Resolution 042-2021 RESOLUTION NO. 042 - 2021 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AMENDING THE PERSONNEL POLICIES AND PROCEDURES MANUAL REGARDING CERTIFICATION INCENTIVES, BEREAVEMENT LEAVE, AND THE ABILITY OF EMPLOYEES TO USE PERSONAL LEAVES IN CONJUNCTION WITH WORKERS' COMPENSATION/FMLA. WHEREAS, County policy states that Certification Incentives may be earned only by employees who have achieved career service status and in a quantity of two per year, and the County recognizes that employees gaining skills and knowledge benefit the County at any point in the employee's career, and there is a need to increase the allowable number of certifications earned per year, the County now wishes to allow employees in their probationary period to earn certification incentives, and the County now wishes to increase the number of certifications earned per year from two to four; and, WHEREAS, the County Bereavement Policy states that employees are allowed two days of paid time off to grieve and attend funeral services of a family member, and the County now recognizes that in many occasions employees need more time to attend to these needs and that other similar employers offer more bereavement time, and the County also recognizes that temporary employees are similarly affected by the loss of family members, and the County now wishes to increase the number of bereavement days from two to four and make eligible temporary employees for bereavement leave; and, WHEREAS, County policy currently states that employees on workers' compensation leave designated as covered by the Family Medical Leave Act(FMLA)are not allowed to use annual leave, sick leave, or compensatory time in conjunction with the workers' compensation/FMLA, and the County recognizes that if employees are allowed to use personal leaves in conjunction with workers' compensation/FMLA, it will reduce employee leave balances and allow employees' pay to remain whole and intact, and the County wishes to delete language from its policy that prevents annual, sick, or compensatory leave from being used in conjunction with workers' compensation/FMLA; and, WHEREAS, the County now wishes to amend these three policies. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, THAT: 1. Monroe County Personnel Policies and Procedures Manual section 4.08 B. is now amended to read: "To be eligible for a certification incentive salary increase consideration, the affected employee must: a. currently be employed by the County in a career service status position, either with career service status or within the employee's new hire probationary period; i b. have received at least a "Meets Expectations" rating on their most recent performance evaluation, or must currently be performing at an acceptable level, and may not have been issued a written warning within the previous twelve (12) months; and c. not exceed four certifications per calendar year(renewal of a certification will continue certification incentive pay, but not net any additional increase in pay)." 2. Monroe County Personnel Policies and Procedures Manual section 7.05 is now amended to read: "All employees covered under this policy, including temporary employees, shall be granted up to four working days off with pay in order to attend a funeral of a member of the employee's immediate family..." 3. Monroe County Personnel Policies and Procedures Manual section 8.02 D (7) paragraph 2, which says: "If Worker's Compensation absence is designated as FMLA leave, the employee will not be allowed to use annual leave, sick leave and/or approved compensatory time to supplement leave, in accordance with Department of Labor rules", is now deleted. Deletion of this language means that employees will now be able to use annual leave, sick leave, or compensatory time in conjunction with absences designated as workers' compensation and FMLA.
