The task order is funded by FDOT Grant GOU78 (80%) and Marathon Airport Operating Fund 403 (20%). ITEM BACKGROUND: Six (6) bids were received at the bid opening held on January 19, 2021 and the bid/contract award to the second lowest most responsive bidder Marino Construction Group is a companion item on the March 17, 2021 BOCC agenda, as well as Amendment 2 to FDOT grant contract GOU78 providing additional funding for the project. Upon construction notice to proceed to Marino, RPR services will begin. These construction support services are associated with the original scope of work for Task Order 12/15-87 DESCRIPTION OF WORK LO r cv r The RPR services will provide the following: 0 ARTICLE E-RESIDENT PROJECT REPRESENTATIVE(RPR) i • Attend pre-construction conference. • Coordinate and attend progress meetings with the contractor,Airport, and any other CL interested parties,as required prior to construction (e.g.Staging area coordination, setting up Contractor's trailer.). • Provide full-time RPR services for the work associated with the project. The RPR's for the project shall have field experience in the type of work to be performed, be fully qualified to make interpretations,decisions,field computations, and have knowledge of testing requirements and procedures. The RPR's shall be responsible for the following: LO • Checking of construction activities to ensure compliance with the plans and specifications. Inform the contractor and County of any work, which is in non- r compliance. CL • Coordinate quality assurance tests and verify they have been performed at the frequency stated in the specifications. • Review certifications for conformance with the specifications. • Maintain a set of working drawings on the job site,which can be used to prepare"As- Built"drawings. • Review the test reports and certifications for conformance with the specifications and maintain a file for all reports and certifications. N For the purpose of providing a stipulated fee amount, this proposal has been based on the following qualifications and assumptions: • Inspection services for building/permitting inspections is not in our scope(no inspectors on staff),none are anticipated by the architect/engineer. • Attendance and/or presentation to public hearings and/or other meetings with municipal agencies are not included. • Municipal Agency and all associated permit fees are to be paid by the client or contractor. Jacobs is not responsible for obtaining any permits. Permits are to be obtained by the contractor.Jacobs will monitor the contractor's progress through Page 2 of 4 Packet Pg. 2322 J.10.a the permit process for the client and provide follow up periodically with the permitting agency to verify the status,but it is ultimately the responsibility of the contractor to obtain all permits. • Services not described in the scope of work are not included. CL Construction Phase Services-If this Agreement includes the furnishing of any Services during the construction phase of the project,the following terms will apply: (a) If JACOBS is called upon to observe the work of CLIENT's construction contractor(s)for the detection of defects or deficiencies in such work,JACOBS will not bear any responsibility or liability for such defects or deficiencies or for the failure to so detect. JACOBS shall not make inspections or reviews of the safety programs or procedures of the construction contractor(s)and shall not review their work for the purpose of ensuring their compliance with safety standards. (b) If JACOBS is called upon to review submittals from construction contractors,JACOBS shall review and approve or take other appropriate action upon construction contractor(s)' submittals such as shop drawings, product data and samples,but only for the limited purpose of checking for conformance with information given and the design concept expressed in the contract documents. JACOBS' action LO shall be taken with such reasonable promptness as to cause no delay in the work while allowing sufficient time in JACOBS' professional judgment to permit adequate review. Review of such submittals will not be conducted for the purpose of determining the accuracy and completeness of 0 other details such as dimensions and quantities. (c) JACOBS shall not assume any responsibility or liability for performance of the construction services,or for the safety of persons and property i during construction,or for compliance with federal, state and local statutes,rules,regulations and codes applicable to the conduct of the construction services. JACOBS shall have no influence over the construction means,methods,techniques,sequences or procedures. Construction safety shall remain the sole responsibility of the construction contractor(s). (d) All contracts between CLIENT and its construction contractor(s)shall contain broad form indemnity and insurance clauses in favor of CLIENT and JACOBS, in a form satisfactory to JACOBS. 0 On-Site Services During Construction-The presence or duties of Jacobs' personnel at a construction site,whether as onsite representatives or otherwise,do not make Jacobs or Jacobs' personnel in any way responsible for those duties that belong to Client and/or the construction contractor or other entities,and do not relieve the construction contractor or any other entity of their obligations, duties,and responsibilities, including,but not limited to,all construction methods,means,techniques,sequences,and procedures necessary for coordinating and completing all portions of the construction work in accordance with the construction Contract ' LO Documents and any health or safety precautions required by such construction work. o Jacobs and Jacobs' personnel have no authority to exercise any control over any construction CL contractor or other entity or their employees in connection with their work or any health or safety precautions and have no duty for inspecting,noting,observing,correcting,or reporting on health 0 or safety deficiencies of the construction contractor(s)or other entity or any other persons at the site except Jacobs' own personnel. The presence of Jacobs' personnel at a construction site is for the purpose of providing to Client a greater degree of confidence that the completed construction work will conform generally to the construction documents and that the integrity of the design concept as reflected in the construction documents has been implemented and preserved by the construction contractor(s).
