He currently maintains his offices in Islamorada. B.A. History J.D. Law University of Arizona, 1971 University of Miami, 1975 Assistant State Attorney. Mr. Tobin was hired in 1976 to manage the Upper Keys Division of the State Attorney's Office. During most of his tenure Mr. Tobin was the only prosecutor north of Marathon. He was responsible for all criminal investigations and prosecutions for felonies, misdemeanors, and juvenile crimes. Mr. Tobin was also responsible for providing training to the law enforcement community in the upper keys on all aspects of criminal law and procedure. His experience includes more than more than 35 jury trials and hundreds of bench trials. Code Enforcement Special Prosecutor, Mr. Tobin was employed by the Monroe County Board of County Commissioners and the State Attorneys Office as special counsel to prosecute and enforce Monroe County's land development regulations and ordinances. This was the County's fIrst attempt at enforcing its codes and ordinances. Mr. Tobin also provided training for new code enforcement inspectors in investigative techniques and presentation of evidence. General Practice. For six years, Mr. Tobin maintained a civil trial practice and office practice with an emphasis on real property transactions including, real estate contracts, title examinations, and closings. The trial practice consisted of mortgage foreclosure, landlord-tenant, divorce and family law, and real estate related litigation. Land Use Practice. Mr. Tobin's practice, since 1987, has been primarily in the areas of land use, zoning, and environmental law. The practice involves the following sub-areas of law: civil litigation, administrative proceedings, and appellate practice. The focus of litigation has involved challenges to arbitrary and unreasonable regulations, inverse condemnation, extraordinary writs (mandamus, prohibition & injunction), and declaratory actions on a wide range of issues. December 21,2000 Page 1 Bars and Organizations .. Appellate Practice. Most cases in Momoe County are appealed, either by the permit applicant, the government, or affected parties. As a result, Mr. Tobin has substantial appellate experience before the Circuit Court and the District Court of Appeals.
