Although the site is currently vacant, its historic land use has been commercial fishing. As

packaging of seafood for commercial purposes, including the mooring and docking of boats
and/or the storage of traps and other fishing equipment and charter boat uses and sport diving
uses. Pursuant to MCC 9.5-248(a), commercial fishing is an as -of -right permitted use in the

Findings:
Because the fish house existed prior to demolition of sheds / icehouse, Monroe County
recognized existing operation.
Commercial fishing does not require any approval or mandatory structures according to Monroe
County code.
Throughout the County there exists numerous locations of Commercial fishing operations,
including Big Pine Key, without a building or structures.

Pursuant to §9.5-43 of the Monroe County Code (MCC), this document shall constitute a Letter
of Understanding (LOU). On July 8, 2008, a Pre -Application Conference regarding the above -
referenced property was held at the office of the Monroe County Planning & Environmental
Resources Department in Marathon.
Attendees of the meeting included Andrew M. Tobin, P.A. (hereafter referred to as "the
Applicant") and Andrew O. Trivette, Director of Growth Management; Townsley Schwab,
Acting Senior Director of Planning & Environmental Resources; Joseph Haberman, Principal
Planner; Mitchell Harvey, Comprehensive Planning Manager; Steven Biel, Senior Planner; Rich
Jones, Senior Administrator of Marine Resources & Ralph Gouldy, Senior Administrator of
Environmental Resources (hereafter referred to as "Staff').
I. APPLICANT PROPOSAL
1. The Applicant is requesting clarification from the Growth Management Division
regarding whether or not the County is able to permit or otherwise allow the following on
the subject property at this time: 1) dockage for pleasure and charter boats, 2) g4s pumps
and 3) additional dolphin piles for mooring.

IL SUBJECT PROPERTY DESCRIPTION
1. The subject property is located at 6001 Peninsular Avenue on Stock Island, at
approximate mile marker 5 on the Atlantic Ocean side of US Highway 1.
2. The subject property consists of twelve (12) contiguous parcels, legally described as
Block 45, Lots 42-46 and 52-57, Maloney subdivision, Stock Island (PB1-55) and lot east
of and adjacent to Lots 42-46 & 57. The parcels are identified as real estate (RE)
numbers 00123680.000000, 00125900.000000, 00125910.000000, 00125920.000000,
00125930.000000, 00125940.000000, 00126000.000000, 00126010.000000,
00126020.000000, 00126030.000000, 00126040.000000 and 00126050.000000.
3. According to the Monroe County Property Appraiser's records, all 12 parcels are
currently owned by WSG Sand Lake LP.
4. The site is commonly known as `Gulf Seafood' and is specifically referred to as a general
location of existing trap/gear storage and fishing work area in the Stock Island and Key
Haven Livable CommuniKeys Plan.
III. RELEVANT PRIOR COUNTY ACTIONS
1. On September 28, 2006, a pre -application conference was held to discuss a proposed
redevelopment plan for the existing waterfront facility and if and how the project could
remain in compliance with the Monroe County Code, the Year 2010 Comprehensive Plan

and other regulations. Based on the dialogue of the conference, a Letter of Understanding
(LOU) from the Director of Planning & Environmental Resources was sent to the
applicant on January 8, 2007.
W. REVIEW OF DEVELOPMENT PROPOSAL
The subject property has a Land Use District designation of Mixed Use (MU); a Future Land
Use Map (FLUM) designation of Mixed Use / Commercial (MC); and a tier designation of
Tier 3.
1. The first item in which the Applicant requested clarification concerned whether or not the
County would allow existing dockage and wet slips to be utilized by pleasure and charter
boats.
Currently, the site is not being utilized for any use. However, as set forth in LOU dated
January 8, 2007, the Planning & Environmental Resources Department determined that
the property was last being used as working waterfront and commercial fishing. The site
is specifically referred to as a general location of existing trap/gear storage and fishing
work area in the Stock Island and Key Haven Livable CommuniKeys Plan. The site is
also referred to as a location of commercial fishing and related land use in 1985 and 2004.
Although the site is currently vacant, its historic land use has been commercial fishing.
As defined in MCC §9.5-4 (C-12), commercial fishing means the catching, landing,
processing or packaging of seafood for commercial purposes, including the mooring and
docking of boats and/or the storage of traps and other fishing equipment and charter boat
uses and sport diving uses. Pursuant to MCC §9.5-248(a), commercial fishing is an as -
of -right permitted use in the MU District.
Therefore, the existing dockage and wet slips may be used for vessels consistent with the
commercial fishing use, which includes charter boats as well as vessels providing
commercial fishing and sport diving services. However, in general, pleasure boats are not
related to commercial fishing and may not utilize the existing dockage and wet slips
unless a) a marina use is approved for the site under a major conditional use permit or b)
the Applicant submits documentation to Staff proving that the site was being utilized as a
marina in September 1986 (the date in which the current land development regulations
were adopted) and is thereby deemed to have a major conditional use permit in
accordance with MCC §9.5-2(c).
The second item in which the Applicant requested clarification concerned whether or not
the County would permit the installation of gas pumps or marine fuel dispensers (for
exclusive use by boats and other marine vessels, not land -based vehicles such as
automobiles).
As previously stated, commercial fishing is an as -of -right permitted use. In addition,
accessory uses are as -of -right permitted uses in the MU District. Therefore, accessory

structures/uses, such as gas pumps, may be permitted on the subject property. However,
in order to be permitted as -of -right, the gas pumps must serve as an accessory use to the
commercial fishing use and consequently may only be used by vessels consistent with the
definition of commercial fishing, such as vessels providing commercial fishing, charter
and sport diving services. Furthermore, the Applicant must receive a building permit(s)
for the installation of the fuel dispensers and tanks and must secure all necessary
approvals/permits required for such development.
At the conference, the issue of whether or not the County would permit the installation of
pump -out facilities was also addressed. Pump -out facilities may also be permitted on the
subject property as accessory uses/structures. However, as with the gas pumps, in order
to be permitted as -of -right, the pump -out facilities must serve as an accessory use to the
commercial fishing use and consequently may only be used by vessels consistent with the
definition of commercial fishing. Furthermore, the Applicant must receive a building
permit(s) for the installation of the pump -out facilities and must secure all necessary
approvals/permits required for such development.
Vessels that are not related to commercial fishing may not utilize the fuel dispensers or
pump -out facilities unless a) a marina use is approved for the site under a major
conditional use permit or b) the Applicant submits documentation to Staff proving that
the site was being utilized as a marina in September 1986 and is thereby deemed to have a
major conditional use permit in accordance with MCC §9.5-2(c).
3. The third item in which the Applicant requested clarification concerned whether or not
the County would permit the installation of additional dolphin piles for mooring.
Commercial fishing is an as -of -right permitted use. Therefore, the County would permit
additional wet slips on the property (which includes submerged bay bottom) for
commercial fishing -related vessels if the required approvals and permits are obtained by
from United States Army Corps of Engineers and Florida Department of Environmental
Protection and the required off-street parking regulations for both the existing
development and expansion are met.
Pursuant to MCC §9.5-352, the wet slips are subject to the following off-street parking
requirements:
Marinas and commercial fishing facilities
1 space per berth & 1 space per 4 dry storage
racks
Chaser/guide boats, 6 or fewer passengers capacity
2 spaces per berth
Party and charter/guide boats, more than 6
passengers capaci
0.3 space per passenger capacity of vessel
Vessels that are not related to commercial fishing may not utilize the additional wet slips
unless a marina use is approved for the site under a major conditional use permit. If the

Applicant submits sufficient documentation to Staff proving that the site was being
utilized as a marina in September 1986 and is thereby deemed to have a major conditional
use permit in accordance with MCC §9.5-2(c), an amendment to the major conditional
use permit shall be required for the additional wet slips.
Pursuant to MCC §9.5-43, you are entitled to rely upon the representations set forth in this letter
as accurate under the regulations currently in effect. This letter does not provide any vesting to
the existing regulations. If the Monroe County Code or Year 2010 Comprehensive Plan are
amended, the project will be required to be consistent with all goals, objectives and standards at
the time of development approval. The Planning & Environmental Resources Department
acknowledges that all items required as a part of the application for development approval may
not have been addressed in this letter, and consequently reserves the right for additional
comment. The information provided in this letter may be relied upon, with the previous
disclaimers, for a period of three (3) years. The Director of Planning, upon the request of the
property owner, may review and reaffirm the representations set forth in this letter for an
additional period of time.
You may appeal decisions made in this letter. If you choose to do so, please contact the PIanning
Commission Coordinator at (305)289-2500 for the necessary forms and information. The appeal
must be fled with the County Administrator, 1100 Simonton Street, Gato Building, Key West,
FL 33040, within thirty (30) days from the date of this letter. In addition, please submit a copy of
your application to Planning Commission Coordinator, Monroe County Planning &
Environmental Resources Department, 2798 Overseas Highway, Suite 410, Marathon, FL 33050.

Engineering's only contacts with the property were:
1. On 3-4 June 2010 Engineering reviewed the storm water plans as part of a building permit application (#101-
002883) by WSG Development (WSG) with approval issued on 4 June 2010.
2. On 17 AUG 2010, Engineering received, reviewed, and approved the surface water part of the building permit
for an after the fact application (#101-04842) to add a 400 sq. ft. slab to the site plan.
3. In early 2011(February) Engineering was asked by Commissioner Wigington to contact the property owners
(WSG Development) about what they had to do to connect to the sewer utility (KWRU) on Stock Island. After
consultations with KWRU and WSG Development, Engineering ascertained that the parcels comprising the WSG
project had been included in the planned service area for which the County had contracted capacity from KWRU
and that some of that capacity (one parcel) had been reserved (by C&A response) by the previous property
owners. There were two other parcels with documented sewer needs — one had been included in the C&A
mailings (opt in program) and for which no response was received. The other parcel had not been included in
the opt -in (optional C&A reservation) program. There was no documentation about why it wasn't included but
the record of a water meter usage is clearly contained in the URS reports of the system review. The BOCC
approved allowing County staff to continue to accept C&A responses and WSG subsequently executed and
submitted C&A agreements for those two parcels with the required down payments and agreements for the
remainder to be assessed on their tax bills. WSG also submitted payment in full (to the County in accordance
with the County-KWRU agreements) for the additional sewer capacity required (as determined by
KWRU). KWRU then connected the property to the central sewer system. Nothing was done in this process that
wouldn't be done for any resident or business. In fact, the above actions were initiated long after the alleged
start of the fish house operations about which the inquiries from the public were received.
Kevin's thoughts:
Separate from the above, I (Kevin Wilson) do not know what permit approvals might be required for the operation of
a fish house on that property. As I read the public's inquiries, the business (WSG's lessee) was operating from
summer 2010 onwards. From my (Kevin Wilson's) perspective, the owner (WSG) applied for building permits in early
summer 2010. Growth Management will have to address the issue of when were the building permits actually
issued. There was discussion about the final certificate of occupancy at the same time we were resolving the sewer
connection issues in February, it's not clear to me (Kevin Wilson) whether issuance of the building permit or
certificate of occupancy is the real issue. It appears that the underlying question in the inquiry is how could the
lessee's operation have started without havi _access to the building or a sewer connection from the building. It
appears to me that the important operative question is, "Is there any County permit or license requirement for such a
business to operate that was ignored?" As best 1 can tell from the early exchanges, the issue was that, prior to
receiving a full approval for the occupancy of the building, the lessee of the property started operating his/her
business on the property but in 0 to fFa adi(tent), From a wastewater perspective, any permit for such an
operation using any pre-existing on -site system would have been a DOH or FDEP (depending on the on -site system
if and its size). I do not know Growth Manag ment has a role in permitting / licensing businesses or enforcing them.

Question is did this property have existing sewage treatment prior to applying for the fish house?
I checked the computer. This parcel never paid for a sewer tie in. I would assume if there was an existing business prior
the new fish house the property was using a DOH or DEP operated sewage treatment.
I read Kevin's memo but I am not sure from reading it either. He talks about multiple parcels so maybe the parcels were
split at some point but shared the sewage treatment?

I am in the process of developing an agenda item for Joe Paskalik to give to Christine for the June BOCC meeting.
I have all the pieces except Christine's last paragraph was to "coordinate with Kevin Wilson on sewer issues to include in
the report".
Holly and I have coordinated a plan to cover the "impact" fee for sewer connections on new projects.
Before we issue a C.O. we call Monroe County Solid Waste Management to see if we need to collect a prorated waste
management bill.
We are now doing the same with sewers. We are calling Holly to see if there is an impact fee that needs to be paid prior
to the C.O.
I don't know if this is enough or if we should collect the fee prior to issuance of the permit? That is a second option.
We used to send all new construction to FKAA before accepting an application. FKAA told us they no longer need to see
the plans prior to permitting. I don't know that is true with the other sewer companies in the county. We have the Key
Largo sewer district, FKAA, Key West Resort Utilities, Key Haven and then some mobile home parks with their own

Engineering's only contacts with the property were:
1. On 3-4 June 2010 Engineering reviewed the storm water plans as part of a building permit application (#101-
002883) by WSG Development (WSG) with approval issued on 4June 2010.
2. On 17 AUG 2010, Engineering received, reviewed, and approved the surface water part of the building permit
for an after the fact application (#101-04842) to add a 400 sq. ft. slab to the site plan.
3. In early 2011(February) Engineering was asked by Commissioner Wigington to contact the property owners
(WSG Development) about what they had to do to connect to the sewer utility (KWRU) on Stock Island. After
consultations with KWRU and WSG Development, Engineering ascertained that the parcels comprising the WSG
project had been included in the planned service area for which the County had contracted capacity from KWRU
and that some of that capacity (one parcel) had been reserved (by C&A response) by the previous property
owners. There were two other parcels with documented sewer needs — one had been included in the C&A
mailings (opt in program) and for which no response was received. The other parcel had not been included in
the opt -in (optional C&A reservation) program. There was no documentation about why it wasn't included but
the record of a water meter usage is clearly contained in the URS reports of the system review. The BOCC
approved allowing County staff to continue to accept C&A responses and WSG subsequently executed and
submitted C&A agreements for those two parcels with the required down payments and agreements for the
remainder to be assessed on their tax bills. WSG also submitted payment in full (to the County in accordance
with the County-KWRU agreements) for the additional sewer capacity required (as determined by KWRU).
KWRU then connected the property to the central sewer system. Nothing was done in this process that
wouldn't be done for any resident or business. In fact, the above actions were initiated long after the alleged
start of the fish house operations about which the inquiries from the public were received.
Kevin's thoughts:
Separate from the above, I (Kevin Wilson) do not know what permit approvals might be required for the operation of
a fish house on that property. As I read the public's inquiries, the business (WSG's lessee) was operating from
summer 2010 onwards. From my (Kevin Wilson's) perspective, the owner (WSG) applied for building permits in early
summer 2010. Growth Management will have to address the issue of when were the building permits actually
issued. There was discussion about the final certificate of occupancy at the same time we were resolving the sewer
connection issues in February, it's not clear to me (Kevin Wilson) whether issuance of the building permit or
certificate of occupancy is the real issue. It appears that the underlying question in the inquiry is how could the
lessee's operation have started without having access to the building or a sewer connection from the building. It
appears to me that the important operative question is, "Is there any County permit or license requirement for such a
business to operate that was ignored?" As best I can tell from the early exchanges, the issue was that, prior to
receiving a full approval for the occupancy of the building, the lessee of the property started operating his/her
business on the property but in a temporaryfacility (tent). From a wastewater perspective, any permit for such an
operation using any pre-existing on -site system would have been a DOH or FDEP (depending on the on -site system
and its size). I do not know if Growth Management has a role in permitting / licensing businesses or enforcing them.

I have all the pieces except Christine's last paragraph was to "coordinate with Kevin Wilson on sewer issues to include in

Holly and I have coordinated a plan to cover the "impact" fee for sewer connections on new projects.
This is 4 Food interim step which will have to work until we get a formal process in place by resolution (probably in
June). The meeting we've set up for next Monday (9 May) is aimed at the Growth Management piece of this process
(Community Plus). The resolution we've drafted for Commission adoption proposes that the wastewater capacity fee
(what you refer to as the "impact" fee) be collected for all permits issued after its adoption at the time of permit
issuance. The amount of the fee will be specified in the resolution and how to determine which properties must pay it
will, hopefully, be embedded in your Community Plus system.
Before we issue a C.O. we call Monroe County Solid Waste Management to see if we need to collect a prorated waste
management bill.
We are now doing the same with sewers. We are calling Holly to see if there is an impact fee that needs to be paid prior
to the C.O.

We used to send all new construction to FKAA before accepting an application. FKAA told us they no longer need to see
the plans prior to permitting. I don't know that is true with the other sewer companies in the county. We have the Key
Largo sewer district, FKAA, Key West Resort Utilities, Key Haven and then some mobile home parks with their own
plants. Our proposed process will have FKAA (or the appropriate sewer authority -- KWRU for Stock Island, for example)
determining what the EDU assignment is for the proposed development/modification this agreement to do so is not
yet finalized. When we meet next week, we can collectively think through the details of this issue and how to
implement.
The easiest way, of course, is to either have a request from all or from none. Agreed

LETTER OF UNDERSTANDING DATED 7/11/2008 "COMMERCIAL FISHING IS AN AS -OF -RIGHT PERMITTED
USE ON THIS PROPERTY.
PERMITS WERE PULLED FOR DEMO, SITE WORK/ MOORING PILES, FISH HOUSE, TEMP POWER, ATF
SLAB/ TEMPORARY CONSTRUCTION TRAILER AND WALK-IN COOLER/ICE MACHINE.
ASIDE FROM COMMENTS LISTED IN THE "LETTER OF UNDERSTANDING""CARLOS SEAFOOD" WAS NOT
GRANTED PERMISSION TO OPEN A BUSINESS. EVERY PERMIT ISSUED WAS VERY SPECIFIC TO THE
CONSTRUCTION AND NOT TO ALLOWING AN EXPANSION OF THE "COMMERCIAL FISHING AS -OF RIGHT"
CONVEYED IN THE LETTER OF UNDERSTANDING.
ONCE THE DEMO WAS COMPLETE THERE WAS NO NEED TO CONNECTTO WASTE WATER AS THERE WAS
NOTHING TO CONNECT. THE WASTE WATER WAS COORDINATED AND APPROVED PRIOR TO THE
"TEMPORARY CERTIFICATE OF OCCUPANCY" ISSUED ON MARCH 14, 2011 AND EXPIRES ON MAY 15,
2011(60 DAYS).
THE 60 DAY TEMPORY CERTIFICATE OF OCCUPANCY WAS GRANTED BECAUSE THE BUILDING WAS
BASICALLY COMPLETE, THE UTILITIES HAD BEEN CLEARED AND CONNECTED BUT A PROBLEM REMAINED
WITH A "SETBACK" ISSUE FOR A STAND AT THE ELECTRIC PANEL THERE WAS A QUESTION WHETHER
TO ASK FOR A VARIANCE, MOVE THE PANEL OR FIGURE A WAY TO GET TO THE PANEL WITHOUT A
PERMANENT STRUCTURE OR LADDER. THE DECISION WAS MADE TO HAVE AN ENGINEERED "FOLD
DOWN" PLATFORM CONSTRUCTED AND INSTALLED TO THE BUILDING. IT COULD BE UTILIZED WHEN
NECESSARY AND OTHERWISE BE FOLDED OUT OF THE SETBACK. SIXTY (60) DAYS WAS ALLOCATED FOR
THE DECISSION MAKING AND THE END RESULT OF SECURING A PERMANENT CERTIFICATE OF
OCCUPANCY.

I have just received copies of the 2 new C&A agreements and the three checks that accompany for the new
C&A agreements and the $11,340 check that paid for the 4.2 ERC's @ $2700 per. This covers you for 17
ERCs and you previously had paid for 4 ERC's. This gives you your 21 ERC's for the project as
permitted by FDEP. The Utility has in our records your 21 ERCs and the payments for every one of them.
Regarding your Connection
Gary's Plumbing did not have the proper pump to get the pipes cleared therefore, the Utility's field
technician used a 1" gas pump to pump the system down and was able to complete some of the camera
inspection work this afternoon. Provided no major problems are discovered tomorrow morning during the
course of the remaining camera work, the uroyerty will be on-line before lunch time. I will make sure I get
Joe Paskalik the information he needs and will notify him when connection is made.
I will send you a pdf of the contract that you signed, that was notarized by Denise P. Soriano on August 6,
2010. This is to be the official contract with regard to this property and the 21 connections.

The utility field technician was on site at 8:30AM to complete the camera inspection work. Unfortunately the
inspection was not satisfactory, rock and debris was found in the sewer lateral. Upon discovery of this Gary's
Plumbing was immediately notified. Gary's quickly dispatched a plumber and jet rodder to the property. It
looks as if the line will be cleaned with the high pressure jet rodder and ready for final camera inspection on the
other side of lunch. Assuming the line is fully cleared of all rock, construction debris, etc and passes camera
inspection there is no reason the valve can't be installed and the system put on line this afternoon. Usually jet
rodders do a nice job getting all the debris out of the system. I will keep you apprised as things develop.

Gary's Plumbing continued working until 5:40 this afternoon and the utility verified the system is now free of
rock and construction debris. This was the final inspection that is required prior to valve installation. The

Thanks for your timely response. I agree with your assessment of
fairness regarding hook up fees, but that is not the part of the
newspaper article that prompted my email.
Considering the fact that the BOCC has already actively attempted
to obtain this property for the benefit of the same people now using

they had been allowed to operate for an entire lobster season with
no sewer hookup. It has been many years since I served on the MC
Zoning Board (now planning commission), but back then, a new

owner to pay the wastewater EDU capacity reservation charge ($2,700 x
21 or 65) in a manner that each of us on Stock Island was allowed to

The county has already purchased the capacity and needs to collect

and equal treatment, not special treatment."

As a lifelong resident of Key West, and owner of Stock Island
Lobster Co. — the oldest fish house in the Florida Keys — I would
like to make a few observations regarding the Carlos Seafood
property. Let us agree from the beginning that Carlos Seafood is a
direct competitor for us, but we have survived dozens of
formidable competitors in the past 58 years, and have no fear of
competition as long as the playing field is level.
1) Monroe County has a history of being misled by working
waterfront interests. Commercial fishing in particular is a very
specialized industry, and few outsiders have any idea of the
complex consequences of excessive government regulation.
Sympathy for our legitimate industry problems is commendable
and welcome, but politicians in particular are frequently cajoled
with emotional rather than factual argument.
2) There will not be one fisherman without a dock space, nor one
pound less production if Carlos Seafood closes. The opening of
Carlos Seafood was not an expansion of our local fishery, but
simply a shuffling of boats. Every fisherman at Carlos Seafood
came from the two existing fish houses, both of whom had empty
dock spaces and needed more fishermen.
3) Key West cannot support 3 fish houses. Gulf Seafood closed
because there were not enough fishermen or production to support
three fish houses. Carlos Seafood may now be finding out what
Fishbusterz has already learned; the highly restricted fishery of
today cannot support a 15 million dollar piece of property. It is
inevitable that if the free market rules, at least one of the existing
fish houses will be forced to close. The continued existence of fish
houses is out of the hands of County commissioners, unless they
are willing to permanently subsidize them.
4) Beware of the `poor fisherman' syndrome. Our fishing industry
legitimately needs support from elected officials. While even the
sympathy card is fair play in the business world, publicly elected
officials should especially be aware of when it is being played. The
fishermen involved are not there because they had no other place,
but simply to serve their own self interest. Carlos Seafood is a
large seafood processor who ships worldwide, and is here, not
because of their love of the fishing industry, but to make money.
WSG is not a philanthropic, non- profit organization, but part of a
giant, nationwide development corporation, with the name Trump
thrown in along the way. One cannot blame them for wanting to
by-pass the often ridiculous development rules that all of us must
comply with, but it is certainly not because they weren't aware of
them, or couldn't afford to comply.
5) How were they allowed to start operation without complying
with all the rules the rest of us must follow. Carlos Seafood started
operating in Key West in August. With all that has now become
public, one can legitimately wonder what role Monroe County has
played in this apparently unlicensed operation. Operating a fish
house is a nightmare of inspections and regulatory compliance, yet
when the FDA recently spent 2 days inspecting my operation, they
didn't even know of the existence of Carlos Seafood. How is this
possible? Did Monroe County know?
6) Why should one particular business receive preferential
treatment from government authorities? Neither the county, the
state, nor the federal government, has ever cut me one ounce of
slack with regulatory requirements or permitting. Indeed, I am five
years and $50,000 into obtaining simple permits to build docks,
some of which were destroyed in Hurricane Wilma. Carlos
Seafood has been allowed to operate for an entire lobster season,
and take critically needed production from the other fish houses,
without complying with the rules. Why was this allowed? Who
allowed it?
It was common knowledge that Monroe County red tagged the
project, and issued some after the fact permits. As I understand it,
the original permit was for a warehouse, and then got changed to a
fish house after construction had begun. Seems like a pretty
substantial change for an after the fact deal. Is it true? Who
authorized it if it is? I had assumed that with code enforcement on
the job all the laws would be enforced, but its beginning to look as
if there are different rules for different people.
A cursory background check will show that Carlos Seafood is not a
newcomer to the fisheries and they should be highly

I read in the newspaper, but it is appearing as if Monroe County, or
someone in Monroe County, is responsible. Can the County please
provide me with an explanation?
