Marlene CR*ay, Director f Planning of Growth Management To follow of re uired Agenda Item #: Key Largo Volunteer Ambulance Corps, Inc. is proposing a 2,992 square foot addition to their existing institutional use located in the median of U.S. #1, at approximately Mile Marker 98.3. The addition will be used to house equipment and vehicles on the ground floor and provide sleeping quarters for 24 hour on -call emergency medical technicians on the second floor. Due to their status as a federally tax-exempt non-profit organization, Key Largo Volunteer Ambulance Corps, Inc. is eligible to receive an exemption from the non-residential permit allocation system. The ambulance service is considered an institutional use and is allowed as -of -right in the Suburban Commercial (SC) land use district. The proposed addition will be serving the needs of current Monroe County residents and will not have any impact on hurricane evacuation time. The use also complies with County level of service standards and has been determined to be in compliance with all applicable Land Development Regulations and the Monroe County Year 2010 Comprehensive Plan. WHEREAS, during a regular meeting held April 26, 2000, the Monroe County Planning Commission conducted a public hearing on the request of Key Largo Volunteer Ambulance Corps, Inc. for an exemption to the non-residential permit allocation system for a 2,992 square foot addition to their existing building; and WHEREAS, the proposed development is located on property legally described as Parts of Lots 22 and 17 of the Model Land Plat, Island of Key Largo; and WHEREAS, the above -described property is located in the Suburban Commercial (SC) land use district; and WHEREAS, the Planning Commission was presented with the following evidence, which by reference is hereby incorporated as a part of the record of said hearing: 1. The request from Key Largo Volunteer Ambulance Corps, Inc.; and 2. The staff report from Donny Lang, Senior Planner, dated April 3, 2000; and 3. NOW THEREFORE; BE IT RESOLVED BY THE PLANNING COMMISSION OF MONROE COUNTY, FLORIDA, that the preceding Findings of Fact and Conclusions of Law, support their decision to recommend APPROVAL to the Board of County Commissioners of the request filed by Key Largo Ambulance Corps, Inc. for an exemption to the non-residential permit allocation system pursuant to Policy 101.3.4 of the Monroe County Year 2010 Comprehensive Plan. REQUEST FOR EXEMPTION FROM THE NONRESIDENTIAL PERMIT ALLOCATION SYSTEM PURSUANT TO POLICY 101.3.4, MONROE COUNTY YEAR 2010 COMPREHENSIVE PLAN. MEETING DATE: August 17, 2000 I. REQUEST: Key Largo Volunteer Ambulance Corps, Inc. is requesting an exemption from the nonresidential permit allocation system based on the ambulance corps' status as a federally tax exempt non-profit organization. Policy 101.3.4 states that: Development activity by federally tax-exempt non-profit educational, scientific, religious, social service, cultural and recreational organizations may be exempted from the permit allocation system by the Board of County Commissioners after review by the Planning Commission upon a finding that such activity will not adversely affect the hurricane evacuation objectives of the Comprehensive Plan... All other provisions of the Comprehensive Plan shall apply to development exempted from the Permit Allocation System, including compliance with the adopted levels of service for the provision of adequate public facilities. Key Largo Volunteer Ambulance Corps, Inc. is proposing a 2,992 square foot addition to the existing facility on property described as a part of Lots 22 and Lot 17, Model Land Plat in Key Largo (RE# 00088100.000100. The proposed two-story addition will increase the building footprint by 1,496 square feet. The proposed building addition is located in the Suburban Commercial (SC) Land Use District, in the median of U.S. #1, approximately Mile Marker 98.3. Page 1 of 2 RE # 00088100.000100 BOCC Staff Report H: PREVIOUS RELEVANT PLANNING COMMISSION ACTION; On April 26, 2000, by Resolution P33-00, the Planning Commission recommended approval to the Board of County Commissioners of the request filed by Key Largo Ambulance Corps, Inc. for an exemption to the non-residential permit allocation system pursuant to Monroe County Year 2010 Comprehensive Plan Policy 101.3.4. III. ANALYSIS: The proposed 2,992 square foot addition will be used to house equipment and vehicles on the ground floor, and provide sleeping quarters for 24 hour on -call emergency medical technicians on the second floor level. Currently, the existing building has 3,998 square feet of offices and garage area on the first floor and 2,816 square feet of office area on the second floor, for a total of 6,814 square feet of existing floor area. With the addition, the total floor area will be 9,806 square feet. The maximum allowable floor area is 10,706 square feet, which is the equivalent of the maximum floor -area ratio of 0.30 for this type of institutional use. The addition will serve the needs of current Monroe County residents, and will not have any impact on hurricane evacuation time. The proposed addition may be developed as -of -right. The project has been reviewed and found in compliance with Objective 101.1 which states, "Monroe County shall ensure that at the time a development permit is issued, adequate public facilities are available to serve the development at the adopted level of service standards concurrent with the impacts of such development." Site plans have been submitted and been found to be in compliance with all applicable Land Development Regulations and Year 2010 Comprehensive Plan. Key Largo Volunteer Ambulance Corps, Inc. has submitted documentation from the Internal Revenue Service (IRS) District Director dated November 4, 1988 stating that the organization is exempt from Federal Income Tax under section 501(a) of the IRS Code as an organization described in Section 501(c)(3). Articles of Incorporation were originally filed as a non-profit corporation on December 3, 1971. CONCLUSION AND RECOMMENDATION: Based on the fact that the addition to the ambulance corps building will not have any impact on hurricane evacuation objectives and that it has been found to be in compliance with the Monroe County Year 2010 Comprehensive Plan, the Planning Commission recommends to the Board of County Commissioners that an exemption be granted from the non-residential permit allocation system for the Key Largo Volunteer Ambulance Corps, Inc. An exemption to Monroe County Year 2010 Comprehensive Plan Policy 101.3.4 is required to construct a 2,992 sq. ft. addition to an existing institutional use; and 3.
