AGENDA ITEM WORDING: Consideration of a request by the Monroe County Housing Authority for an award of 50

ITEM BACKGROUND: The Monroe County Housing Authority has received conditional approval funds in the amount
of $2,373,045 for the construction of Affordable Housing. Per Resolution 06-1996, the Monroe County Land Authority
has reserved funding in the amount of $1 ,573,600 for Affordable Housing. The award of the 50 replacement unit building
pennits would enable Monroe County Housing Authority to construct the rental units on scattered sites from Key Largo to
Stock Island within Unincorporated Monroe County. The Planning Commission recommended approval of the request on
May 24, 2000.
PREVIOUS RELEVANT BOARD ACTION: The Board of County Commissioners has indicated a desire to construct
affordable housing rental units that will best meet the needs of county residents. Twenty-six (26) of the replacement units
have previously been awarded by the BOCC to the Tradewinds Project in Key Largo.

A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS AWARDING FIFTY (50)
FEMA REPLACEMENT UNIT PERMIT ALLOCATIONS
TO THE MONROE COUNTY HOUSING AUTHORITY
FOR THE CONSTRUCTION OF AFFORDABLE HOUSING
RENTAL UNITS TO BE LOCATED ON SCATTERED
SITES IN UNINCORPORATED MONROE COUNTY FROM
KEY LARGO TO STOCK ISLAND
WHEREAS, Monroe County has designated the Monroe County Housing Authority as its
agent for affordable housing and Fair Housing, and;
WHEREAS, the Board of County Commissioners of Monroe County recognizes and is
committed to addressing the problem of affordable housing to meet the social and economic
needs of County Residents, and;
WHEREAS, Monroe County and the Department of Community Affairs executed a
Memorandum of Agreement dated December 27,1999 providing for ninety (90) replacement
unit ROGa allocations dedicated for affordable housing in unincorporated Monroe County,
and;
WHEREAS, The Monroe County Housing Authority has received conditional approval of
funds for the construction of affordable housing in the amount of $2,373,045 from the Federal
Emergency Management Agency, and;
WHEREAS, Resolution 06-1996 of the Monroe County Comprehensive Land Authority had
reserved funding in the amount of $1,573,600 in support of affordable housing development
by the Monroe County Housing Authority in Monroe County, and;
WHEREAS, The Monroe County Comprehensive Plan Land Authority Advisory Board
voted unanimously (5/0) at their May 24, 2000 meeting, to recommend the Board of County
Commissioner, sitting as the Monroe County comprehensive Plan Land Authority, adopt an
update of Resolution 06-1996 to include as a qualified strategy, the purchase of land for the
development of single family and/or duplex affordable housing rental units, and;
WHEREAS, the Monroe County Planning Commission heard the request of the Monroe
County Housing Authority and voted unanimously (5/0) at their May 24, 2000 meeting to
recommend approval to the Board of County Commissioners with the following
recommendations;
· Recommend approval of the Bou9ing Authority's Request for all award of the
t'ift}. (50) ROGO, nutrient credit free, replacement units.
· Support the proposal to construct single family and duplex: units on ~cattered lots
through out Keys for low1 moderate and very low-income levels.
· Recommend that the Land Authority and Housing Authority not be constrained to
placing one third of the units in the upper. lower, and middle Keys.
· Furthermore, the Planning COIDJIlission directed staff to prepare an amendment to
the LDRs. which would permit affurdable housing to be used for affordable elderl)'
housing for individuals who currently live in Monroe County.
NOW, TBE.REFORE, BE IT RESOLVED, by the Monroe County Board of County
Commissioners the County hereby:
Approves the award of fifty (50) FElV!A replacement unit permit allocations to the Monroe
COWlty Housing Authority for the construction of affordable housing rental unitS located in
unincorporated Monroe Counly on scattered sites from Key Largo to Stock Island.
Directs Staff to recommend a mechani:lnl to provide that qualitIed elderly residents may be
included as eligible beneficiaries of the ninety (90) m1A replacement unit permit
allocations.

BACKGROUND
A 380 Agreement between Monroe County and the DCA was signed in December 1999
to allow for the replacement of dwelling units contained within illegal downstairs
enclosures. Under the Agreement the County is allowed to add 90 ROGO, nutrient credit
free, replacement residential unit credits toward the issuance of building permits for
affordable housing. These credits may be used for eligible projects throughout
unincorporated Monroe County, except Big Pine and No Name Keys. The award of these
credits to specific projects are required under the Agreement to be recommended by the
Planning Commission and approved by the Board of County Commissioners:
The Board of County Commissioners at the November 10, 1999 meeting adopted an
Affordable Housing Action Plan to guide appropriation of the ROGO replacement units.
One third of the units are to be distributed in each of the upper, middle, and lower areas
of the Keys. The Action Plan included criteria to be used by interested developers who
want to use the ROGO housing units. The criterion is for multifamily projects with rent
between $500 - $800. The BOCC awarded Tradewinds, a multifamily rental project, in
Key Largo twenty-six of the ROGO replacement units.
PROPOSAL
The Monroe County Housing Authority is requesting the award of 50 of the remaining
replacement units to be used to construct single and/or duplex rental housing on scattered
sites in unincorporated Monroe County. The units will be targeted to very-low and low-
income households, with no more than 40% of the units occupied by moderate-income
households. A minimum of ten percent of the units will be reserved for elderly housing.
STAFF ANALYSIS
· The proposal for constructing single-family houses and the inclusion of moderate
priced rental units does not meet the BaCC criteria for use of the replacement units.
· Affordable housing units to be eligible for a ROGO award are required to be owned
or rented to employees that receive 70% of their income from working in Monroe
County. Housing for the unemployed elderly would not be permitted in the
affordable housing, under the County definition..

· The County affordable criteria does not allow incomes above 100% of the medium,
the proposal is for moderate, 120% of the medium.
· If the award of 50 units is made to the Housing Authority, there will be 14 ROGO
replacement units remaining to allocate
PLANNING COMMISSION RECOMMENDATION
The Monroe County Planning Commission reviewed the request from the Housing
Authority at a meeting in Key Largo on May 24, 2000. And voted to:
· Recommend approval of the Housing Authority Request for an award of the 50
ROGO, nutrient credit free, replacement units.
· Support the proposal to construct single family and duplex units on scattered lots
though out the Keys for low, moderate and very low-income levels.
· Recommend that the Land Authority and Housing Authority not be constrained to
placing one third of the units in the upper, lower, and middle Keys.
· Furthermore, the Planning Commission directed staff to prepare an amendment to the
LDRs, which would permit affordable housing to be used for affordable elderly
housing for individuals who currently live in Monroe County.
STAFF RECOMMENDATION
· Consider increasing the flexibility for using the ROGO replacement units by
amending the criteria adopted by the BOCC in November 1999 to allow the
development of single family and duplexes on scattered lots throughout the KEYS.
· Support the Planning Commission direction to prepare an amendment to the LDRs,
which would permit affordable housing to be used for affordable elderly housing for
individuals who currently live in Monroe County.
· Require the Housing Authority to limit the rental of housing to the Medium income
level, rather than Moderate-l 20% of the medium.
· Staff recommends approval with the understanding that, unless the LDRs are
amended, residents who make 70% of their income working in Monroe County will
occupy the units and rentals will be limited to low, moderate and medium income
levels.

AFFORDABLE HOUSING (RENTAL) DEVELOPMENT PLAN
MONROE COUNTY HOUSING AUTHORITY
The Monroe County Housing Authority (MCHA) proposes to construct fifty (50) ncw single family
and/or duplex affordable housing rental units located at scattered sites in unincorporated Monroe County
from Key Largo to Stock Island.
We propose a mixture of two and three bedroom units, with a predominance of three bedroom units. \Vc
propose to reserve a minimum often units for occupancy by qualified elderly_
Occupancy shaH be dedicated to very Jow, low and moderatc income households as defined annually for
Monroe County by the U.S. Department of Housing and Urban Development (Attached). Properties
wi II be rented to qualified tenants under the terms of the Monroe County Housing Authority's Rental
AffordabiHty Policy. This policy provides that:
· Income targeting of very-low an low income households with no more that 40'% of the units
occupied by moderate income households.
· Monthly rents for very low and low-income households shall not exceed the amounts defined
annually fOT Monroe County by the U.S. Department of Housing and Urban Development (HUD).
· Monthly rents for modcrate.income households shan not exceed thc amounts defined annually by
the Florida Housing Finance Corporation (FHFC).
The location of the homes will be based on availability and subject to the following site selection criteria
developed in cooperation with the Monroe County Land Authority (MCLA):
· Unincorporated Monroe County, Key Largo to Stock Island
· Current zoning: IS, UR. URM, SR, SRL, MU
· Lot Size sufficient to accommodate 1300 sq. ft. single family home (min. SO' x 100'/5000 sq. ft.)
· Surrounding uses compatible with single family/duplex residential
· Acceptable l~'el of service along US Route I (C or higher)
· Dry lots only, no canal Jots or wetlands
· Very-low or low intensity environmental sensitivity:
VeT)'-low: ScarifiedlExotic vegetation
Low: Disturbed lots
· All lots subject to approval of Monroe County Housing Authority & Monroe County Land Authority

Weare requesting the Monroe County Board of County Commissioners. through a recommendation

Pending approval and initial land acquisition construction is anticipated to begin in early 200 I and
