AGENDA ITEM WORDING: Approval of a Lease for Unit B-2 at the Big Pine Key Shopping
Center for use as the District 2 Commissioner's office and authorization for Mayor to execute the
required Lease, after review by the County Attorney's Office and Approval to terminate the current
Lease on the District 2 Commissioner's office now located on Ship's Way, Big Pine Key and
authorizing the Mayor to execute the termination notice.
ITEM BACKGROUND: Space is now available in the Big Pine Key Shopping Center next to the
Tax Collector's office. The Big Pine Key Branch Library is located in the same building as the Tax
Collector. Leasing space in the shopping center for the Commissioner's office will make the office
more visible and accessible for constituents. The new space will require completion of some minor
renovations prior to opening the new office on or about May 1, 2021. County staff is currently
finalizing some details of the new Lease with the Landlord, UH US Big Pine Key 2019 LLC. Staff
requests approval of this item authorizing the lease of a new location for the District 2
Commissioner's office and authorizing the Mayor to execute the new Lease once it has been
finalized and approved by the County Attorney's office. Approval of the Lease at the February
BOCC meeting will allow sufficient time to complete the renovations in a timely manner.
Approval is also sought to terminate the existing Lease currently in place for the District 2
Commissioner's office located on Ship's Way in Big Pine Key. Monroe County will need to
provide the current Landlord (Ships Way, Inc., Judy A. Shephard, President) with ninety (90) days'
notice of termination pursuant to the lease terms and this approval seeks authorization for the Mayor
to execute the termination notice to be provided by the County Attorney's office.
PREVIOUS RELEVANT BOCC ACTION:
The Big Pine Key Shopping Center Lease is a new Lease, so no prior BOCC action.
Ship's Way Lease has been used as office space for a District 2 Commissioner's Office since 1998.
On March 15, 2015, a Termination for Convenience clause was approved. Lessee may terminate this
Agreement upon 90 days' written notice. No rental shall accrue and neither party shall have any
further obligations under the terms of the lease after the effective termination date of the notice.
