("Consultant"), in order to amend the Agreement, as First Amended on May 20, 2015, Second Amended on October 21, 2015, Third Amended on May 17, 2017, Fourth Amended on January 17, 2018, as Fifth Amended on May 16, 2018, as Sixth Amended on February 20, 2019, as Seventh Amended on June 19, 2019, as Eighth Amended on November 20, 2019,as Ninth Amended on December 11,2019,and as Tenth Amended on August 19,2020 as follows: WHEREAS,on February 18,2015,the parties entered into an Agreement for professional services to design and permit the Plantation Key Judicial Courthouse and Detention Facility("Project");and WHEREAS, on May 20,2015,the parties agreed to a First Amendment to the Agreement increasing Consultant's scope of work to undergo a site plan review and approval process,which is a requirement for the Village of Islamorada;and WHEREAS, on October 21, 2015, the parties agreed to a Second Amendment to the Agreement to provide a schedule of values for compensation that includes the Schematic Design, Design Development, Construction Documents, Bidding and Permitting, and Construction Administration phases; and WHEREAS,on May 17,2017,the parties agreed to a Third Amendment to the Agreement to provide sub-consultant services for Civil Engineering, Landscape and Irrigation design, Voice/Data/AV and Security, Acoustics, Sustainable Design and Cost Estimating and to include public records provision revisions in compliance with section 119.071 Florida Statues; and WHEREAS, on January 17, 2018, the parties agreed to a Fourth Amendment to the Agreement to provide sub-consultant services for the Interior Design and Building Commissioning and Training Services as identified in Attachment C of the Agreement, and with the Florida Department of Management Services Design Professional Guidelines; and WHEREAS,on May 16, 2018,the parties agreed to a Fifth Amendment to the Agreement to provide the Services of an Architectural Historian to verify the historic significance of the existing Spottswood building's eligibility to be registered as a Historic place; and WHEREAS, on February 20, 2019, the parties agreed to a Sixth Amendment to the Agreement to provide site investigation,utility coordination and phasing coordination with existing structures on the Project;and Eleventh Amendment to Agreement with CSA for PK Courthouse Page 1 of 4 WHEREAS, on June 19, 2019, the parties agreed to a Seventh Amendment to the Agreement to increase the Consultant fee for services due to the increase in the project scope and construction budget; and WHEREAS,on November 20,2019,the parties agreed to an Eighth Amendment to the Agreement to increase the Consultant fee for services due to an error on the original site survey provided by the County; and WHEREAS, on December 11, 2019, the parties agreed to a Ninth Amendment to the Agreement to redesign certain aspects of the structure in order to pursue cost saving opportunities to possibly reduce the overall cost of the project; and WHEREAS, on August 19, 2020, the parties agreed to a Tenth Amendment to the Agreement to provide additional design documents for the demolition of the adjacent existing detention center and existing courtroom B; and WHEREAS, due to the lag time between original design and construction, multiple design changes are needed in order to abide by changes in the standard operating procedures of the Monroe County Sheriff's Office and also to incorporate miscellaneous requests for changes by the Circuit Court for the 16'h Judicial Circuit. NOW THEREFORE IN CONSIDERATION of the mutual promises obtained herein, the parties hereby agree that the original Agreement shall be amended as follows: 1. In accordance with Article III, Attachment C, of the Agreement, Consultant shall engage the services of sub-consultants, as needed, to provide all necessary actions, coordination and deliverables to provide documents to reflect the following actions: Items Requested by MCSO: • Janitor closet D136 conversion to attorney meeting room(add Arrnortext window with pass thru tray and speaker port,plus writing surface on either side). • Relocation of mop sink from D136 to Supply Room D 109. • Hand Wash Station requested at Sally port - Adjacent to door D144A (research and find product,provide detail). • Pass Thru slot requested from booking to control room (pass thru slot not possible, provided pass thru cabinet to maintain smoke rating). • Add secured fence and gate outside of Area of Refuge. • Concrete wall and desk needed at elevated dormitory slab(create plan and perspective for approval,provide structural detail). • Add west side "Forte" Vestibule adjacent to Rec Yard (provided options and had multiple discussions. 8'high area was decided on). • PREA partitions at cells (create views for MCSO approval and presented to client for approval then finalize). Eleventh Amendment to Agreement with CSA for PK Courthouse Page 2 of 4 • Restroom area partitions at Dormitory(presented to the client,MCSO decided to raise partition height from original design). • Add a 220v electric outlet in Booking D 135 to accommodate new shrink wrap machine for inmate personal effects. • Add telephone in Holding Cell D145 for inmate/attorney phone calls(Phone model to be provided to design team for inclusion). • Add J-box w/pull string in Secure Lock D146 for future 'Body Scanner'. • Coordination with Monroe County's Air Purification Vendor(SD Air)to redesign the supply/exhaust air and add HEPA filtration. System Certification to be performed by Vendor. • Relocate Booking Desk,power,and data outlets. • Add one-way film to various windows in detention areas. Item Requested by the Circuit Court for the 16th Judicial Circuit: • Revised cabinetry-at Copy 121 to accommodate Key watcher and ID station. • Add Power and Data Drops per Circuit Court for the 16th Judicial Circuit request (coordinate with Empire Office and Holly Elomina). 2. Pursuant to section 7.3 of the Agreement, the County shall pay the Consultant monthly in current funds for a percent complete of the Consultant and sub-consultants' services for the total not to exceed amount of Twenty-Seven Thousand Nine Hundred and Five Dollars and 00/100($27,905.00). The remaining terms of the Agreement and as Amended,not inconsistent herewith, shall remain in full force and effect.
