Item H01BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: October 19, 2011 Division: Growth Management Bulk Item: Yes x No _ Department: Growth Management Staff Contact Person/Phone #: Christine Hurley (305) 289-2517 AGENDA ITEM WORDING: Approval of a resolution amending the boundaries of the five (5) County Commission Districts as required by Article VIH, Section 1.(e) of the Florida Constitution according to Florida Statutes Chapter 124. ITEM BACKGROUND: Every 10 years, as a result of the decennial census, governments are to consider changing County Commission district boundaries (Florida Constitution Article VIII, Section 1.(e)). The districts shall be of contiguous territory as nearly equal as practicable. The legal process is governed by Chapter 124 of the Florida Statutes. In addition, the changes to the district boundaries are to be made in odd -numbered years. Further, Section 2 of the Voting Rights Acts of 1965, as amended and interpreted through case law indicates each local government shall preserve, as much as possible, concentrations of minority voters, in order to not dilute minority voting strength. Staff has further made an effort to: Follow major natural and man-made boundaries and maintain whole islands and communities (especially those with organized Homeowner/Condo associations) within each district as much as is practical in the attached redistricting recommendation. New district boundaries are required to be described in narrative form and shall be placed in a resolution adopted by the Board of County Commissioners. The description of the boundaries of the districts as changed is entered into the minutes of the Board and a certified copy of the minutes shall be published once a week for two consecutive weeks. Following publication of the new boundaries, the proof of publication shall be entered into the minutes of the Board. The County Clerk shall furnish the Department of State with a certified copy of its minutes reflecting the description of the boundaries. WHEREAS, it is necessary and required by law to change the present boundaries of County Commissioners' Districts in Monroe County, Florida, pursuant to the requirements of Article VIII, Section 1.(e), of the Constitution of the State of Florida and Florida Statutes Chapter 124; NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS, that the County Commissioners' Districts in Monroe County Florida shall be established as follows and shown graphically as Exhibit "A" and shall be designated numerically as is stated hereinafter: Section 1. District No. 4 of the County Commission shall comprise a portion of the City of Marathon, a portion of Islamorada, Village of Islands, all of Key Colony Beach (City), all of Layton (City) and a portion of the unincorporated area of Monroe County and shall be more particularly described as follows: All of the territory lying Northerly of the Seven Mile Bridge (less the area Lying Northerly of U.S. No. 1, from the North end of the Seven mile Bridge to the centerline of 63rd Court), commencing at a point being three miles Southeasterly of a perpendicular line to U.S. Highway No. 1 at the North end of the Seven mile Bridge and extending Northeasterly to the shoreline of the City of Marathon; thence all of the Territory lying Southerly of U.S. Highway No. 1 at the North end of the Seven Mile Bridge and extending along the centerline of U.S. Highway No. 1 to a point on the intersection of the centerline of 63rd Court; thence all of the territory laying Northeasterly and Northerly of the centerline line of 63rd Court lying Northerly of U.S. Highway No. 1, along the centerline of 63rd Court in a Northerly direction to the shoreline of the City of Marathon, and extending along the centerline of 63rd Court for three miles in a Northwesterly direction into the Gulf of Mexico; Also all of the remaining territory of the City of Marathon and all of the Territory Northeasterly of the City of Marathon extending to a point on U.S. Highway No. 1 where it intersects the centerline of Plantation Avenue in Tavernier; thence in a Westerly direction along centerline of Plantation Avenue to the shoreline of the Gulf of Mexico and then extending the centerline of Plantation Avenue, Westerly into the Gulf of Mexico for 9 miles; also the territory lying Southerly of U.S. Highway No. 1 to the shoreline of Tavernier Creels; thence Southerly along the centerline of Tavernier Creek to the Atlantic Ocean and then to a line extending Easterly 3 miles into the Atlantic Ocean. Section 5. District No. 5 of the County Commission shall comprise the following more particularly described territory of Monroe County: All of the territory lying Northerly of the centerline of U.S. Highway No. 1 where it intersects the centerline of Plantation Avenue in Tavernier; thence in a Westerly direction along centerline of Plantation Avenue to the shoreline of the Gulf of Mexico and then extending the centerline of Plantation Avenue, Westerly into the Gulf of Mexico for 9 miles; also the territory lying Northerly of U.S. Highway No. 1 to the shoreline of Tavernier Creek; thence Southerly along the centerline of Tavernier Creek to the Atlantic Ocean and then to a line extending Easterly 3 miles into the Atlantic Ocean; said area extending to the Monroe County Line and the area known as the Florida mainland and Everglades. Section 6. This resolution with boundary descriptions shall be entered into the minutes of the Board of County Commissioners and, pursuant to Florida Statutes Sec.124.02 a certified copy of the minutes shall be published once each week for two weeks in a newspaper published in Monroe County. The Clerk shall send a certified copy of the minutes reflecting the boundaries of the districts as changed to the Department of State.
