: The proposed land use changes do not have any affect on infill and redevelopment potential. The rezonings affect only the park properties which are currently nonconforming because of their current zoning and future land use classifications. FINDINGS OF FACT AND CONCLUSIONS: Based on Section 9.5-511 of the Monroe County Code (MCC), the Board of County Commissioners may consider a land use change if at least one of six criteria is met. Policy 1201.4.1 of the Year 2010 Comprehensive Plan stipulates that existing County -owned neighborhood and community parks shall be assigned to the Park and Refuge land use district. In addition, Policy 1201.4.2 states that upon fee simple acquisition, new County -owned neighborhood and community park sites shall be reassigned to the Park and Refuge land use district. Therefore, the proposed land use changes are consistent with the requirements enumerated in Section 9.5-5l l(5)(d)b.(v) (Need for Additional Comprehensiveness) of the Monroe County Code. Based on Section 9.5-511 of the Monroe County Code (MCC), the Board of County Commissioners may consider a land use change if at least one of six criteria is met. The adopted standards set forth in Policy 101.4.21 of the Year 2010 Comprehensive Plan stipulate that all properties zoned Park and Refuge (PR) shall have the corresponding future land use category Recreation (R). Therefore, the proposed land use changes are consistent with the requirements enumerated in Section 9.5-511(5)(d)b.(v) of the Monroe County Code. Based on Policy 101.4.9 of the Year 2010 Comprehensive Plan, the principal purpose of the Recreation (R) future land use category is to provide for public and private activity -based and resource -based recreational facilities. These properties are currently used, or shall be developed in the near future, as public parks. Based on Section 9.5-224 of the Monroe County Code, the principal purpose of the Park and Refuge District (PR) land use category is to establish and protect areas as parks, recreational areas, and wildlife refuges. The second group of sites lie within the Bay Haven subdivision at mile marker 95 on Key Largo. These small residential lots remain vacant and have been deemed unbuildable for environmental reasons. The third site consists multiple vacant residential lots combined in two separate beach front sections along Coco Plum Beach. The forth group of parcels are located at Cutthroat Harbor Estates, mile marker 22.5 Cudjoe Key, are platted residential lots which have remained vacant because of environmental sensitivity. Existing and Proposed Use: All of the properties are currently vacant. The County intends to conserve these properties in their natural state to provide open space within existing residential subdivisions. Neighboring Land Uses and Character: The vicinity of the subject properties is characterized by low density residential uses. All of the subdivisions containing these properties will likely not be built -out because the Monroe County Rate of Growth Ordinance (ROGO) does not favor residential construction on property containing native habitat. In particular, the Garden Cove site is adjacent to the undeveloped Port Bougainville Subdivision which is part of the largest continuous hardwood hammock in North America. The Florida Department of Environmental Protection is currently working on a management plan for the hammock which tentatively includes the creation of a State Park facility on the old Port Bougainville Development site. Existing Habitat: Site visits by County Biologists and an examination of the existing site conditions maps indicate that all of the sites contain native habitat. The properties can be classified by three basic habitat categories: hardwood hammock, transitional wetlands, or freshwater wetlands. All of the sites play host to native plants and animal species, including the endangered Florida Key Deer at Cutthroat Harbor. Bay Haven Single Family Residential District (RU-1) providing for permanent single family residential dwellings and non-profit parks and playgrounds when owned and operated by the residents of the subdivision. Coco Plum Beach Multiple -Family Residential District (RU-3) providing residential areas in which multiple -family dwellings or apartments may be constructed and occupied with the amenities of a protected living environment. Considerations During the 1986 Comprehensive Plan Process: During the 1986 planning process, none of the subject properties were specifically discussed. Considerations during the 2010 Comprehensive Plan Process: Planning Department records do not indicate any specific consideration of these properties. Map Changes or Boundary Considerations Since 1986: The subject properties were not involved in any map changes or boundary considerations. IMPACT AND POLICY ANALYSIS: Comparison of Development Potential for the Current and Proposed Land Uses: The development potential associated with the current and proposed designations is limited because of the natural habitat which exists on these sites. These properties were purchased by the County with the specific intent of preventing residential or commercial development on environmentally sensitive lands. Further, the preservation of these lands will have a positive effect on the character of the residential subdivisions in which they are located. To insure that these habitats are protected in the future, a new land use designation of Conservation (C) is recommended by staff. Compatibility with Adjacent Land Uses and Effects on Community Character: Sec. 9.5-511, Monroe County Code (MCC), prohibits any amendments which would negatively impact community character. Objective 101.4 directs the county to maintain community character and protect natural resources through a distribution of land uses consistent with the Future Land Use Map. The proposed designations shall insure that the low density character of surrounding properties is enhanced with pockets of natural open space. Based on Policy 101.4.15 of the Year 2010 Comprehensive Plan, the principal purpose of the Conservation future land use category is to provide publicly owned lands held primarily for the preservation of natural and historic resources and compatible passive recreational uses. These properties were purchased by Monroe County to prevent commercial or residential development on environmentally sensitive lands while providing passive recreational opportunities to County residents and visitors. Therefore, the Conservation (C) land use category is most applicable to these environmentally sensitive properties. 4. Based on Section 9.5-225 of the Monroe County Code, the principal purpose of the Conservation District (CD) land use category is to provide an area acquired for conservation purposes. These properties were purchased by Monroe County with the intent of conserving natural habitat. Therefore, the Conservation District (CD) land use category is most applicable to these environmentally sensitive properties. Based on the intent of the proposed land use changes, environmental preservation will be encouraged on the subject properties. The environmental preservation of these sites, as passive recreational areas, will greatly reduce the development potential on these properties.
