ITEM BACKGROUND:
The owners of 30 and 32 Ocean Reef Drive, Key Largo, Florida have requested vacation of an
unused 3' wide easement, which traverses both of the above-referenced properties, in order to enable
development. The easement runs through the southeast corner of 30 Ocean Reef Drive and adjacent
to the northwest property line of 32 Ocean Reef Drive and contains a total area of 981.3 square feet.
The proposed easement vacation is depicted in red below.

The subject easement was established within the Anchor Drive Ocean Reef Plat No. 10, which was
recorded in July 1974.
The reference on the subject plat to the easement is on its first page under "dedication". It provides
in relevant part that"the utility easements described as:A strip of land 6 feet in width, running along
the street frontage, and a strip of land 3 feet in width, running along the sidelines of every lot in this
subdivision; are hereby reserved for the installation and maintenance of utility distribution lines and
shall be kept free ofpermanent obstructions".

In addition, a Declaration of Restrictions, recorded in July 1974,provides as follows in its paragraph
seventeen (17): "PUBLIC UTILITY EASEMENT. "Declaration ofRestrictions, Limitations,
Conditions and Agreements". It provides in relevant part that"A perpetual easement is reserved
over, on and across a strip of land six (6)feet in width running along the street frontage, and a strip
of land three (3)feet in width running along the sidelines of each of the lots in the subdivision for the
installation and maintenance of telephone and electrical lines, conduits,poles and incidental
equipment water and gas mains, sewer and sewer lines, and any other utility or any similar facility
deemed by the Subdivider necessary for the services ofsaid lines; and the Subdivider further
reserves the right to assign the use of such easements and right-of-way to any person,firm,

Monroe County has received no objections from any utility providers in connection with this request
to vacate the subject easement.

23 Ocean Reef Club, Inc. and Ocean Reef Chapel, Inc. (the "Applicants") have requested to vacate
24 an easement on property located at at 30 and 32 Ocean Reef Dr., Tract "A", ANCHOR DRIVE
25 SUBDIVISION OCEAN REEF PLAT NO. 10, according to the Plat thereof as recorded in Plat
26 Book 6, Page 118, on the Public Records of Monroe County, Florida.

28 The Applicants seek the easement vacation for the following reasons:

The subject Easement is not in use and its ration through the middle of both properties restricts development on
30 each property.

32 Ocean Reef Club, Inc. owns 30 Ocean Reef Dr. and Ocean Reef Chapel, Inc. owns 32 Ocean
33 Reef Dr. (the "Property Owners") as shown whithin the blue contour in Figure 1 below. There is
34 an existing easement that traverses both properties, which the Property Owners desire to vacate.
35 The request to vacate the easement is made to provide unrestricted development and eliminate
36 the unused easement. The three (3) foot wide utility easement runs through the southeast corner
37 of 30 Ocean Reef Dr. and adjacent to the northwest property line of 32 Ocean Reef Dr. The
38 easement runs in a zigzag pattern from the right-of-way of 30 Ocean Reef Dr. to the northeast
39 property line of 32 Ocean Reef Dr. and contains a total area of 981.3 square feet. The proposed
40 easement vacation is shown in red in Figure 1.

interpretation arises out of, relates to, or is interpreted in connection with this resolution shall be liberally
construed and enforced in favor of Monroe County to effectuate its public purpose(s) and policy(ies) of the
County, and shall be deferred in favor of the BOCC and such construction and interpretation shall be entitled
to great weight in adversarial administrative proceedings, at trial,bankruptcy, and on appeal.
Section 4. No Liability. Monroe County expressly reserves and in no way shall be deemed to
have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign, governmental, and any
other similar defense, immunity, exemption, or protection against any suit, cause-of-action, demand, or
liability.

Section 5. Severability.If any provision of this resolution,or any part or portion thereof,is held
to be invalid or unenforceable by any administrative hearing officer or court of competent jurisdiction, the
invalidity or unenforce ability of such provision, or any part or portion thereof, shall neither limit nor impair
