Assuming there is a 20 feet road in the center, that leaves 15 feet on each side between the road and the adjacent private property. This area is generally used for utilities, mailboxes, stormwater management and parking. Many adjacent property owners landscape this area. Technically, any work performed in the right-of-way requires a right- of-way permit issued by the Public Works Department. Not all work is permitable. For instance, the right- of-way is public property so any attempt to fence it off would not be permitable. Also, any item that would be considered unsafe including some landscaping would not be permitable. Monroe County does not aggressively search for right-of-way violators. However, if an encroachment is unsafe or if a complaint is received Monroe County will respond until the issue is resolved. PREVIOUS RELEVANT BOCC ACTION: At the last BOCC meeting the Board asked for a report on this issue and requested that FDOT and Growth Management be present. STAFF RECOMMENDATION: No action required.
