Funding is Ad Valorem and Fines and Forfeiture. ITEM BACKGROUND: Siemens Industry, Inc. provides for the testing, certification, and maintenance of the fire alarm system, building automation system, and smoke control system of the Corrections' facilities and other County owned buildings. The existing Agreement terminates on April 19, 2021. At the May 20, 2020, the BOCC approved an agreement for the replacement of the existing, no longer supported Environmental Building Management Systems (EBMS) with a Desigo Enterprise BMS in the amount of $237,583.06 allowing the County to monitor additional sites remotely and locally in a unified system. This replaces obsolete systems in critical facilities. We are requesting a Purchasing Policy waiver to make the Siemens Industry contract a Sole Source and negotiate a new agreement. A Memo from Monroe County Information Technology Department to OMB is attached supporting the request. If this request is approved, further negotiations with Siemens will be conducted. If an agreement can be reached on suitable terms for the County, the new contract will be brought forth for BOCC approval at a future meeting. PREVIOUS RELEVANT BOCC ACTION: October 1, 2015 BOCC approved a month-to-month renewal agreement with Siemens Industry, Inc. pending the award of a new contract. October 1, 2015 Siemens was the sole respondent to a Bid Request for new services. Their submission included terms that were outside the scope of the original Bid Request. December 9, 2015 BOCC approved for negotiations to take place with Siemens until a satisfactory contract was achieved and then for it to be placed on an agenda for approval by the BOCC. April 20, 2016 BOCC approved a two (2) year agreement with three (3) optional one (1) year renewals with Siemens. Packet Pg.911 C.25 May 16, 2018 BOCC approved the First Amendment to the Siemens Agreement for a one-year renewal and a 2.1% CPI-U increase, added the Sheriff's Administration Building EST system, amended its Agreement as to the Public Records compliance, Non-Discrimination compliance, and Federal Required Contract Provisions. April 17, 2019 BOCC approved the Second Amendment to the Siemens Agreement for a one-year renewal and a 1.9 % CPI-U increase and added new statutory language as to scrutinized companies. This will enable cross building capabilities as well as provide remote access to any included building environmental control. In order to align with that project and ensure that activities and updates occurring during the c maintenance of the actual environmental equipment are updated appropriately in the Desigo management software, Siemens resources should also be responsible for the physical maintenance described in the contract, "Fire Alarm System, Building Automation System and Smoke Control System Testing, Certification and Maintenance" for Corrections and other Facilities.
