The recommended plan was developed under the 3-year Coastal Storm Risk Management Feasibility Study with the United States Army Corps of Engineers (USACE). The plan includes nonstructural and structural measures that will reduce the risk to the Florida Keys from coastal storms, including storm surge, sea level rise, evolving weather patterns, and other changing conditions which pose potential coastal storm risks. The 3-year study will be complete this September 2021, at which time a Chief of Engineer's Report will be signed by the USACE so that the recommended plan can be authorized into law by Congress. A letter of support is required from the non-federal sponsor to demonstrate a willingness to participate in the implementation of the recommended plan. This letter of support is not a contractual agreement. It demonstrates that the non-federal sponsor supports the plan and intends to participate in the implementation of the project as a cost sharing partner with the federal government. As the non-federal sponsor for this study, Monroe County is required to provide a letter of support and a financial self-certification in order for the recommended plan to be approved and transmitted to Congress for authorization. When the project has been authorized and Congress has appropriated funding for implementation, a Project Partnership Agreement (PPA) will be executed between the County and USACE. The PPA is the cost share agreement that defines the responsibilities of the non-federal sponsor and federal government for project implementation. Until a PPA is executed, the non-federal sponsor is not required to contribute funding for the implementation of the project. Packet Pg. 2580 P.3 On June 17, 2020 the USACE presented to the BOCC the results of its meetings with the municipalities and advised that the County's request for a waiver of the mandatory acquisition (through use of eminent domain) had been received and was under consideration. On October 21, 2020 the USACE presented an update. At the time, the USACE had not yet made a decision on the County's request for a waiver of the eminent domain for housing acquisitions. However, the USACE subsequently removed all acquisitions from the Plan after additional analysis led to the determination that it would not be a cost effective measure as compared to elevation. The features proposed under the Recommended Plan include structural measures and nonstructural measures. The structural measures include revetments that are recommended along U.S. Route 1 in six areas that have been identified as vulnerable to damage due to erosion and wave energy. The recommended nonstructural measures are designed to help reduce the risk and vulnerability to storm surge damage to residential, nonresidential/commercial, and critical infrastructure buildings throughout the Florida Keys. Detailed Information: 1. Structural Measures: reduce magnitude of water level and/or probability of flooding and storm impacts in an area to reduce damage to structures in that area of reduced risk. Packet Pg. 2581 P.3 Structural Measures include the Shoreline Stabilization along US 1: six rock revetments designed to reduce damage, especially erosion/washout, to the roadway. 2. Nonstructural Measures: reduce damage to a specific structure and/or its contents, focus is on reducing the consequences of flooding on that structure instead of reducing the amount or probability of flooding. Nonstructural measures include elevation of residences and floodproofing of businesses and critical infrastructure. FEASIBILITY REPORT: The Feasibility Study findings will be documented in a final Feasibility Report to include National Environmental Policy Act (NEPA) documentation in an EIS which is integrated with the Feasibility Report. The Recommended Plan will be documented in the Final Feasibility Report will be used to inform the Chief of Engineer's Report, which will serve as the basis for the authorization of the Recommended Plan by Congress. If the Recommended Plan is authorized and funds are appropriated in the future, the federal government would finance 65% of the total project cost. The County and the municipalities would be responsible for 35%, which could also come from other local or State funds. The recommended plan includes measures located in each of the municipalities, and Interlocal Agreements will be needed to formalize their participation should the County and municipalities choose to participate in the project.
