ITEM BACKGROUND: On January 22, 2020; the Board of County Commissioners (BOCC) adopted Ord. 005-2020 and 006-2020 to extend the remaining market rate ROGOs out for an additional three (3) years from 2023 to 2026; providing the County additional time to distribute ROGO allocations while the new hurricane evacuation model runs are completed and to implement other strategies to help transition land into public ownership reducing the potential takings claims and addressing the future build-out of the Florida Keys. The revised ROGO distribution extended the time period through 2026, rather than the previous sunset date of 2023. In order to extend the date to 2026, the number of annual residential allocations were reduced so that total allocations would remain at 1,970 for the period July 2013 through July 2026. In this amendment, the annual ROGO allocations for Big Pine Key and No Name Key were similarly reduced from eight (8) annual allocations to four (4) to extend the allocations through 2026. This extension of the Big Pine Key and No Name Key allocation distribution timeframe is beyond the expiration date of the ITP. An excerpt of the amendment is provided below. Based on this revised ROGO distribution extension to 2026, the County would like to examine the option of a minor modification to the ITP in accordance with paragraph I.I. of the ITP permit to extend the expiration date to June 30, 2026. It is important to note that no increase in development or take is being requested, simply an extension of the expiration date. The extension of the ITP to 2026 would allow applicants on Big Pine Key and No Name Key to continue to be covered by the authorized take (H impacts) within the ITP and not require the applicant to apply for an individual take permit after June 30, 2023 (i.e., between June 2023 Packet Pg.4' B.1 through July 2026 of the remaining ROGO distribution, an individual applicant would need their own authorizations required under the Endangered Species Act to proceed with their proposed development). Staff is presenting this information to the BOCC and hopes to schedule a future agenda item (future BOCC meeting) to receive direction from the BOCC. The ITP expires on June 30, 2023. Packet Pg. 5 B.1 The HCP/ITP regulates the type and amount of development on Big Pine Key and No Name Key for the duration of the permit. The core of the protections is based on limiting development through the number of permits for new development that are to be issued for the life of the permit. Specifically, the HCP requires that development activities in the project area will occur in accordance with the following guidelines, which ensure avoidance and minimization of impacts to the Key deer and other covered species: • The total impact of commercial, institutional, and residential development over 20 years will not exceed H = 1.1. • New residential development will be limited to a maximum of 200 dwelling units over 20 years. • New residential development in Tier 1 areas will be limited to no more than five percent of all residential units permitted over the 20-year period (i.e., a maximum of 10 units) or a total H = 0.022 (two percent of the total H), whichever results in a lower H. • No new development other than single-family residential and accessory uses will be permitted in Tier 1. The total H of all development in Tier 1 will not exceed H = 0.022. The above listed guidelines are the ones that are specific to growth management controls, there are other guidelines not spelled out herein that deal more directly with habitat and species protection. As of December 2020, Monroe County has issued 177 (89% of allowed) permits for new residential development on Big Pine Key and No Name Key. All development activity as of December 31, 2020 has a total H impact of 0.5792 (53 % of allowed). Further, 99% (3.2954 `H') of the total 3.3 `H' mitigation required by the HCP and ITP has been acquired. As of December 2020, Monroe County has issued five (5) of the 10 Tier I permits (50% of allowed based on a maximum of 10 units)with a total H impact of 0.0107 (49% of allowed). While the HCP/ITP expires in June Of 2023, the BOCC adopted amendments to the Comprehensive Plan and Land Development Code to reduce annual allocations and extend ROGO until July 12, 2026. This amendment reduced the annual allocations for Big Pine Key and No Name Key from 8 dwelling units annually to 4 units annually, and extended the allocation distribution timeframe beyond the expiration date of the ITP. The expiration of the HCP would result in permittees having to consult directly with the U.S. Fish & Wildlife Service (USFWS) under Section 10 of the Endangered Species Act. The consultation process is lengthy, and may result in allocations and/or building permits expiring before the consultation process is completed. Based on the above, Planning & Environmental Resources staff have identified the following four (4) potential options for future growth management on Big Pine Key and No Name Key for the BOCC's future consideration: 1. Update the HCP and ITP to extend take approval to coincide with ROGO distribution timeframe through 2026. Packet Pg. 6 B.1 This option would be a minor modification to the ITP in accordance with paragraph I.I. of the permit to extend the expiration date from June 30, 2023 to June 30, 2026. This option would require the preparation and submittal of a HCP/ITP renewal application which would address the need for the extension. The County's application for permit renewal will also require a public notice by the USFWS. The permit renewal application would be something like an HCP addendum that would explain the requested changes and to justify that the amount of take would not exceed beyond what has already been approved by USFWS. Preliminary discussions with the USFWS have indicated that such request would be possible and relatively simple . This submission could be handled by staff and would provide applicants on Big Pine Key and No Name Key to continue to be covered by the authorized take (H impacts) within the ITP and not require the applicant to apply for an individual take permit after June 30, 2023 (i.e., between June 2023 through July 2026 of the remaining ROGO distribution, an individual applicant would need their own authorizations required under the Endangered Species Act to proceed with their proposed development). This option also provides the County additional time, consistent with the distribution of ROGO allocations in the Upper and Lower Keys subareas, to evaluate/address the outcomes from the next hurricane evacuation clearance time modeling by the State and the State's determination on the availability of additional allocations. Note, DEO/DEM will run an evacuation model after the compilation of the 2020 Census data. Staff anticipates this process may take two to three years, and this will be the earliest point in time that the County will be able to evaluate the hurricane evacuation modeling results based on any changes experienced in the inputs and assumptions utilized. 2. Extend the HCP/ITP as above, to extend take approval to coincide with ROGO distribution timeframe through 2026 but only for properties within CBRS areas. This option would extend the expiration date to June 30, 2026, but would only cover properties within CBRS areas. This would require applicants for properties outside a CBRS area on Big Pine Key and No Name Key to apply for an individual take permit after June 30, 2023. This option would require a new analysis and submittal of a new HCP/ITP application to USFWS to only cover properties within CBRS areas. The process will likely be lengthy and require a Request for Proposals (RFP), the contracting of a consultant to prepare the analysis and application, and the associated funding to cover this work. This option would also require the preparation and processing of Comprehensive Plan and Land Development Code amendments which take approximately 12- to 18 to process and become effective. This option would NOT extend the expiration date to June 30, 2026, and would require applicants on Big Pine Key and No Name Key to apply for an individual take permit after June 30, 2023 (i.e., between June 2023 through July 2026 of the remaining ROGO distribution, an individual applicant would need their own authorizations required under the Endangered Species Act to proceed with their proposed development). The consultation process is lengthy, and may result in allocations and/or building permits expiring before the consultation process is completed. This option would also require the preparation and processing of Comprehensive Plan and Land Development Code amendments which take approximately 12- to 18 to process and become effective. Considerations for this option: • Affects allocations, ROGO/NROGO, Tier I development, mitigation, clearing, fences, accessory uses, etc. • From FEMA BO settlement: In the event that current HCPs designated in the Florida Keys under section 10 of the Act expire, all properties addressed by these HCPs that fall within the Species Focus Area Maps will be referred to the Service for review per the guidelines in this RPA. • This option in effect"turns back the clock" to the review procedures used prior to the adoption of the HCP/ITP. All development proposals on Big Pine Key and No Name Key would have to seek independent authorization from the U.S. Fish & Wildlife Service. Packet Pg. 9 B.1 4. Let the HCP/ITP expire and incorporate Tier Overlay District criteria into Comprehensive Plan & Land Development Code - not including any remapping of Tier designations. This would also necessitate revising the Livable CommuniKeys Plan. This option would require the preparation and processing of Comprehensive Plan and Land Development Code amendments which take approximately 12 to 18 months to process and become effective. It should be noted, as in the option above, this option would also result in all development proposals having to seek independent authorization from the U.S. Fish & Wildlife Service. Applicants on Big Pine Key and No Name Key would not be covered by the authorized take (H impacts)within the ITP between June 2023 through July 2026. PREVIOUS RELEVANT BOCC ACTION: On August 18, 2004, the BOCC adopted the Master Plan for Future Development of Big Pine Key and No Name Key into the 2010 Comprehensive Plan via Ordinance 029-2004. This ordinance included amendments to Objective 103.1 requiring Monroe County to regulate future development and coordinate the provision of public facilities on Big Pine Key and No Name Key, consistent with the Goals, Objectives, and Policies of this Comprehensive Plan, the Livable CommuniKeys Master Plan and the Habitat Conservation Plan for Big Pine Key and No Name Key. On April 13, 2016, the BOCC adopted the 2030 Comprehensive Plan via Ordinance 005-2016, which included Policy 101.6.2 establishing the annual maximum number of residential permit allocations that may be awarded in Tier to be no more than one (1) every 2 years in the Big Pine Key/No Name Key subarea. On April 13, 2016, the BOCC adopted Ordinance 006-2016 amending the Land Development Code. This included amending Sections 138-24(a)(4)b and 138-24(a)(5) to limit Tier I allocations on Big Pine Key and No Name Key to no more than one (1) allocation every 2 years. On January 22, 2020, the BOCC adopted Ordinance 005-2020 amending Monroe County Comprehensive Plan Policy 101.3.2 to extend the time period of ROGO through 2026. On January 22, 2020, the BOCC adopted Ordinance 006-2020 amending Monroe County Land Development Code Section 138-24 to extend the time period of ROGO through 2026.
