ITEM BACKGROUND: Five (5)bids were received at the bid opening held on November 3, 2020 and the lowest bidder, Design Center was awarded the bid and contract at the BOCC meeting held on November 17, 2020. Upon notice to proceed to Design Center for construction, construction administration and construction inspection services will begin. Jacobs will provide construction support services associated with the bid phase services of Task o Order 121"l 5-80. DESCRIPTION OF WORK 76 E The construction support services will provide the following: ARTICLE A—CONSTRUCTION SUPPORT SERVICES co Services during this work phase shall include the following unless otherwise noted: LO cv ■ Prepare for and attend Pre-Construction conference. ■ Review all shop drawings submitted by the contractors and all materials used in 0 the construction of the project. Assume sixteen(16) shop drawings throughout the course of the construction project. i ■ Respond to RFI's and prepared field sketches as necessary. Assume forty(40) RFI's throughout the course of the construction project. >- ■ Attend site visits and onsite project related meetings every other week. Assume W thirteen (13)site visits throughout the course of the construction project. co c' ■ Attend telcon project related meetings every other week(staggered with onsite LO project meetings). Assume thirteen(13)throughout the course of the construction project. ■ Prepare and negotiate change orders, as necessary. Assume four(4)change CL orders. ■ Attend final inspection meeting and generate report. Attend follow up to the final inspection meeting ■ Review close out documentation. ■ Edit electronic drawing files to produce record drawings from marked drawings m provided by the Contractor. ■ Review and approve Pay Application submitted by the Contractor. ■ Review quality control testing performed by the contractor and review results. Services for Article A will be provided under a lump sum basis based on a 180-calendar day construction completion schedule. QUALIFICATIONS AND ASSUMPTIONS Pap t €f Packet Pg.372 C.7.a For the purpose of providing a stipulated fee amount, this proposal has been based on the following qualifications and assumptions: • Architect/Engineer construction inspections are not included. Inspection services for building =permitting inspections is not in our scope (no inspectors on staff), none are anticipated by the architect/engineer. • Attendance and/or presentation to public hearings and/or other meetings with municipal agencies are not included. • Municipal Agency and all associated permit fees are to be paid by the client. Jacobs is not responsible for obtaining any permits. Permits are to be obtained by the contractor.Jacobs will monitor the contractor's progress through the permit process for the client and provide follow up periodically with the permitting agency to verify the status, but it is ultimately the responsibility of the contractor to obtain all permits. . • Printing of plans shall be treated as reimbursable direct expenses and are included as part of this proposal. • Construction Support Services are based upon the following: 16 shop drawings product submittals. Our assumption is 80%of submittals will be approved on the first review and 20%will require re-submittal for a total of 16 submittal reviews. • Construction Support Services are based upon the following: 40 Requests for Information(RFI's). • Construction Support Services for site visits consists of providing 13 visits(one Co Co person) for a total of 13 site visits throughout the duration of construction. • Contract Support Services does not include maintenance or preparation of As- Built drawings which is the contractor's responsibility. • Quality Control is the responsibility of the contractor. • Quality Assurance testing is included. • Services not described in the scope of work are not included. Preparing Record Drawings- Record drawings will be prepared, in part, on the basis of information compiled and furnished by others,and may not always represent the exact location, Co type of various components, or exact manner in which the project was finally constructed. Jacobs LO is not responsible for any errors or omissions in the information from others that is incorporated into the record drawings 0 CL Review of Third-Party Design-Any review by Jacobs of design prepared by a third- party shall N be for general conformance with the design intent, drawings and specifications but not a complete review of all design details and calculations. The Designer and their design professionals shall remain responsible for the accuracy and completeness of their design and construction documents. Jacobs does not assume any liability for work product(s)prepared by third parties, including but not limited to design and related work and makes no representation or warranty regarding same. Jacobs will reasonably rely upon the accuracy,and completeness of the information/data provided by the Client or other third parties. Construction Phase Services-If this Agreement includes the furnishing of any Services during the construction phase of the project, the following terms will apply: (a) If JACOBS is called upon to observe the work of CLIENT's construction contractor(s)for the detection of defects or deficiencies in such work,JACOBS will not bear any responsibility or liability for such defects or deficiencies or for the failure to so detect. JACOBS shall not make inspections or reviews of the safety programs or procedures of the construction contractor(s)and shall not review their work Page 2 of 4 Packet Pg.373 C.7.a for the purpose of ensuring their compliance with safety standards. (b) If JACOBS is called upon to review submittals from construction contractors,JACOBS shall review and approve or take other appropriate action upon construction contractor(s)' submittals such as shop drawings, product data and samples, but only for the limited purpose of checking for conformance with information given and the design concept expressed in the contract documents. JACOBS' action shall be taken with such reasonable promptness as to cause no delay in the work while allowing sufficient time in JACOBS' professional judgment to permit adequate review. Review of such submittals will not be conducted for the purpose of determining the accuracy and completeness of other details such as dimensions and quantities. (c) JACOBS shall not assume any responsibility or liability for performance of the construction services, or for the safety of persons and property c, during construction, or for compliance with federal, state and local statutes, rules, regulations and codes applicable to the conduct of the construction services. JACOBS shall have no influence over the construction means, methods, techniques, sequences or procedures. Construction safety shall remain the sole responsibility of the construction contractor(s). (d) All contracts between o CLIENT and its construction contractor(s) shall contain broad form indemnity and insurance clauses in favor of CLIENT and JACOBS, in a form satisfactory to JACOBS. On-Site Services During Construction-The presence or duties of Jacobs' personnel at a construction site, whether as onsite representatives or otherwise,do not make Jacobs or Jacobs' °® personnel in any way responsible for those duties that belong to Client and/or the construction F- contractor or other entities,and do not relieve the construction contractor or any other entity of their obligations, duties, and responsibilities, including, but not limited to, all construction co co methods, means, techniques, sequences, and procedures necessary for coordinating and completing all portions of the construction work in accordance with the construction Contract Documents and any health or safety precautions required by such construction work. Jacobs and Jacobs' personnel have no authority to exercise any control over any construction i contractor or other entity or their employees in connection with their work or any health or safety precautions and have no duty for inspecting, noting, observing,correcting, or reporting on health >- or safety deficiencies of the construction contractor(s)or other entity or any other persons at the site except Jacobs' own personnel. co LO cv The presence of Jacobs' personnel at a construction site is for the purpose of providing to Client a o greater degree of confidence that the completed construction work will conform generally to the construction documents and that the integrity of the design concept as reflected in the CL construction documents has been implemented and preserved by the construction contractor(s). .0 0 Jacobs neither guarantees the performance of the construction contractor(s)nor assumes responsibility for construction contractor's failure to perform work in accordance with the construction documents.
