Resolution setting the date, time and place for a public hearing of a proposed
abandonment of portions of Morris Avenue, Cross Key.
ITEM BACKGROUND:
Morris Avenue was platted in 1956 to be 100 feet wide. Shortly thereafter, a road
approximately 25 feet wide was built off-center and paved with asphalt. Over the next 40
years adjacent property owners erected fences and other structures (walkways, signs,
flagpoles, mailboxes), using the physical roadway as a guideline. As a result there are
numerous items in a right-of-way that is 50 feet wider than required by law. Since the
road ends at a trailer park on one side and a single family residence on the other, the
additional 50 feet in width are unnecessary for any public purpose.
To resolve most, if not all, of the prOblems posed by these encroachments, the Engineering
Department and County Attorney's Office have been working for several years to develop a
road abandonment plan acceptable to the affected property owners and which would not
reqUire the County to construct a new road centered on the existing right-of-way.
This proposal has been accepted in concept by the affected property owners and only a
metes and bounds description of each segment to be abandoned has delayed a final
proposal to the BOCC for abandonment. Those descriptions are now found in Exhibit A of
the Resolution approving a public hearing and will be provided to each affected property
owner with notice of the hearing.
Although existing utilities are not affected, abandonment of the segments is subject to an
access easement for utilities as an additional safeguard.

RESOLUTION SETTING THE DATE, TIME AND PLACE FOR A PUBLIC
HEARING CONCERNING THE PROPOSED ABANDONMENT OF
PORTIONS OF MORRIS AVENUE. CROSS KEY. KEY LARGO. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires
to renounce and disclaim any right of the County and the public in and to the hereinafter
described streets, alley-ways, roads or highways, and
WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public
hearing after publishing due notice of said hearing in accordance with said Chapter, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that the Board will hold a public hearing on February . 2001,
at 3:00 PM, at the Key Largo library, Tradewinds Shopping Center, Key Largo,
Florida, to determine whether or not the Board will renounce and disclaim any right of
the County and the public in and to the following described streets, alley-ways, roads or
highways as delineated on the hereinafter described map or plat, to-wit:

Dear Mr. Gelbman:
Subsequent to receIVIng a copy of your September 21 letter to the County
Commissioners. the County Attorney and I reviewed the issues surrounding a downsizing of
Morris Avenue. Although there arc le"gitimate concerns concerning access and distribution of the
portion of road proposed to be abandoned. we were able to determine that these issues can be
resolved and the abandonment can go forwaro as has been contemplated and agreed to by the
property owners for some two years.
The issue of a 20' wide access from the County Road to the last lot can be resolved by a
Unity of Title with the other lots whicb are in common ownership. As soon as I can ascertain that
a Unity of Title has been filed in the County's Public Records and can obtain a metes and bounds
legal description for the area to be abandoned, I will be placing this on the County Commission
Agenda to request approvaJ to advertise a public hearing to abandon the road. As you arc no
doubt awan; the abandonment of a portion of width of this road is extremely unusual since roads
arc generally abandoned by the entirety of their width. Of course, having a 100' width of side
street platted is also extremely unusual. The County has had to be inno~ative while being careful
cot to violate any laws governing road abandonments.
As soon as the Public Hearing can be scheduled, the owners along Morris Avenue will be
notified of the hearing date.
