Item O4 NOTICE OF INTENTION TO CONSIDER ADOPTION OF COUNTY ORDINANCE NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday, May 17, 2000, at 3:00 PM at the Key Largo Library, Tradewinds Shopping Center, Key Largo, Monroe County, Florida, the Board of County Commissioners of Monroe County, Florida, intends to consider the adoption of the following County ordinance: AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AMENDING SECTION 2-388, MONROE COUNTY CODE, IN ORDER TO ADD LOCAL ROAfi> PATROL LAW ENFORCEMENT SERVICES AS AN ESSENTIAL MUNICIPAL SERVICE TO THE MONROE COUNTY GENERAL PURPOSE MUNICIPAL SERVICE TAXING UNIT; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person decided to appeal any decision made by the Board with respect to any matter considered at such hearings or meetings, he will need a record of the proceedings, and that, for such purpose, he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. Sec. 2-388, Monroe County Code, is hereby amended to read: Sec. 2-388. Created; purposes. There is hereby created, pursuant to the authority granted in chapter 125, Laws of Florida, and article 7, section 9(b), Florida Constitution, a municipal service taxing unit (district) for the purpose of providing the following essential municipal services: (a) Land use planning, including but not limited to all those functions described in the Local Government Comprehensive Planning Act as amended, Florida Statutes, section 163.3161 et seq., and chapter 380, Laws of Florida; (b) Drafting and analysis of all land use or building regulations, of whatever type and however denominated, when so requested by the board of county commissioners; (c) The administration and enforcement of all building codes and controls, including the issuance of permits; (e) Code enforcement under chapter 162, Laws of Florida (f) The office of the fire marshal, whose duties shall be as defined by general and special law and county ordinance and resolution; aAd (g) Parks, beaches and recreation, the provision of which shall be as authorized by general and special law and county ordinance and resolution; and (h) Local road Datrol law enforcement services which means reQularlY scheduled patrol by uniformed law enforcement' officers in marked oatrol cars whose full-time duty assignment involves resoondina to calls for service and enaaaina in crime prevention activities. seraeants who orovide first-line suoervision to those officers, and aeneral case detectives not assigned to investiaate maior crimes or function as crime scene technicians. In carrying out the purposes described in this article, the district shall be financed from ad valorem taxes collected solely within the district. Nothing contained herein shall prevent the district from charging various fees, as determined by the board of county commissioners, for any service or services rendered to any specific person or persons, regardless of whether such person or persons are real or incorporeal. However, when such fees are collected by any deE>artment of the county or a law enforcement aaencv in the course of providing any of tHe services described in subparagraphs (a) through (e} .U:11 of this section, then those fees may only be expended by the department or law enforcement aaencv which collected them. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
