ITEM BACKGROUND: This transmittal hearing is one of two public hearings required for amendments to the
Monroe County Year 2010 Comprehensive Plan. This proposed amendment will be transmitted to the
Department of Community Affairs for review. A second public hearing will be held so that the BOCC can adopt
the ordinance. At the November 1999 meeting before the Board of County Commissioners, the Planning
Department received conceptual approval from the Board to pursue the Livable CommuniKeys Program. The
Planning Department prepared a series of principles to guide local community plans. The principles and direction
for the Planning Department to implement the Livable CommuniKeys are set forth in this proposed amendment
to the Monroe County Year 2010 Comprehensive Plan. The Development Review Committee heard the item on
June 29, 1999 and recommended approval. The Planning Commission heard the item on both July 10 and July 19,
1999 and recommended approval. After public input, staff and the Planning Commission recommend adoption of
this ordinance containing the proposed amendment.
PREVIOUS RELEVANT BOARD ACTION: At the November 10, 1999 regular meeting of the Board of
County Commissioners, the Board approved, in concept, the Livable CommuniKeys Program.

This amendment is an initiative of the Monroe County Planning Department and
Planning Commission. During the course of 1999, Monroe County Planning Staff
realized a need for a more comprehensive approach to address the distinctive planning
needs of unincorporated Monroe County communities including greater participation and
oversight. A primary focus of the Monroe County Year 2010 Comprehensive Plan is
environmental protection. Although, Goal 101 of the Comprehensive Plan directs the
County to manage future growth and to enhance the quality of life, it does not articulate a
methodology to identify quality of life, what enhancements should be made, or where and
when they should be implemented.
The Monroe County Planning Department developed the Livable CommuniKeys
Program as a response to address these issues. To provide a framework for the Program,
the Planning Department developed a series of principles. The principles would be
incorporated into the development of Community Master Plans - to guide local
community planning efforts.
The Monroe County Planning Department determined that an amendment to the Monroe
County Year 2010 Comprehensive Plan to include the Livable CommuniKeys Program
and the Principles for Guiding Local Community Plans as the appropriate measure to
address the current deficiencies in the Monroe County Year 2010 Comprehensive Plan.

WHEREAS, the Monroe County Board of County Commissioners held a public hearing
for the purposes of considering the transmittal to the Florida Department of Community Affairs
for review and comment of a proposed amendment to the Monroe County Year 20 I 0
Comprehensive Plan adding Objective 101.20 and policy 101.20.1 consisting of a Livable
CommuniKeys Element including Principles for the Development of Local Community Plans;
and
WHEREAS, the Planning Commission and the Monroe County Board of County
Commissioners support the requested Monroe County Year 2010 Comprehensive Plan
amendment; and
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. The Board of County Commissioners does hereby adopt the recommendation of the
Planning Commission pursuant to the attached draft ordinance (marked as Exhibit 1) for adoption
of the Monroe County Year 2010 Comprehensive Plan; and
Section 2. The Board of County Commissioners does hereby transmit the proposed amendment
as part of the second (2nd) set of Comprehensive Plan amendments for 2000 to the Florida
Department of Community Affairs for review and comment in accordance with the provisions of
Sections 163.3184 and 380.0552, Florida Statutes; and
Section 3. The Monroe County staff is given authority to prepare and submit the required
transmittal letter and supporting documents for the proposed amendment in accordance with the
requirements of 9J-ll.006 of the Florida Administrative Code; and

Section 4. The Clerk of the Board is hereby directed to forward a certified copy of this resolution
to the Director of Planning and Environmental Resources.

WHEREAS, the Monroe County Planning Commission during two regular meetings
held on July 10 and July 19, 2000 approved the amendment to the Monroe County Year 2010
Comprehensive Plan adding Objective 101.20 and policy 101.20.1 consisting of a Livable
CommuniKeys Element including Principles for the Development of Local Community Plans;
and
WHEREAS, the Monroe County Development Review Committee during a regular
meeting held on June 29, 2000, approved an amendment to the Monroe County Year 2010
Comprehensive Plan adding Objective 101.20 and Policy 101.20.1 consisting of a Livable
CommuniKeys Element including Principles for the Development of Local Community Plans
after conducting a review and consideration; and
WHEREAS, the Planning Commission examined the following information:
1. The staff report prepared by Patrick Small, dated June 09, 2000; and
2. The sworn testimony of Monroe County Staff; and
3. Comments made by community members; and

WHEREAS, the Monroe County Land Development Regulations were not updated
concurrently with the adoption of the Monroe County Year 2010 Comprehensive Plan in 1996;
and
WHEREAS, discrepancies between the Land Development Regulations and the Monroe
County Year 2010 Comprehensive Plan have led to inconsistencies between existing land uses
and future land uses rendering some properties non-conforming; and
WHEREAS, discrepancies between the Land Development Regulations and the Monroe
County Year 2010 Comprehensive Plan have led to the need for continuous interpretations and
amendments to both the Land Use Regulations and the Monroe County Year 2010
Comprehensive Plan; and
WHEREAS, the absence of design guidelines to guide development and redevelopment
continues to precipitate generic redevelopment projects that compromise community identities;
and
WHEREAS, non-conforming properties have resulted in incompatibilities between
adjacent uses, the prohibition of appropriate uses where they should be permitted, general
confusion on the part of County citizens as to how the regulations apply to their property, and
additional significant County staff workloads spent pursuing time intensive rezoning applications;
and
WHEREAS, the aforementioned statements have led to the acknowledgment on behalf
of Monroe County Planning Staff of a need for a more individualized approach to planning within
Monroe County; and
WHEREAS, Monroe County Planning Staff have developed a framework to address a
new planning process with the intent of developing Master Plans for the island communities; and
WHEREAS, the Monroe County Board of County Commissioners has approved, in
concept, the implementation of the Livable CommuniKeys Program; and
WHEREAS, Phase One of the Livable CommuniKeys program directs Planning Staff to
draft work plans and provide technical and organizational tasks prior to working with the public;
and
WHEREAS, Monroe County Planning Staff has proposed a conceptual document
consisting of principles to direct the development of the Livable CommuniKeys Program called
Principles for Guiding Local Community Plans; and
WHEREAS, on May 10, 2000, Monroe County Planning Commission approved the
Livable CommuniKeys Principles; and
WHEREAS, Monroe County Planning Staff have determined that an amendment to the
Monroe County Year 2010 Comprehensive Plan to include the Livable CommuniKeys Program
and Principles for Guiding Local Community Plans is the appropriate measure to address current
deficiencies in the Monroe County Year 2010 Comprehensive Plan; and

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. Objective 101.20 of the Monroe County Year 2010 Comprehensive Plan be created
that reads as follows:
Obiective 101.20
Monroe County shall address local community needs while balancing the
needs of all Monroe County communities. These efforts shall focus on the
human crafted environment and shall be undertaken through the Livable
CommuniKeys Planning Program.
Section 2. Policy 101.20.1 of the Monroe County Year 2010 Comprehensive Plan shall
be created that reads as follows:
Policv 101.20.1
Monroe County shall develop a series of Community Master Plans.
Master Plans will be developed in accordance with the following
principles:
1. Each Community Master Plan will contain a framework for future
development and redevelopment including the designation of growth
boundaries and future acquisition areas for public spaces and
environmental conservation:
2. Each Community Master Plan will include an Implementation Strategy
composed of action items. an implementation schedule. and a monitoring
mechanism to provide accountability to communities:
3. Each Community Master Plan will be consistent with existing Federal and
State requirements and overall goals of the 2010 Comprehensive Plan to
ensure legal requirements are met. While consistency with the goals of the
2010 Comprehensive Plan is paramount. the 2010 Plan will be updated
and amended where appropriate:
4. Each Community Master Plan will be closely coordinated with other
community plans and other iurisdictions to ensure development or
redevelopment activities will not adversely impact those areas:
5. Each Community Master Plan will include appropriate mechanisms
allowing citizens continued oversight and involvement in the
implementation of their plans. Through the Community Master Plans.
programs for ongoinl! public involvement. outreach. and education will be
developed:
6. Each Community Master Plan will include a Capital Improvements
program to provide certainty that the provision of public facilities will be
concurrent with future development:
7. Each Community Master Plan will contain an environmental protection
element to maintain existing hie:h levels of environmental protection as
required in the 2010 Comprehensive Plan:

element that will address the protection and enhancement of existing
residential areas and the preservation of community character through site

throulZh collaborative efforts of citizens. the Planning Department. and
design professionals reinforcing the character of the local community

9. Each Community Master will include an economic development element
addressing current and potential diversified economic development
stratelZies includinlZ tourism management. The preservation and retention
of valued local businesses. existing economies. and the development of
economic alternatives will be encouraged through the process;
10. Each Community Master Plan will contain a Transportation Element
addressinlZ transportation needs and possibilities including circulation.
safe and convenient access to goods and services. and transportation
alternatives that will be consistent with the overall integrity of the
transportation system not resulting in negative consequences for other
communities; and
11. Each Community Master Plan will be based on knowledge of existing
conditions in each community. The Planning Department will compile
existing reports. databases. maps. field data. and information from other
sources supplemented by community input to document current
conditions; and
12. Each Community Master Plan will simplify the planning process
providing clarity and certainty for citizens. developers. and local officials
by providing a transparent framework for a continuing open dialogue with
different participants involved in planning issues.
Section 3. If any section, subsection, sentence, clause, item, change or provision of this ordinance
is held invalid, the remainder of this ordinance shall not be affected by such an invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of the said conflict.
Section 5. This ordinance is hereby transmitted to the Department of community Affairs to be
reviewed for compliance with Chapter 380, Florida Statutes.
Section 6. This ordinance shall be tiled in the Office of the Secretary of State, of the State of
Florida, but shall not become effective until a notice is issued by the Department of Community
Affairs or Administrative Commission approving this ordinance.

OVERVIEW
This report recommends adding a Livable CommuniKeys component to the Monroe County 2010
Comprehensive Plan.
Section I: Introduction
Background
Determining a need for community based planning, the Monroe County Planning Department
began research into a program that would take a comprehensive planning approach to address the
individual needs of Keys communities while increasing community participation in the local
planning process. The Livable CommuniKeys Program was developed and shortly thereafter
endorsed by the Board of County Commissioners. The development of the Livable
CommuniKeys framework began by establishing principles to direct the preparation of
Community Master Plans. Amending the 2010 Comprehensive Plan to include these principles is
a marked first step in the realization of the Livable CommuniKeys Program.
The Monroe County Year 2010 Comprehensive Plan, as it currently exists focuses on regional
and site specific environmental protection/regulation. It does not address quality of life for
residents and sustainable tourism for visitors.
Livable CommuniKeys is the local community planning initiative of the Monroe County
Planning Commission and the Planning & Environmental Resources Department. Livable
CommuniKeys will allow the Planning Department to refocus efforts away from making
incremental changes to the Future Land Use Map, the Zoning Map, and the Land Development
Regulations and the need for interpretation of existing regulations. Instead, the Livable
CommuniKeys program will be the forum in which community and redevelopment plans that
offer a clear direction for each community's future are prepared. These plans will pay attention to
quality of life issues, provide greater certainty and clarity for communities, reduce the need for
individual map amendments, eliminate the need for interpretations, streamline development
review, increase community-based input in planning decisions, and improve quality of service to
the public overall.
Direction of Plans for Individual Communities
The 2010 Plan's current one-size-fits-all approach to planning and development does not provide
the foundation for individual communities to develop according to their needs and aspirations.
Each island within the chain, however, is distinctive in its resources and needs. Livable
CommuniKeys engages each community, providing them with the tools to develop their own
distinct response to local planning issues. For the individual, Livable CommuniKeys provides the
tools for proactive community participation focusing on the quality and character of the built
environment.
Through a series of focus groups and interactive events designed to stimulate the involvement of
as many of Monroe County's permanent and seasonal residents as possible, the Livable
CommuniKeys Program will create a vision for our communities. This program will empower
individuals and groups to participate effectively in planning and create appropriate mechanisms
for meaningful public involvement in land use decisions. The vision will be articulated through
workshops, surveys, and ultimately a series of conceptual land use plans and images that translate
the values, goals and priorities of individual communities. The products of this process will help
the Planning Department identify the policies and regulations needed to guide land use decisions
for each community in Monroe County.
Interconnected Chain of Island Communities
Although Monroe County is composed of a series of individual communities, it is also an
environment of interconnected islands. There is a cause and effect relationship whereby critical
decisions made in one community impact others. Understanding these relationships will allow
communities to make informed decisions balancing their needs with the needs of other
communities. Each community must be sensitive to their extent of influence and the adverse
impacts their decisions may pose on other communities.
The County as a whole, has a responsibility to provide a sound framework to address a diversity
of planning issues effectively. The framework must be proactive yet responsive, flexible yet
certain. The County must also address recent incorporations and an evolving regional
responsibility. Coordination, participation, and facilitation are critical to the success of Livable
CommuniKeys.
Need For Principles to Guide Local Community Plans
The Principles for Guiding Local Community Development are needed to guide County staff and
citizens in establishing community plans developed through the Livable CommuniKeys Program.

The principles will guide the community planning process to ensure community plans are
compatible with their regional context. These principles reflect a responsible approach to
planning enabling communities to plan for their needs while respecting the needs of surrounding
communities and the larger region. Since infrastructure, the economy, the environment, and
transportation systems are interlaced and shared by neighborhoods and communities across
islands and beyond individual jurisdictions, checks and balances will be integrated into the
process to ensure that shared resources are distributed equitably.
Similar to the Principles for Guiding Development outlined in Chapter 380 of the Florida
Statutes, the principles developed to guide local community plans in Monroe County will provide
a clear directive to coordinate development and redevelopment efforts throughout the County.
Section II: Principles for Guiding Community Plan Development
Principles for Guiding Community Planning
The following principles will guide the development of community plans through the Livable
CommuniKeys Program.
1. Each Community Master Plan will contain a framework for future development and
redevelopment
Livable CommuniKeys will help communities shape their landscape based on their needs and
desires. The community vision identified through the citizens will reflect the local response to
development and redevelopment. In addition, each community will develop a Community Master
Plan to incorporate community ideals and plans for action to be administered through the land
use and zoning framework. To provide greater future certainty, citizens assisted by the Planning
Department will develop growth boundaries for land uses, including defined commercial centers,
mixed land uses, residential uses, and future acquisition areas for public spaces and
environmental conservation.
2. Each Community Master Plan will include an Implementation Strate2V

and an implementation schedule as determined by the action items and the Capital Budget.
Accountability to the communities through the process will be provided with a monitoring and
feedback mechanism.
3. Each Community Master Plan will be consistent with existine: Federal and State
reauirements and overall e:oals of the 2010 Comprehensive Plan

Livable CommuniKeys Community Master Plans will comply with the requirements of the
Federal and State legislation. These requirements will set parameters for the planning process
and ensure that the legal requirements are met. While each Community Master Plan will be
consistent with the overall goals of the 2010 Comprehensive Plan, the 2010 Plan will be updated
and amended where appropriate.
4. Each Communitv Master Plan will be closelv coordinated with other communitv olans
and other iurisdictions
To ensure that activities will not adversely impact those areas, Livable CommuniKeys will
coordinate planning efforts throughout Monroe County. The program will coordinate with other
Community Master Plans in recognition of the interdependency of planning actions. The process
will also include coordination with the incorporated jurisdictions within Monroe County.
Examples of issues requiring regional coordination include:
Land Use/ Development Impact Review,
Transportation Management,
Affordable Housing,
Public Facilities,
Public Safety,
Solid Waste (including recycling),
Stormwater Management,
Economic Development,
Conservation,
Coastal Management,
Permit Allocation, and
Hurricane Evacuation.
5. Each Communitv Master Plan will include aoorooriate mechanisms so that citizens will
continue to have oversi2ht and involvement in the imolementation of their olans
To provide government accountability to citizens and citizen accessibility to planning issues,
each Community Master Plan will establish ongoing public involvement, outreach, and
educational programs that work best in each community. Examples may include, Island Planning
Offices, websites, ongoing newsletters, Community Councils, and other advisory boards.
Additional mechanisms identified through citizen participation will be explored.
6. Each Communitv Master Plan will include a Caoital Imorovements Pr02ram
In the interest of the availability of funding to implement plans, each Community Master Plan
will incorporate a Capital Improvements Program to provide certainty that the provision of
government facilities will be concurrent with future development.
7. Each Communitv Master Plan will contain an Environmental Protection Element
The Program will require communities to acknowledge the critical relationship between the
natural and built environments and maintain a positive balance between them. Community

Master Plans will maintain existing high levels of environmental protection as required in the
2010 Comprehensive Plan. This is important since environmental issues have been the primary
focus of the 2010 Plan with a great deal of public comment and technical research. It is
important to use these environmental regulations as the parameters for allowable future
development in the Keys.
8. Each Communitv Master Plan will include a Communitv Character Element that will
address the orotection and enhancement of existine: residential areas and the preservation
of communitv character throue:h site and buildine: desie:n e:uidelines
Each Community Master Plan will identify or develop local community character elements.
Design guidelines for public spaces, landscaping, streetscaping, buildings, parking areas and
other elements will be developed through collaborative efforts of citizens, the Planning
Department, and design professionals. Livable CommuniKeys will promote the preservation and
historic character of traditional building forms and ensure that both development and
redevelopment reinforce the character of the local community context.
9. Each Communitv Master Plan will include an Economic Develooment Element
Each Community Master Plan will address current and potential diversified economic
development strategies including tourism management and how it can be integrated into a
localized sustainable future. As well, Livable CommuniKeys will encourage the preservation and
retention of valued local businesses, existing economies, and the development of viable
economic alternatives. Diversified economies are necessary to ensure long term economic
stability and prosperity. The stability inherent in diversified economies positively reinforces the
long-term social and environmental integrity of island communities.
10. Each Communitv Master Plan will include a Transoortation Element
Each Community Master Plan will address transportation needs and possibilities including
circulation, and safe and convenient access to goods and services. Transportation alternatives
including bicycle and pedestrian connections and access will be examined. Projects approved
through the Livable Communi Keys process shall maintain the overall integrity of the
transportation system and not result in negative consequences for other communities.

Policy 101.20.1
Monroe County shall develop a series of Community Master Plans. Master Plans
will be developed in accordance with the followina: principles:

development and redevelopment including the designation of l!1'owth
boundaries and future acquisition areas for public spaces and
environmental conservation:

Section IV: Analysis and Consistency
The following discussion focuses on drawing clear connections between what Monroe County is
proposing by amending the 2010 Comprehensive Plan and the existing legislation. There are two
primary areas of concern, consistency with the 2010 Comprehensive Plan, and consistency with

the applicable State Legislation. The following discussion addresses how the proposed Objective
and Policy fit into the framework of the existing 2010 Plan, and how they address Section 9J-5
of the Florida Administrative Code and Chapters 163 and 380 of the Florida State Statutes.
The 2010 Comprehensive Plan
Goal 101 directs the County to manage future growth, to enhance the quality of life, ensure the
safety of County residents and visitors, and protect valuable natural resources. Objective
101.20.1 addresses the need for coordinated community planning efforts within Monroe County
providing a mechanism to manage future development and redevelopment. Through the Livable
CommuniKeys Program, Policy 101.20.1 addresses the integration of elements in the 2010
Comprehensive Plan through Community Master Plans, thus strengthening the Future Land Use
element in the 2010 Comprehensive Plan. Neither Objective 101.20 or Policy 101.20.1 subtract
from or diminish the significance of existing priorities as outlined in the 2010 Comprehensive
Plan.
Consistency with State Legislation
Section 9J-5 of the Florida Administrative Code
According to Section 9J-5.006 of the Florida Administrative Code, the purpose of the Future
Land Use element is to designate future land use patterns as reflected in the goals, objectives, and
policies of local government comprehensive plans. While the 2010 Comprehensive Plan has
been adopted and includes the requirements of Section 9J-5, Policy 101.20.1 supports the
following principles of the Future Land Use element outlined in Section 9J-5.006,
.:. To coordinate future land uses with the availability of facilities and services;
.:. To encourage the redevelopment and renewal of blighted areas;
.:. To encourage the elimination of or reduction of uses inconsistent with the
community's character and future land uses;
.:. To ensure the protection of natural resources;
.:. To discourage the proliferation of urban sprawl;
.:. To ensure the availability of suitable land for utility facilities necessary to support
proposed development; and
.:. To encourage the innovative use of land development regulations that may include
mixed use development techniques.
Chapter 380 of the Florida State Statutes
Policy 101.20.1 supports the following Principles for Guiding Development as established in
Section 380.0552:

.:. To strengthen local government capabilities for managing land use and development so
that local government is able to achieve these objectives without the continuation of the
area of critical state concern designation;
.:. To protect upland resources, tropical biological communities, freshwater wetlands,
native tropical vegetation for example, hardwood hammocks and pinelands), dune
ridges and beaches, wildlife and their habitat;
.:. To ensure the maximum well being of the Florida Keys and its citizens through sound
economic development;
.:. To limit the adverse impacts of development on the quality of water throughout the
Florida Keys;
.:- To enhance natural scenic resources, promote the aesthetic benefits of the natural
environment and ensure that development is compatible with the unique historic
character of the Florida Keys;
.:. To protect the historical heritage of the Florida Keys;
.:. To limit the adverse impacts of public investment on the environmental resources of the
Florida Keys;
.:. To make available adequate affordable housing for all sectors of the population of the
Florida Keys; and
.:. To protect the public health, safety, and welfare of the citizens of the Florida Keys and
maintain the Florida Keys as a unique Florida resource.
Section 380.0552 directs Monroe County to coordinate plans, programs, and regulatory activities
consistent with the principles for guiding development. Objective 101.20 directs Monroe County
to address local community needs while balancing the needs of all Momoe County communities.
Under Objective 101.20, Policy 101.20.1 instructs the County to prepare Community Master
Plans based on a set of principles to coordinate local community planning efforts. Therefore,
Objective 101.20 and Policy 101.20.1 support both the Principles for Guiding Development and
the directive to coordinate plans, programs, and regulatory activities consistent with these
principles.
Chapter 163
Chapter 163 of the Florida Statutes outlines the required and optional elements of
Comprehensive Plans. One purpose of Objective 101.20 is to integrate the Future Land Use
element of the 2010 Comprehensive Plan into a meaningful local planning context. By
addressing this element in the 2010 Comprehensive Plan, Policy 101.20.1 supports Chapter 163,
addressing:
.:. A conservation element for the conservation of, use and protection of natural
resources;
.:. An intergovernmental coordination element, specifically demonstrating that
consideration of particular effects of the local plan upon the development of
adjacent regions and jurisdictions;
.:. An economic element setting forth guidelines for development including commercial

and industrial uses; and
.:. A community design element which may consist of design recommendations for
development, redevelopment, the design of open spaces, and similar matters that
may aid developers in the in the future planning and development of land.
Additionally, Section 163.3181 promotes policy supporting public participation in the
comprehensive planning process to the fullest extent possible. Section 3181 directs local
governments to adopt procedures designed to provide effective public participation through the
broad dissemination of proposals and alternatives, opportunity for written comments, public
hearings, provisions for open discussions, communications programs, information services, and
consideration of and response to public comments. Policy 101.20.1 is consistent with Section
3181 since it includes a directive to develop appropriate mechanisms for citizen oversight and
involvement in the implementation of Community Master Plans.
Therefore, Objective 101.20 and Policy 101.20.1 support the goals and objectives of Chapter 163
of the Florida State Statutes.
Conclusion
Objective 101.20 and Policy 101.20.1 support the policies of the Monroe County 2010
Comprehensive Plan. The proposed Objective and Policy do not compromise the existing Goals,
Objectives, and Policies of the 2010 Plan, but serve to reinforce existing legislation.
Objective 101.20 and Policy 101.20.1 are also consistent with the goals and principles of Section
9J-5 of the Florida Administrative Code and Chapters 163 and 380 of the Florida State Statutes.
Section V: Resolution
Recommendation
Based on the above discussion and consistency with the Monroe County 2010 Comprehensive
Plan, Section 9J-5 of the Florida Administrative Code, and Chapters 163 and 380 of the Florida
State Statutes, the Planning Department recommends approval of the amendment to the 2010
Comprehensive Plan adding Objective 101.20 and Policy 101.20.1.

APPROVAL TO THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS OF THE AMENDMENT TO
THE MONROE COUNTY YEAR 2010 COMPREHENSIVE
PLAN ADDING A LIVABLE COMMUNlKEYS
ELEMENT INCLUDING PRINCIPALS FOR THE
DEVELOPMENT OF LOCAL COMMUNITY PLANS.
WHEREAS, during two regular meetings held on July 10 and July 19, 2000 the Monroe
County Planning Commission conducted a public hearing on the request filed by the Monroe
County Planning Department to amend the Monroe County Year 2010 Comprehensive Plan
adding Objective 101.20 and policy 101.20.1 consisting of a Livable CommuniKeys Element
including Principals for the Development of Local Community Plans; and
WHEREAS, the Monroe County Development Review Committee during a regular
meeting held on June 29, 2000, approved an amendment to the Monroe County Year 2010
Comprehensive Plan adding Objective 101.20 and Policy 101.20.1 consisting of a Livable
CommuniKeys Element including Principals for the Development of Local Community Plans
after conducting a review and consideration; and
WHEREAS, the Planning Commission examined the following information:
1. The staff report prepared by Patrick Small, dated June 09, 2000; and
2. The sworn testimony of Monroe County Staff; and
3. Comments made by community members; and
WHEREAS, the Monroe County Land Development Regulations were not updated
concurrently with the adoption of the Monroe County Year 2010 Comprehensive Plan in 1996;
and
WHEREAS, discrepancies between the Land Development Regulations and the Monroe
County Year 2010 Comprehensive Plan have led to inconsistencies between existing land uses
and future land uses rendering some properties non-conforming; and
WHEREAS, discrepancies between the Land Development Regulations and the Monroe
County Year 2010 Comprehensive Plan have led to the need for continuous interpretations and
amendments to both the Land Use Regulations and the Monroe County Year 2010
Comprehensive Plan; and
WHEREAS, the absence of design guidelines to guide development and redevelopment

continues to precipitate generic redevelopment projects that compromise community identities;
and
WHEREAS, non-conforming properties have resulted in incompatibilities between
adjacent uses, the prohibition of appropriate uses where they should be permitted, general
confusion on the part of County citizens as to how the regulations apply to their property, and
additional significant County staff workloads spent pursuing time intensive rezoning applications;
and
WHEREAS, the aforementioned statements have led to the acknowledgment on behalf
of Monroe County Planning Staff of a need for a more individualized approach to planning within
Monroe County; and
WHEREAS, Monroe County Planning Staff have developed a framework to address a
new planning process with the intent of developing Master Plans for the island communities; and
WHEREAS, the Monroe County Board of County Commissioners has approved, in
concept, the implementation of the Livable CommuniKeys Program; and
WHEREAS, Phase One of the Livable CommuniKeys program directs Planning Staff to
draft work plans and provide technical and organizational tasks prior to working with the public;
and
WHEREAS, Monroe County Planning Staff has proposed a conceptual document
consisting of principals to direct the development of the Livable CommuniKeys Program called
Principals for Guiding Local Community Plans; and
WHEREAS, the Principals for Guiding Local Community Plans include the following
elements:
.:. Each Community Master Plan will contain a framework for future development
and redevelopment including the designation of growth boundaries and future
acquisition areas for public spaces and environmental conservation; and
.:. Each Community Master Plan will include an Implementation Strategy
composed of action items, an implementation schedule, and a monitoring
mechanism to provide accountability to communities; and
.:. Each Community Master Plan will be consistent with existing Federal and State
requirements and overall goals of the 2010 Comprehensive Plan to ensure legal
requirements are met. While consistency with the goals of the 2010
Comprehensive Plan is paramount, the 2010 Plan will be updated and amended
where appropriate; and
.:. Each Community Master Plan will be closely coordinated with other community
plans and other jurisdictions to ensure development or redevelopment activities
will not adversely impact those areas; and
.:. Each Community Master Plan will include appropriate mechanisms allowing
citizens continued oversight and involvement in the implementation of their
plans. Through the Community Master Plans, programs for ongoing public

Planning Department, and design professionals reinforcing the character of the
local community context; and

including tourism management. The preservation and retention of valued local
businesses, existing economies, and the development of economic alternatives
will be encouraged through the process; and
.:. Each Community Master Plan will contain a Transportation Element addressing
transportation needs and possibilities including circulation, safe and convenient
access to goods and services, and transportation alternatives that will be
consistent with the overall integrity of the transportation system not resulting in
negative consequences for other communities; and
.:. Each Community Master Plan will be based on knowledge of existing conditions
in each community. The Planning Department will compile existing reports,
databases, maps, field data, and information from other sources supplemented by
community input to document current conditions; and
.:. Each Community Master Plan will simplify the planning process providing
clarity and certainty for citizens, developers, and local officials by providing a
transparent framework for a continuing open dialogue with different participants

WHEREAS, on May 10, 2000, Monroe County Planning Commission approved the
Livable CommuniKeys Principals; and
WHEREAS, Monroe County Planning Staff have determined that an amendment to the
Monroe County Year 2010 Comprehensive Plan to include the Livable CommuniKeys Program
and Principals for Guiding Local Community Plans is the appropriate measure to address current
deficiencies in the Monroe County Year 2010 Comprehensive Plan; and
WHEREAS, the Planning Commission made the following FINDINGS OF FACT based
upon the evidence presented:

1. Goal 101 of the Monroe County Year 2010 Comprehensive Plan directs the County

8. The proposed text amendment to the Monroe County Year 2010 Comprehensive Plan

WHEREAS, the Planning Commission made the following CONCLUSIONS OF LAW based
upon the evidence presented:
1. The amendment to the Monroe County Year 2010 Plan to include Objective 101.20
and Policy 101.20.1 is necessary and appropriate; and
2. Amending the Monroe County Year 2010 Comprehensive Plan to include Objective
101.20 and Policy 101.20.1 will improve the quality of service overall to
communities within Monroe County; and
3. Amending the Monroe County Year 2010 Comprehensive Plan to include Objective
101.20 and Policy 101.20.1 does not detract from the significance of the existing
Goals, Objectives, Policies, and overall intent of the Monroe County Year 2010
Comprehensive Plan; and
4. The amendment of the Monroe County Year 2010 Comprehensive Plan to include
Objective 101.20 and Policy 101.20.1 supports the principles of Section 9-J5.006 of
the Florida State Administrative Code; and
5. The amendment of the Monroe County Year 2010 Comprehensive Plan to include
Objective 101.20 and Policy 101.20.1 supports Section 380.0552 of the Florida State
Statutes; and
6. The amendment of the Monroe County Year 2010 Comprehensive Plan to include
Objective 101.20 and Policy 101.20.1 supports the Optional Elements of

NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION

Plan adding Section 101.20 and Policy 101.20.1 to include a Livable CommuniKeys Element
