NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Monroe
County, Florida, will hold a publiC hearing on February 21, 2001, at 3:00 PM, at the Key
Largo Library, Tradewinds Shopping Center, Key Largo, Florida, for the purpose of
determining whether or not the following streets, alley-ways, roads or highways shall be
abandoned:
ALL OF BAHAMA ROAD NORTH, AS SHOWN ON PLAT OF MARION PARK,
RECORDED IN PLAT BOOK 4, PAGE 113, PUBLIC RECORDS OF MONROE COUNTY,
FLORIDA.
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person
decided to appeal any decision made by the Board with respect to any matter considered
at such hearings or meetings, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the appeal is to be based.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, RENOUNCING AND DISCLAIMING ANY RIGHT OF THE COUNTY AND
THE PUBLIC IN AND TO BAHAMA ROAD NORTH. MONROE COUNTY. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the publiC in and to the hereinafter described
streets, alley-ways, roads or highways, and
WHEREAS, due notice has been published and a publiC hearing has been held in accordance
with Chapter 336, Florida Statutes, and
WHEREAS, at said publiC hearing the Board considered the argument of all parties present
wishing to speak on the matter, and all premises considered concerning the renouncing and
disclaiming of any right of the County and the publiC in and to the hereinafter described streets,
alley-ways, roads or highways as delineated on the hereinafter described map or plat, and
WHEREAS, the Board has determined that vacation of the said road is for the general publiC
welfare, and conforms to the requirement of Florida Statutes Sees. 336.09 and 336.10, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Board hereby renounces and disclaims any right of the County and the public in
and to the following described streets, alley-ways, roads or highways as delineated on the
hereinafter described map or plat, to-wit:
ALL OF BAHAMA ROAD NORTH, AS SHOWN ON PLAT OF MARION PARK, RECORDED

Petitioners want to build a house on property adjacent to said road.
One of the requirements of Monroe County Building and Zoning is that
the road must be abandoned before a building permit can be issued.

recording fees incurred relative to this request for the vocation.
Petitioners further agree to grant any easement necessary for the fvrnishing Of
utilities. including without limitation. electric power. water. sewer. telephone. gos.

common with:n this area as to height. width and degree. upon request for such
service or by the Boord of County Commissioners through its outhorized agents. If
easements are so required. copies o! the executed documents will be providea

The FKAA Board of Directors approved at the June 16, :2000 meeting, the above referenced
project.
Pursuant to your request for the abandonment of the above-reference property, Staff has
researched your request and have no objection to the abandonment of these roads, since both are
uncleared and unimproved. The FKAA has no facilities on them nor will they be any in the future.

reviewed the subdivision plat you provided and has no objection to the abandonment of
Bahama Road North.
However, after reviewing the subdivision plat for Coco Plum North, FKEC DOES have
obiection to this abandonment.

My clients Spence H. Pass and Elizabeth A. Pass, his wife, are in the process of requesting that
the Board of County Commissioners, Monroe County, Florida, grant a road abandonment of the
above described roads.
As part of this process it is necessary to obtain letters of objection or no objection to the road
abandonments from utility companies.
Attached is a plat of Marion Park showing the proposed road abandonments in yellow. Also
enclosed is a Monroe County "Tax Map" showing the proposed road abandonments in yellow.
Your cooperation on these road abandonments would be greatly appreciated.

Request from Spence H. Pass and Elizabeth A. Pass for a
Road Abandonment of all of Bahama Road North in Marion
Park Subdivision, Key Largo, FL., MM 98.

Spence H. Pass and Elizabeth A. Pass, owners of Lots 1-12 of Block 4, Lots
1-6 of Block 5, and Lot 1, Block 6, of Marlon Park Subdivision have
requested the abandonment of all of Bahama Road North at MM 98, Key
Largo, FL.
Block 1 and 2 of Marion Park Subdivision are In the Suburban Commercial
(SC) land use district. Blocks 3, 4, 5, and 6 of Marion Park Subdivision are
in the Suburban Residential (SR) land u$e,district. There is no development
on Blocks 1-6. Blocks 7 and 8 are in the Improved Subdivision (IS) land
use district located at the southern end of-the subdivision. Each of the lots
in Block 7 and 8 is developed with single family residences.
Roadway Description
Bahama Road North, which is the subject of the request for abandonment
Is shown in Plat Book 4, Page 113 of the Public Records of Monroe County.
There is no evidence of any paving on the property, and the property is
heavily wooded and almost completely covered with vegetation.
Use of the Road
There is no current use of road.
Development Potential
The property surrounding Bahama Road North Is entirely owned by the
applicants. The abandonment of the road would add acreage to the parcel
of property to allow construction of a single family residence. Each single

family residence requires two (2) contiguous acres in the Suburban
Residential (SR) land use district.
Shoreline Access
The road being proposed for abandonment does not terminate on open
water.
Staff Review
A review of the records and an on site inspection of the property revealed
the following:
1. The original platted roadbed shows no signs of ever having
been completed. The entire property is covered heavily
wooded.
2. The applicants are the owners of all the property adjoining the
road proposed for abandonment.
3. The applicant has received letters of concurrency from the
Florida Keys Aqueduct Authority, BellSouth, the Florida Keys
Electric Cooperative Association and AT & T Cable. No
easements are anticipated in the. proposed abandonment area
from any utility.
4. The applicant has stated that the roadbed proposed for
abandonment serves no other property owner.
Conclusion
Staff recommends APPROVAL of the request by Spence H. Pass and
Elizabeth A. Pass for a road abandonment of all of Bahama Road North as
shown on Plat Book 4, Page 113 of the Public Records of Monroe County.

1. The road proposed for abandonment serves only the
applicant. Therefore the request for abandonment meets the
requirements as outlined in the Monroe County Code Section
16-1.
2. The road does not terminate on a body of water, and is
consistent with goal 213 of the Monroe County Year 2010
Comprehensive Plan.
3. Based on the application and supporting documentation, the
abandonment will not Impair the distribution of utilities in the
neighboring area.
