AGENDA ITEM WORDING:
An ordinance declaring that an emergency exists and waiving notice by a four-
fifths vote, amending Ordinance No. 031-1988 in order to delete the
municipality of Key Colony Beach from the Lower And Middle Keys Fire And
Ambulance District.
ITEM BACKGROUND:
Key Colony Beach declared, in its Ordinance No. 333-2000, that it is no longer a part of
the Lower And Middle Keys Fire And Ambulance District, a MSTU. The amendment to
Monroe County Ordinance No. 031-1988 must be adopted by July 1, 2000, making time
of the essence.

AN ORDINANCE DECLARING THAT AN EMERGENCY EXISTS AND
WAIVING NOTICE BY A FOUR-FIFTHS VOTE; AMENDING
ORDINANCE NO. 031-1988 IN ORDER TO DELETE THE
MUNICIPALITY OF KEY COLONY BEACH FROM THE LOWER AND
MIDDLE KEYS FIRE AND AMBULANCE DISTRICT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES
INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION
INTO THE MONROE COUNTY CODE OF ORDINANCES; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, in Key Colony Beach Ordinance No. 333-2000 the City declared that
it is no longer a part of the Lower And Middle Keys Fire And Ambulance District (the
District), a MSTU;
WHEREAS, it is desired to amend the ordinance creating the District to reflect the
City's action; and
WHEREAS, such amendment must be adopted by July 1, 2000, making time of the
essence; now, therefore
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that:

Section 1. An emergency is hereby declared and notice waived by a four-fifths
Section 2. Ordinance No. 031-1988, Sec. 3, is hereby amended by the addition
of subsection 3(j) to read as follows:
1) Notwithstandino any lanouaoe to the contrary in this section, sec. 13,
or elsewhere in this ordinance, all land within the municioality of Key
Colony Beach is excluded from the district.
Section 3. If any section, subsection, sentence, clause or prOVIsion of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance
are hereby repealed to the extent of said conflict.
Section 5. The provisions of this ordinance shall be included and incorporated in
the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment

thereto, and shall be appropriately renumbered to conform to the uniform numbering
system of the Code.
Section 6. This ordinance shall take effect when a certified copy of this
ordinance has been accepted by the postal authorities of the United States for special
delivery by registered mail to the Secretary of State of the State of Florida in accordance
with the provisions of Florida Statute 125.66(3).
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the 14th day of June, 2000.
