The grant is partitioned into three segments. The third segment of construction at MMC has several components, all of which are predicated upon each other in order. First we will install the necessary in -ground sewer components. We have received the permit for the sewer installation. The next step is to pave the driveway with a curb cut for the street. Landscaping would be the last step, which would occur in short order. The Department of Transportation has acquired the services of a private company for permit review for our curb cut. This revised review process has pushed back the schedule. While the curb cut is not within the scope of the grant, it's completion predicates a C.O. for the project. The TDC granted MMC and extension based on the unexpected wait time in regard to Key Largo Wastewater Treatment District and the subsequent ability for sewer tie in procedures. MMC currently has the necessary in -ground plumbing installed from the top of the property (US-1) to the existing building. We received confirmation from KLWTD two months ago that they were ready for us to connect. We have had live marine mammals at the MMC site since the mass stranding of pilot whales on May 5, 2011. We have just received notice from NMFS that the last remaining animal has been deemed non -releasable and will be transferred to Sea World within 30 days. According to veterinary protocols we are unable to perform any excavation with an immunocompromised marine mammal on premises due to the risk of potentially fatal Aspergillosis. The recent approval for sewer tie-in requiring the installation of the lift station, macerator, and assorted fixtures would necessitate excavation at the lower portion of the property with the marine mammal present. The timing of these two events is unfortunate to say the least, in regard to our upcoming TDC deadline in September 2011. With all the necessary permits and approvals in hand, MMC intends to commence with the completion of the project immediately upon the transfer of the marine mammal to Sea World. We do not believe we could fulfill the timeline commitment with the TDC, as the final construction steps are sequential as mentioned above. MMC would like to acknowledge the gracious actions and support of the TDC towards the MMC capital improvement project thus far and are hopeful of that very level of understanding and compassion for this marine mammal hospital. MMC is currently the only marine mammal hospital open for long term stranding rehabilitation events in North America. We intend to complete all work as permitted within the adjusted timeframe requested. Sincerely, Art Cooper Chairman, MMC MFMMENT THIS AMENDMENT to agreement dated theday of 1 is entered into by and between the Board of County Commissioners for Monroe County, on behalf of the Tourist Development Council, and the Moir* Mammrd Conservancy, Inc. a not for profit organization organized and operating under the taws of the state of Florida (Grantee). NOW, THEREFORE, in consideration of the mutual covenants contained herein the parties agree to the amended agreement as follows: 1.
