County Commission Meeting

Agenda Item Number: C.1
Agenda Item Summary #6653
BULK ITEM: Yes DEPARTMENT: Employee Services

AGENDA ITEM WORDING: Approval of a Resolution to amend three sections of the Personnel
Policies and Procedures Manual including: 1) Section 4.08 Certification Incentive Salary Increase,
allowing employees to obtain a Certification Incentive Allowance prior to achieving career service
status, and allowing up to 4 new certifications to be earned each year: 2) Section 7.05 Bereavement
Leave, adding 2 additional days to current policy of 2 days leave and including temporary
employees: 3) Section 8.02 D. (7) Workers Compensation Claims, deleting language that prevents
use of annual, sick, or compensatory leave in conjunction with workers' compensation - FMLA
absences.
ITEM BACKGROUND: Approval of three changes to the Personnel Policies and Procedures
Manual. The PPPM Committee met and agreed to recommend these changes to the BOCC.
First, Section 4.08 will now allow new employees, still in their probationary period, to receive
certification incentives. Monroe County recognizes that employees who improve their skills and
knowledge are more capable, productive, and offer greater overall value in their jobs. This is true
regardless of when in a person's career the increased skills and knowledge are gained. Expanding
existing policy to include probationary employees adds only incremental cost, as certification
incentives are not paid in total, but rather, are divided among the 26 pay periods per year. If a
probationary employee is not successful in achieving career service status, the County's financial
liability would not extend beyond the individual's final paycheck. This change also increases the
allowable number of new certifications earned per employee per year from two to four, which is
consistent with the BOCC decision made in December of 2019 when it granted a policy exemption
to this effect for Building Department staff.
Second, Section 7.05, Bereavement Policy will be revised to allow four days of paid time off to
grieve and attend funeral services of a family member. The County's current bereavement policy
only allows two days. Feedback and benchmarking show that two days is less than many employers
offer, including cities and other public sector employers in Monroe County. The change will also
apply the bereavement policy to temporary employees.

C.1
Third, a change in the Workers Compensation Claims policy, Section 8.02 D (7), would allow
employees who are unable to work due to a work-related injury or illness to be able to supplement
the 66 and 2/3 percent of Workers Compensation pay with their own accrued sick, vacation or
compensatory time to make them whole in terms of salary even if that absence is designated as
Family Medical Leave Act(FMLA) leave.
The current policy would not allow for employees to supplement their Workers Compensation
salary with accrued time if that time is designated as FMLA leave. This change of policy would
provide the employee the same benefit as already exists with Workers Compensation benefits not
designated as FMLA leave and is beneficial to the County by reducing leave balances and beneficial
to the employee by keeping their pay whole and intact.
To accomplish this change, the following sentence would be deleted from the Personnel Policies
and Procedures Manual "If the Workers Compensation absence is designated as FMLA leave, the
employee will not be allowed to use annual leave, sick leave and/or approved compensatory time to
supplement leave in accordance with Department of Labor rules".
