ITEM BACKGROUND: County has had an agreement since September 20, 1985 for the maintenance of traffic signals in the area of what is now the municipality of Marathon. County is relinquishing responsibility and jurisdiction over County roads, streetlights, and traffic signals in the new City of Marathon. TOTAL COST: BUDGETED: Yes No Cost to County: APPROVED BY: County Attorney x OMS/Purchasing Risk Management DIVISION DIRECTOR APPROVAL ~ DOCUMENTATION: Included x Follow Not required AGENDA ITEM # i.14 AMENDMENT TO AGREEMENT THIS AMENDMENT made and entered into this day of , 2000, by and between the State of Florida Department of Transportation, an agency of the State of Florida, herein called the "Department," and Monroe County, a political subdivision of the State of Florida, herein called "Maintaining Agency. " WHEREAS, the parties hereto did enter into a Traffic Signal Maintenance Agreement on September 20, 1985; and WHEREAS, said Agreement obligated Monroe County to maintain traffic signals along the State Highway System; and WHEREAS, the incorporation of municipalities of Islamorada, Village of Islands and the City of Marathon resulted in the County divesting responsibility and authority over roads situated in the municipal boundaries; now, therefore IN CONSIDERATION of the promises contained herein, the parties mutually agree and covenant as follows: 1. The Traffic Signal Maintenance Agreement entered September 20, 1985 shall be amended to delete those traffic signals lying and situate within the boundaries of the municipalities of Islamorada, Village of Islands and the City of Marathon, more particularly described as follows: In Marathon: 33rd Street, 55th Street, 89th Street, 107th Street, 109th Street, 121 st Street, Key Colony Boulevard, Coco Plum Road In Islamorada: Snake Creek, Plantation Key, Woods Avenue, Plantation Key. 2. All other provisions of the Agreement entered into September 20, 1985 not inconsistent herewith shall remain in full force and effect.
