AGENDA ITEM WORDING: Second of two public hearings to consider a Future Land Use Map
and Land Use District Map (zoning map) amendment proposed by Ciro Bologna et.al. changing the
future land use designation from Residential Medium (RM) to Mixed Use/Commercial (MC) and
changing the zoning from Improved Subdivision (IS) to Sub Urban Commercial (SC) for property
described as Lot 41, Block 01, Lida Subdivision, Vaca Key, located in Section 01, Township 66 South,
Range 33 East; with a real estate number of 00347940-000000.
ITEM BACKGROUND: The first public hearing, or "transmittal" hearing was held on September 8,
1999, where the BOCC recommended approval of the Fture Land Use Map (FLUM) amendment request.
The Planning Department transmitted a draft FLUM ordinance to the Department of Community Affairs
(DCA) for its consideration. The DCA has reviewed the proposed Future Land Use Map amendment and
has made the comment that the proposed amendment was not supported with adequate evidence. Since
the transmittal to the DCA, the area containing the subject parcel has incorporated. The City of
Marathon's charter indicates that its status as an independent entity commences on November 30, 1999,
meaning the City retains all planning and zoning authority. As a result of these factors, the Planning
Department recommends that this request be forwarded to the City of Marathon. The response to the
DCA's comments should be prepared by the City's government.
PREVIOUS RELEVANT BOARD ACTION: The BOCC approved a resolution authorizing the
Planning Department to transmit a draft ordinance that would amend the Future Land Use Map to the
DCA for review.
