DEP & FPL Sugarloaf Wi-Fi, Inc. Estate of Jerome Pfahning Donald Davis v. Monroe County Administrative Cases of Interest 1. FKAA v. FDEP & Florida Power& Light, — DOAH Case Nos. 20-2967 (consolidated with 20-2968, Florida Fishing Guides Ass'n v. FPL). The FKAA filed an administrative petition challenging DEP's intent to issue a National Pollution Discharge Elimination System (NPDES) permit to FPL to operate treatment and disposal facilities at Turkey Point Power Plant. The County's motion to intervene in support of FKAA was granted on 8/26/20. On 12/23/20, the AU denied the FKAA and County's motion to continue the final hearing. That hearing is set for 1/19/21 - 1/29/21. 2. Monroe County v. FEMA - (Stiglitz House Appeal) FEMA-4337-DR-FL — Monroe County, Public Assistance ID 087-99087-00, Project Worksheet (PW) #36045 (filed 5/10/19) — The County appealed FEMA's denial of reimbursement for an estimated $95,079 in damages sustained by the Stiglitz House as a result of Hurricane Irma with FDEM on 5/10/19. The County had previously received a $13,454 payment from FEMA for Hurricane Wilma damage. FEMA denied payment because the County allegedly did not "obtain and maintain" wind and flood coverage for the House, a requirement after the first FEMA payment. FEMA's deadline to render a 1st appeal decision is reset upon receipt of the County's response to the RFI; FEMA's new 90-day deadline to render a 1st appeal decision is 1/28/21. 1 Packet Pg. 2923 P.1.ai 3. Gregory B. Burkhardt v. Monroe County Planning & Environmental Resources Department, File No. 2019-229 (Planning Commission). Mr. Burkhardt applied for 400- amp electrical service with two (2) security lights for a commercial fishing business on vacant land located in the Commercial Fishing Special District (CFSD) on No Name Key. By letter dated 10/28/19, the Monroe County Building Official informed Appellant that (a) Building Permit #19102673 was issued in error because the permit was failed by the Planning & Environmental Resources Department and (b) the permit was revoked. On 11/26/19, Appellant filed an application for Administrative Appeal of the Revocation Letter pursuant to LDC Section 102-185. A Planning Commission hearing is tentatively scheduled for February 2021. N 4. Virginia Garcia, et. al. v. Monroe County Planning & Environmental Resources Department, File No. 2020-183 (Planning Commission). Appellants are appealing the Department's denial of a request for a Special Vacation Rental Permit for property located in the Bayside Condominium complex on Big Coppitt Key. The basis of denial is that there is insufficient parking and boat trailer spaces pursuant to LDC Section 134- 1(e)(2) and the proposed vacation rental does not comply with LDC Section 134-(e)(1). On 12/10/20, Appellants communicated they are withdrawing the appeal. E 0 5. Shadow Point v. Monroe County Planning & Environmental Resources Department, File No. 2020-061 (Planning Commission). Appellant is appealing the Department's denial of a Request for an Exemption to a Special Vacation Rental Permit for property located in Key Largo consisting of two detached units on a single parcel under single ownership �? in the County's Improved Subdivision (IS) Land Use (Zoning) District. The basis of denial is that the subject property under single ownership does not constitute a "gated community." A Planning Commission hearing is tentatively rescheduled for February 2021. 6. Quack Properties v. Monroe County Planning & Environmental Resources Department, File No. 2020-064 (Planning Commission). On 3/11/20, the Department issued a Letter of Development Rights Determination for the subject property on Big Pine Key that determined (a) no residential units have been lawfully established on the properties and no residential unit shall be considered exempt from the ROGO pursuant to LDC Section 138-22; (b) 3,845 square feet of nonresidential floor area was lawfully established on or about 9/19/01, and is exempt from NROGO pursuant to LDC Section 138-50 (this square footage is attributed to the structure located at 31095 Avenue A); and (c) 1,052.64 square feet of nonresidential floor area was lawfully established on or about 9/19/01, and is exempt from NROGO pursuant to LDC Section 138-50. Appellant is < appealing the residential dwelling unit determination under LDC Section 138-22. A Planning Commission hearing is tentatively rescheduled for February 2021. Cases of Interest at Trial Court Level 7. Diane Beruldsen &Aramis Ikatu v. Monroe County, Murray Marine, & Wreckers Cay, 20-AP-07-KW. On 8/28/20, this action sought to undo the BOCC's approvals of road abandonment applications regarding portions of rights-of-way on Laurel and MacDonald Avenues and an order requiring the removal of various structures. On 10/9/20, the Court granted Murray's motion to dismiss. On 11/16/20, the Court denied Plaintiffs' motion for rehearing. The case is now closed. 2 Packet Pg. 2924 P.1.ai 8. Monroe County v. Atlantic Trash / Magnolia 101, LLC, CA-P 13-945. This case began as the County's complaint for an injunction and foreclosure of a code compliance lien. The Court entered a judgment in favor of the County on 5/2/17. The Third District Court of Appeal affirmed the Trial Court's ruling in the County's favor. The case is now back before the Trial Court to determine the final amount of the fines. A hearing date of 5/20 was set by the Court but vacated due to the coronavirus pandemic. The County is attempting to reschedule the hearing. 9. Disaster Solutions, LLC v. Monroe County, CAK19-32. An action for breach of contract and other claims arising from a firm that had a purchase order to provide services which were capped at $49,999, but who submitted invoices in excess of $700,000. The Court granted the County's motion to dismiss on 4/4/19. Disaster Solutions filed a third amended complaint on 8/15/19. The parties are engaging in discovery. No trial date is currently set. c 10.Monroe County v. Estate of Jerome Pfahning 15CA214K. This is an action to declare the property to be a nuisance, and for an injunction to require abatement of the nuisance through demolition of structures, cleanup of the property and connection to the central wastewater system. The defendant's estate filed its answer on 2/25/2020. On 12/21/20, the County filed an amended complaint seeking foreclosure, money judgment and writ of execution. The defendant has until 1/21/21 to file a responsive pleading. A closed session is scheduled for 1/20/21. N 11.Sunset Gardens Estate Land Trust v. Monroe County, CAP 19-460. Property owner filed a two-count complaint alleging that various state laws including the Right to Farm Act, F.S. 823.14, preempt the County's land development regulations from applying to its parcel and seeking judicial declarations that its alleged agricultural activities are immune from the County's land development regulations. On 2/27/20, the Plaintiffs filed a second amended Complaint. The County filed a Motion to Dismiss on 3/19/20. Due to COVID19, court dates have been scarce. A hearing will be scheduled once an available date can be secured. 12.Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K (lower tribunal: CC-K-18- 112). Declaratory Judgment action filed by trailer park against County as part of its eviction suit against its tenant. On 10/4/18, the County countersued the trailer park and the park residents, seeking an injunction prohibiting occupancy at the park until serious fire and life safety issues have been addressed, and for appointment of a receiver. The trailer park amended their claim again on 7/31/20, arguing that the park residents are at fault and that the County is preempted by state law from enforcing against it. On 11/11/20, the County filed its motion to amend the counterclaim to add declaratory relief counts to determine whether the owner or tenants are responsible for the code violations. On 11/13/20, the Court heard the park tenants' motions to dismiss the park owner's Third Amended Complaint and County's counterclaim. The Court took the matters under advisement. 3 Packet Pg. 2925 P.1.ai 13.KITK, LLC v. Monroe County, CAP 19-351. Property owner filed a Complaint seeking a judicial declaration that F.S. 419.001(12) preempts Monroe County's land development regulations from prohibiting, on its allegedly residentially zoned property, its alleged community residential home of six or fewer residents. On 10/6/20, the County filed its answer. The Plaintiff served discovery requests on 10/22/20.Maschal et al. v. Monroe County and FKAA, CA K 19-186 — Following the Court's dismissal of the Delaney lawsuit, on 2/28/19 the same attorney filed a new lawsuit against Monroe County and FKAA on behalf of Banks Prevatt and 11 other individuals. The complaint seeks essentially the same relief as the Delaney lawsuit. The County and FKAA filed a joint motion to dismiss to the initial complaint, which was granted by the court in January 2020 on the grounds that the ordinance on which the complaint was based had been repealed and replaced by the BOCC in 2019. On 9/8/20, the Court granted the LN Defendants' motion as to Counts I and II (declaratory relief and mandamus) with prejudice, but gave the Plaintiffs' leave to amend as to Count III, equitable estoppel. On 1/4/21, Plaintiffs filed a Third Amended Complaint. The County's response is due on 1/24/21. 14.Monroe County v. Purdue Pharma L.P. et al., No. 4:19-cv-10049. This case was filed by Monroe County against opioid manufacturers/marketers and distributors on 4/3/19. The complaint seeks damages including punitive damages, attorneys' fees, costs, and injunctive relief. The case is part of multi-district litigation under a judge in Cleveland, Ohio. On 7/15/19, the County filed its initial statement describing damages. The case is at the early discovery stages. The parties are in settlement discussions with the distributor defendants. Three of the manufacturer defendants (Purdue Pharma, Insys and Mallinckrodt) have filed bankruptcy. The County has filed claims in the bankruptcy cases. Settlement discussions have not begun with the remaining manufacturer defendants. 15.Burke Construction Group, Inc. v. Monroe County, CA-M 19-80 - On 7/11/19, Burke Construction Group served a multi count complaint arising from the County's bid protest procedure and decisions to award contracts for the Marathon Library and Cudjoe Fire Station projects to other contractors. The County filed a motion to dismiss on 8/12/19 that needs to get scheduled for hearing. 16.Keith & Cheri Cohen v. Monroe County, 15-10167-CIV /USCA 17-15552-G — On 9/20/18, the Court ruled that the County's workforce housing requirement did not discriminate against the Cohens due to their asserted disabilities. The Court ordered the Cohens to sell their property to a qualified buyer and vacate the premises, and ordered the Cohens to reimburse the County's taxable costs of$1,963.55 plus interest. The County has given a deadline to the Cohens by which they must pay the costs. The judgments were recorded on 2/11/20. The County is proceeding to collect the debt. 4 Packet Pg. 2926 P.1.ai 17.Monroe County & State of Florida v. Donald Davis (Collins) — CA M 04-379. A final judgment in favor of Mr. Davis for a taking of his property in the amount of $347,475, which was affirmed on appeal on 10/2/19. The judgment was paid and a Satisfaction of Judgment was issued on 11/22/19. The County paid its portion of Mr. Davis' attorneys' fees and costs at the appellate level. The case is proceeding with discovery on the pending issue of attorneys' fees and costs at the trial level. On 7/13/20, the County filed a motion to compel discovery from the plaintiffs' attorney that was served in December 2019. On 8/26/20, the court granted the County's motion to compel discovery. On 9/18/20, the attorney served answers to the County's discovery. On 10/19/20, the County filed a motion for sanctions, for the Plaintiff's failure to comply with court-ordered discovery, which may be set for hearing depending on negotiations. On 10/21/20, the Court heard the Plaintiff's motion to dissolve former attorney's charging LN lien. . On 11/4/20, the court entered an Order that (a) deferred ruling on Davis' Motion to Release Charging Lien because liability for attorneys' fees has not yet been determined in an order by the court and (b) states that Tobin and Mattson's charging lien shall dissolve automatically without further court action on 3/1/21, unless liability for attorney's fees is determined by agreement or through an evidentiary hearing on or before 2/28/21. On 11/25/20, Tobin and Mattson filed a Petition for Writ of Certiorari in the Third District directed to that Order. The County's response to the Petition is due on 1/13/21. An evidentiary hearing on attorneys' fees is scheduled for 2/3/21. Plaintiff and the County and State have reached a tentative settlement agreement that will be discussed in a closed session at the January meeting and would moot the necessity of the certiorari proceeding and end this litigation. �- N 18.Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc. (Wi-Fi), Case numbers: 3D19-224 & CA K 17-631. The County sued both SVFD and Wi-Fi to declare a lease between SVFD and Wi-Fi invalid on the grounds that SVFD had not approved the lease in an open meeting. The trial court ruled in favor of the County and voided the lease. Wi-Fi appealed. On 6/17/20, the Third DCA affirmed. On 7/2/20, Wi-Fi filed a motion asking the Third DCA to issue a written opinion, a rehearing, or certification of the question, so it could appeal the decision to the Supreme Court. The Court declined, N and entered a mandate returning jurisdiction to the trial court on 8/16/2020. The County will be filing a motion for attorneys' fees as the prevailing party. Appellate Cases of Interest 19.AshBritt, Inc. v. Monroe County & FDOT Third DCA Case 3D20-553 (lower tribunal: 16t" Jud. Cir. 17-CA-802-K). AshBritt sued the County for breach of contract and for < breach of implied covenant of good faith and fair dealing. The County answered and moved for summary judgment (MSJ). On 2/24/20, Judge Koenig denied the County's MSJ. On 3/23/20, the County filed an appeal from that order in the Third DCA. The County filed its initial brief on 6/11/20. AshBritt filed a motion to dismiss the appeal on 6/22/20, which the Third DCA denied on 7/7/20. Ashbritt's answer brief was served on 9/25/20. The County filed a reply brief on 11/20/20. Awaiting notice of oral argument. 20.KRZ, LLC V. Monroe County, L.T. Case No. CE19060068. On 12/18/20, property owners filed a notice of appeal of the 11/19/20 Final Order of the Special Magistrate that found it in violation of land clearing standards in the Land Development Code. Awaiting filing of Appellant's initial brief. 5 Packet Pg. 2927 P.1.ai 21.Galleon Bay Corp. v. Monroe County and State of Florida — CA K 02-595/ 3D19-1783. This long running takings case resulted in a final judgment in the amount of $480,511. The County deposited $531,390.67 to satisfy that judgment plus interest in the registry of the Court and the Clerk issued a Satisfaction of Judgment. Galleon Bay's motion to invalidate the final judgment was denied by the Circuit Court on 8/16/19. On 9/13/19 Galleon Bay appealed that order to the Third DCA. On 10/18/19, Monroe County and the State moved to dismiss the appeal, which the Court agreed to carry with the case. On 12/2/20, the Third DCA issued an Opinion affirming the order of the trial court. The court also denied Galleon Bay's motion for attorneys' fees. On 12/24/20, Galleon Bay filed a "Motion for Rehearing Or In the Alternative To Certify Conflict." A response to that motion is due on 1/8/21. 22.KW Resort Utilities Corp. Rate Litigation (PSC Docket No. 20170141-SU)- appellate case number 1 D18-4212. In June 2017, KWRU sought approval of a second rate increase from the Public Service Commission (PSC) following a prior increase in March of 2017. After a public hearing, the PSC partially granted KWRU requested increase on 9/4/18. The County appealed the PSC's decision on 10/3/18. The appeal was consolidated with one filed by the Office of Public Counsel. Briefing is complete. The Court denied the County's request for oral argument. Awaiting a decision. 23.Atlantic Circle, LLC v. Monroe County Planning Commission, 2020-CA-48-P. On 3/11/20, Petitioner filed its Amended Petition seeking to quash Planning Commission Resolution No. P58-19 that approved with conditions the request by Randolph Wall for a variance of 5 feet from the required 25-foot primary front yard setback and a variance of 10 feet from the required 20-foot rear yard setback. On 3/20/2020, the Court entered its Order Directing Respondents to File Response. A response to the Petition was filed on 6/16/20. Petitioner's reply brief was filed on 8/7/20. Awaiting a decision. 24.Haim v. Monroe County et al., 4:20-cv-10058-KMM (S.D. Florida) (11t" Circuit Appeal 20-13271-AA). Two residents and a non-resident sued the County, Mayor Carruthers, EM Director Shannon Weiner, and the Sheriff over the emergency directives N establishing the US1 checkpoint. The County removed the case to Federal Court on 6/5/20, filed its response to the Plaintiff's Motion for Temporary Injunction on 6/8/20 and moved to dismiss the entire case on 6/8/20. Sheriff Ramsay filed a similar motion. On 8/17/20, the Court dismissed the case. Plaintiffs appealed to the 11tn Circuit on 8/28/20 and filed their brief on 12/1/20. The County's and the Sheriff's answer briefs are due 1/28/21. 25.Ricky Hill & Jayne Hill v. Monroe County, 20-AP-0004-P. On 9/22/20, property owners found in violation of the land clearing standards in the Land Development Code by the Special Magistrate filed this appeal to the Circuit Court. Awaiting filing of Appellants' initial brief. 26.Victorio Martinetti, et. al. v. Monroe County, 20-AP-1-M. On 9/25/20, property owners found in violation of the land clearing standards in the Land Development Code by the Special Magistrate filed this appeal to the Circuit Court. Awaiting filing of Appellants' initial brief. 6 Packet Pg. 2928 P.1.ai Vacation Rental Cases 27.Florentino Fernandez & Tania P Fernandez v. Monroe County, 20-AP-0005-P. On August 27, 2020, the Code Enforcement Special Master found Appellants in violation of the vacation rental ordinance (LDC Section 134-1(k)(1)) and imposed a $15,000 fine. Appellants filed their Notice of Appeal of the Final Order on 9/22/20. Awaiting filing of Appellant's initial brief. 28.Thurmond Street Partners, LLC v. Monroe County, Florida, 18AP10-K& 18AP11 K; Third DCA Case 3D19-2367. On 10/23/18, the Code Compliance Special Magistrate found that Thurmond Street Partners, LLC's (the "LLC") vacation wedding use of two bayside parcels it owns in Key Largo violated Section 130-94 of the Code. The property owner appealed to the Circuit Court. On 11/6/19, Circuit Judge Tim Koenig issued an opinion reversing the Special Magistrate's Final Administrative Order. On 12/6/19 the County filed a Petition for Writ of Certiorari to the Third DCA. The parties filed a Joint Notice of Filing Conditional Settlement Agreement and Request for Entry of Order Staying Case on 6/1/20, giving the property owner 90 days to apply for zoning changes. The County subsequently extended that deadline to 2/28/21. On 6/2/20, the Third DCA entered an order temporarily staying the case. On 12/15/20, the property owners and County staff held pre-application conferences. U 29.Sirena Key, LLC v. Monroe County, CAP 18-704. On 9/21/18, Sirena Key sued the County seeking to declare that the vacation rental ordinance is preempted by state law due to alleged changes in the County's enforcement practices. On 6/26/20, the Court granted the County's motion for summary judgment on Counts I and II. The County filed its motion for summary judgment on Count III on 9/24/20. On 11/5/20, Sirena Key filed a motion for leave to amend Count III, which was unopposed and granted. The County filed its answer to the amended complaint on 11/24/20. The parties are proceeding with discovery on the amended count. The County will amend the pending summary judgment motion and reset for hearing in 2021. Also pending in the Circuit Court is an appeal from the Special Magistrate's decision finding Sirena Key in violation of the vacation rental ordinance, Sirena Key, LLC v. Monroe County, 18-AP- 3-K. In this case, the Appellant Sirena Key filed a motion to stay the appeal pending resolution of the 16t" Judicial Circuit Case. Over objection from the County, the Court granted the motion and stayed the appeal until further order of the Court. There will be no movement on the appeal until the Circuit Court case is concluded. 30.Coral Hammock Rental v. Monroe County, CA K 17-588. Coral Hammock sued the County seeking to declare that our vacation rental ordinance is preempted by state law and that Coral Hammock is permitted to vacation rent. The County countersued seeking an injunction prohibiting vacation rental of the property. On 8/23/19, Coral Hammock amended their claim to add additional property owners, and additional claims. The parties agreed to a dismissal that allowed the violations to be heard by the Code Special Magistrate. On 10/29/20, the Special Magistrate heard 47 cases arising from Coral Hammock, found 45 properties in violation, and assessed fines of $224,329 in fines plus costs. Twenty-Six of the 45 property owners found in violation appealed the final order. A motion to consolidate the appeals filed by Appellants is pending. Packet Pg. 2929 P.1.ai Constitutional Officer Cases 31.Heather Carruthers v. Eddie Martinez, SOE Joyce Griffin, and MC Canvassing Board, 20CATBDK. On 11/23/20, former commissioner Carruthers filed an election contest suit challenging the results of the District 3 BOCC seat race. The County Attorney's Office filed an answer on behalf of the SOE and the Canvassing Board on 12/07/20. On 1/5/21, the Court denied Martinez's motion to dismiss. A final hearing date should be set shortly. 32.Monroe County Tax Collector v. Bennett, 20-CA-000176-P. On 2/21/20, the Tax Collector filed suit against taxpayers Nicholas Bennett, Dessiree Bennett, and a company owned by the Bennetts (Moonbay TH14, LLC) for injunctive and declaratory relief, to compel an audit of the taxpayers for potential non-payment of tourist development taxes on two vacation rental properties in the Upper Keys. Defendants refused to answer, citing their 5t" Amendment rights based on a pending criminal case against Nicholas Bennett, CIF 19-320-P. On 1/4/21, the Tax Collector dismissed the civil case. The State Attorney will resolve the issue in the criminal case. Other Matters of Interest 33.Code Collections. In November, staff collected a total of $293,123.26 in code fines U and costs. In December, staff collected a total of $393,249.19. Thus, to date in FY21, staff collected a total of $853,474.07 in code fines and costs. See attached spreadsheet. 34.Vacation Rental Prosecutions. No update, as no Code Compliance hearings were held in November or December.
